The 40-year-old man was charged with having unnatural sex with the girl, aged nine years and 10 months, on the balcony of an apartment in Cheras on April 8. Bernama reported that the man was charged under Section 377c of the Penal Code, read together with Section 16 (1) of the Sexual Offences Against Children Act 2017, which provides imprisonment of up to 30 years and whipping, if convicted. He pleaded not guilty to the offence after the charge was read out here yesterday. Judge Zulqarnain Hassan fixed June 17 for mention.

PETALING JAYA : An air-conditioning technician pleaded not guilty in the Kuala Lumpur sessions court today to sodomising his stepdaughter last month. Bernama reported that the 40-year-old man was charged with having unnatural sex with the girl, aged nine years and 10 months, on the balcony of an apartment in Cheras at 2am on April 8. He was charged under Section 377c of the Penal Code for carnal intercourse against the order of nature without consent, read together with Section 16(1) of the Sexual Offences Against Children Act 2017, which provides for imprisonment of up to 30 years and a whipping, upon conviction. Lawyer Charanpal Singh, representing the accused, asked for his client to be allowed bail, saying he was the sole breadwinner of the family and had to send his four other children, aged seven to 14, to school. He said the seven-year-old child had a heart problem and needed follow-up treatment in hospital. Judge Zulqarnain Hassan did not allow him bail and set June 17 for mention. The prosecution was conducted by deputy public prosecutor Faizah Khalilah Zaberi.

KUALA LUMPUR: An air conditioning technician today claimed trial at the Sessions Court to a charge of committing carnal intercourse with his nine-year-old step-daughter last month. The 40-year-old entered his plea after the charge was read out to him before judge Zulqarnain Hassan. He was accused of committing the act on the girl, as someone entrusted to her as a stepfather, whose relationship to him is such that he is not permitted under the law, religion, or custom to marry her. The alleged offence occurred at 2am at the balcony of an apartment in Cheras on April 8. The charge, under Section 377C of the Penal Code, provides a maximum 20-year jail term and is liable to whipping upon conviction. It was read with Section 16(1) of the Sexual Offences Against Children Act, which carries a jail term not exceeding five years and not less than two lashes if found guilty. Deputy public prosecutor Faizah Khalilah Zaberi did not offer bail due to the family ties between the accused and the victim. "Investigations reveal they live under the same roof. We are worried that if bail is given, he will harass her and the prosecution witnesses. "The accused is charged with a serious offence under the Penal Code, and it involves a child victim," she said. In mitigation, lawyer Charanpal Singh applied for bail for his client, who is supporting his unemployed first wife and four biological children aged between 14 and 7. "The victim is his second wife's daughter. He is not yet convicted under Section 377C, and if he is refused bail, he will not be able to take care of his family. "We have no objection if the court wants to impose other conditions, such as reporting to the police station. "I understand that this case involves a child victim. She is now under the care of her mother, who will surely not allow her to go near the accused," he said. In a rebuttal, Faizah stood by her stance not to offer bail. "Although the lawyer said the victim is under the mother's care, I ask the court to consider the fact that they are still married. "There is a high probability that he will harass her through various communications, and this is a sexual crime against a child, who is the accused's stepchild," she said. After hearing the submissions from the prosecution and defence, Zulqarnain denied the accused bail. "The court is of the opinion that it is not appropriate to give bail. "The charge is serious and it involves a sexual crime against a child," he said. The court set June 17 for document submission.

KUALA LUMPUR: An Indian national has pleaded not guilty in the Sessions Court here to charges of criminal breach of trust (CBT) involving more than RM140,000. Rajinder Singh, 57, was charged as the director of Vantage Trading Partners, with committing CBT of the company's funds amounting to RM141,486.12. The offence was allegedly committed at the company premises at Ilham Tower, Jalan Binjai here, on Oct 13 and Nov 26, 2021. He was charged under Section 409 of the Penal Code, which provides a prison sentence of not less than two years and a maximum of 20 years, whipping and is liable to a fine, if convicted. He also pleaded not guilty to an alternative charge of using the fund without the consent or ratification of a general meeting at the same location and date. The charge, under Section 218(1)(a) of the Companies Act, provides imprisonment for up to five years, or a fine of up to RM3mil, or both, upon conviction. Judge Zulqarnain Hassan did not allow the accused bail and set June 5 for mention. 'The principle of bail is to ensure the accused appears in court. The accused and his wife are foreign nationals, and this country is not their homeland. Therefore, bail is not allowed,' he said yesterday, Bernama reported. Earlier, deputy public prosecutor Mohamad Ikhwan Mohd Nasir did not offer bail, but said that if the court exercised its discretion to grant bail, he requested the bail amount at RM70,000 with two Malaysian guarantors. Lawyer Daniel Annamalai, representing Rajinder, requested that his client be allowed bail on the grounds that he has a wife, who is British, and two teenage children to support. 'The accused is not at risk of fleeing because he has lived in this country for seven years and has businesses in Malaysia, India, Bangladesh and Indonesia, in addition to being a 'trader' for the governments of the four countries,' he said.
