
Private medical practitioners' proposal potentially violates Competition Act: MyCC
This comes in response to reports that several associations representing private medical practitioners are looking to introduce new service charges including prescription and registration fees, regulatory compliance charges, and facility usage fees some of which may have already been implemented or are under review.
MyCC chairman Tan Sri Datuk Seri Idrus Harun said such practices are considered serious violations and are commonly referred to as cartel activities, which are illegal regardless of whether the pricing agreement has been implemented or merely agreed upon.
'These additional charges reportedly include prescription fees, registration fees, regulatory compliance charges, and facility usage fees, which may already be in effect or currently under consideration.
'MyCC stated firmly that any collective decision by associations representing general practitioners (GPs) or private doctors to introduce such charges could be in violation of the Competition Act 2010 (Act 712),' he said in a statement.
Idrus added under Section 4(2)(a) of the Act, private doctors and GPs are regarded as 'enterprises,' and any agreement between enterprises including decisions by associations to fix prices or trading terms may constitute anti-competitive conduct.
'If any association or organisation collectively agrees to introduce new charges, it may be interpreted as a price-fixing arrangement. Even non-binding pricing recommendations could be deemed price-fixing under Section 4 of the Act,' he said.
The Sarawak Private Medical Practitioners' Society (SPMPS), the Private Medical Practitioners' Association of Selangor and Kuala Lumpur (PMPASKL), and the Penang Medical Practitioners' Society (PMPS) have been specifically cautioned about the possibility of violating Competition Act.
MyCC urged SPMPS to withdraw its advisory encouraging members to implement these new charges.
PMPASKL and PMPS have also been advised not to hold any meetings or make decisions that could result in the uniform imposition of new charges, as this could be considered a breach of the law.
'Under the Competition Act 2010, any enterprise found guilty of violating the Act may face financial penalties of up to 10% of its global turnover during the period of infringement.
'MyCC will not hesitate to initiate investigations and take strict enforcement actions against any parties involved in anti-competitive conduct,' said Idris.
He further stressed MyCC is closely monitoring the situation and called on all stakeholders in the healthcare sector to fully comply with competition laws.
'MyCC reaffirms its commitment to promoting a competitive, healthy, and transparent marketplace for the benefit of consumers and the integrity of Malaysia's economy,' he added.

JOHOR BARU: A company and its director will make legal history tomorrow when they become the first to face charges under the Geographical Indications Act for allegedly misusing a protected label. Federal prosecutors are expected to charge the company and its director at the Johor Baru Sessions Court tomorrow morning for labelling a 2-in-1 coffee product as "KK Tanom Coffee". They are accused of using a label that could indirectly refer to a registered geographical indication, "Tenom Coffee", without the rights holder's approval. The press invitation did not specify the exact section of the Act they would be charged with. The Geographical Indications Act protects names or signs linked to products from specific regions that owe their quality or reputation to their place of origin. Examples include "Tenom Coffee" from Sabah, as well as "Sarawak Pepper" and "Bario Rice" from Sarawak. The law prevents the misuse of these labels by unauthorised producers, which safeguards consumers and the integrity of Malaysia's heritage products. This case is the first prosecution under the Act since it came into force on March 18, 2022. It replaced the Geographical Indications Act 2020 to strengthen protection for products linked to specific regions and to align Malaysia with international standards under the World Trade Organisation's Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS). Adopted in 1994, TRIPS is a pact that sets minimum global standards for intellectual property protection. It requires member countries to safeguard copyrights, trademarks, patents, geographical indications, and other rights, ensuring fair competition and consumer protection across borders.

