Trial postponed for alleged driver in fatal McKinley hit-and-run
Circuit Judge Trish Morikawa granted the motion Thursday and ordered the trial week for Mitchel Miya shiro to be continued to Sept. 8 from July 7.
The case of Miyashiro, who had 164 prior traffic citations, had incensed the public because he had never been jailed for any of his previous driving offenses.
Deputy Public Defender Reiko Bryant requested the continuance Tuesday on Mitchel Miyashiro's behalf by written motion.
She said in the motion that she is still investigating potential witnesses and waiting for medical records from The Queen's Medical Center.
'Given the severity of the instant charges and possible consequences /punishment stemming there from, counsel requests a continuance of the trial week to complete our ongoing investigations, ' Bryant said.
However, Deputy Prosecutor Landon Patoc objected to a continuance.
Miyashiro will be tried on first-degree negligent homicide for operating a vehicle in a negligent manner, collisions involving death or serious bodily injury, collisions involving bodily injury and driving without a valid license.
At the time Miyashiro was charged in December 2023, Honolulu Prosecutor Steve Alm said he would try to use Kaulana's Law, which allows enhanced sentencing of up to 20 years for drivers who do not remain at the scene of a fatal crash and render aid.
Yara and another girl were struck in a marked crosswalk at 6 :40 a.m. Feb. 15, 2023, at the intersection of Kapiolani Boulevard and Kamakee Street near Mc Kinley's athletic field.
Miyashiro fled the scene and turned himself in to police the following day.
Miyashiro has been held in lieu of $250, 000 bail at the Oahu Community Correctional Center since December 2023.
He was sentenced in April to one year in jail for a Jan. 5, 2023, citation for driving without a license, and given credit for time served.
The charge was upgraded from a petty misdemeanor to a misdemeanor after the Feb. 15, 2023, crash. He pleaded no contest Sept. 20, 2023, to the misdemeanor.

Myles Garrett declined to address his latest speeding ticket on Wednesday as he faced media for the first time since being cited for driving 100 mph in his Ferrari. The Cleveland Browns captain and six-time All-Pro defensive end was asked repeatedly about the infraction during media availability at Wednesday's Cleveland Browns practice. Each time he was asked about it, Garrett said that he preferred to discuss football. Garrett's 8th speeding ticket since joining Browns Garrett was cited on Aug. 9 for driving 100 mph in a 60 mph zone in the Cleveland suburb of Strongsville, Ohio. The incident took place on Saturday morning, a day after the Browns returned home from a preseason road game against the Carolina Panthers. The citation came with a $250 fine. The speeding citation was Garrett's eighth since he joined the Browns as the No. 1 pick in the 2017 NFL Draft. In 2022, Garrett flipped his Porsche and was cited for driving 65 mph in a 45 mph zone leading up to the rollover crash. Garrett sustained a shoulder sprain and biceps strain among other minor injuries in the crash that took place in September that year and sidelined him for Cleveland's Week 4 game against the Atlanta Falcons. Garrett returned to the field the following week and played the rest of the season en route to earning second-team All-Pro honors. Garrett, 29, is entering his ninth season with the Browns as their best player and the veteran leader on the team. He signed a four-year, $160 million extension with the Browns in the offseason and will entered the 2025 season among the favorites to win Defensive Player of the Year for the second time in his career.

49ers WR Demarcus Robinson suspended three games
The NFL has suspended wide receiver Demarcus Robinson three games for violating the league's substance abuse policy, coach Kyle Shanahan said on KNBR. It is a suspension the 49ers anticipated when they signed Robinson in the offseason. Robinson was playing for the Rams when police pulled him over Nov. 25 for driving his car at a speed in excess of 100 mph. He refused a field sobriety test. In July, Robinson pleaded no contest to a misdemeanor DUI charge. A judge sentenced Robinson to 36 months of probation and imposed a $390 fine. Robinson also was given penalty assessment and was ordered to complete a series of programs, including a three-month alcohol program and a hospital and morgue program. Robinson had two other charges — driving with a 0.08 percent blood alcohol content or higher and driving without a valid license — dismissed. The 49ers open the season against Seattle, New Orleans and Arizona, games Robinson will miss before he can return for a Week 4 game against Jacksonville.