Anwar Ibrahim outlines fiscal priorities, pledges sustainable growth with 3pc deficit for 2025
KUALA LUMPUR, Aug 20 — The country's financial management must be carried out prudently and with discipline, in line with the spirit of the Public Finance and Fiscal Responsibility Act 2023 (FRA), said Prime Minister Datuk Seri Anwar Ibrahim. He stressed on this while chairing the Fiscal Policy Committee (FPC) meeting, which is an important platform for drafting clear fiscal policies and setting the direction of the country's economy. He said the Madani Government needs to continue to find a balance between efforts to maintain the momentum of economic growth and ensuring the country's fiscal position remains sustainable, especially in the volatile global economic environment. 'Although the world is still grappling with uncertainty, the national economy remains strong with a growth rate of 4.4 per cent for the first half of 2025. 'The unemployment rate has also dropped to three per cent, the lowest in 10 years,' the prime minister said in a post on his Facebook page yesterday. He added that the government has successfully reduced the fiscal deficit from 5.5 per cent in 2022 to 4.1 per cent of Gross Domestic Product (GDP) in 2024, an achievement that demonstrates its commitment to responsible fiscal management. Meanwhile, in a separate statement following the FPC meeting yesterday, the Ministry of Finance (MoF) said as the Madani Government embarks on the 13th Malaysia Plan, fiscal space must be optimised to deliver public investments that materially transform the economy (Raise the Ceiling) and improve the rakyat's quality of life (Raise the Floor). In 2025, Malaysia's economy is expected to grow between 4.0 per cent and 4.8 per cent, underpinned by strong domestic demand, moderate inflation and a stable labour market. 'The FPC meeting today reaffirmed the government's commitment to reducing the 3.8 per cent fiscal deficit target for 2025 and subsequently achieving a deficit of three per cent or below in the medium term, in line with the FRA commitment,' said Anwar, who is also the Finance Minister. The session also serves as an important step in setting the government's fiscal trajectory ahead of the forthcoming Budget 2026, scheduled to be tabled on October 10, 2025. Pursuant to the provisions of the FRA, the MoF said the Madani Government is undertaking the Medium-Term Revenue Strategy (MTRS) to broaden the revenue base and establish a more progressive tax system, while strengthening compliance with international best practices. 'Moving forward, priority will be placed on addressing leakages and enhancing efficiency through measures such as the phased implementation of the e-invoicing system. Madani housing campaign to boost growth, says Nga
PUTRAJAYA: The Housing and Local Government Ministry is set to roll out the Madani Home Ownership campaign, aimed at spurring economic growth and boosting related industries. Minister Nga Kor Ming said the initiative could spur growth in as many as 200 industries tied to housing and construction. 'With the Madani Home Ownership campaign, every Malaysian can own their dream home,' Nga told reporters after a press conference held following an engagement session with stakeholders nationwide in conjunction with Budget 2026 yesterday. Also present were his deputy minister Datuk Aiman Athirah Sabu and ministry secretary-general Datuk M Noor Azman Taib. Nga stressed that the government's priority is not simply imposing a ceiling price for houses, but raising household incomes in line with Malaysia's high-income nation aspirations. 'Don't focus on the wrong thing. We want to focus on how to raise the people's income.' Among the new mechanisms being considered to tackle affordable housing and living costs is the use of advanced construction technology to shorten project timelines. Nga also announced he will table the first reading of the Urban Renewal Act this Thursday, with the second and third readings scheduled for Aug 27. 'This is the new direction for the country to ensure that our cities continue to develop sustainably. We have held 101 engagement sessions with stakeholders, and the Act has been referred twice to the Parliamentary Special Select Committee.' He added that under the 'traffic light' system he introduced, local councils performing well will receive more funds, while underperforming ones risk budget cuts. 'For those in the green, we will double their budgets, those in yellow, we will reconsider, while for those in red, I'm sorry, but their allocations will be withdrawn.' The ministry is also eyeing an additional RM1 billion allocation for public cleaning next year, with plans for 20% of vehicles used in city cleaning to be electric by 2027, in line with Malaysia's net zero carbon emissions target. Looking ahead to Budget 2026, Nga said the ministry will propose 10 new initiatives focused on national development, including 10,000 public infrastructure projects. 'Our strong track record last year saw us deliver 6,011 public facility projects, from recreational parks and public markets to food courts, hawker centres and toilets.' More than 300 stakeholders attended the engagement session, with over 30 representatives putting forward 50 proposals. Nga said he will present these to the Finance Ministry on Sept 4 for consideration in Budget 2026.
