Zoo gets catty and sues town over new $1 tax on memberships

An Ohio zoo has shown its claws by filing a lawsuit against the local township over a $1 tax on all its admissions and memberships.
Columbus Zoo and Aquarium filed the lawsuit Wednesday against Liberty Township, who claim that the fee helps cover costs for police, fire and emergency medical services at the park.
The proposed tax comes from House Bill 315, which was passed in April 2024 to allow townships to collect up to $1 per admission to offset public safety costs at large venues.
In the suit, seen by The Independent, the zoo argues that it should be exempt from the so-called 'Protect and Serve Charge' as it does not meet the criteria of a 'qualifying venue.'
Such venues, which include theatres, concert halls, entertainment venues, or similar event spaces, must have a capacity of at least two thousand and be situated on land exempt from property taxation, according to the suit.
'The Zoo is not, and is dissimilar to, a 'theatre, concert hall, entertainment venue, or similar space.' Rather, the Zoo is an animal conservation and educational institution,' the suit states.
'The Zoo is also not considered a 'qualifying event venue' because a portion of the land on which it is situated is not exempt from property taxation.'
The lawsuit also claims that a $1 surcharge on each admission would amount to $2 million of taxes per year, given the average number of visitors the zoo receives, while the cost of first responders is only around $260,000.
The Columbus Zoo has demanded that an order be passed, forcing the township to declare it is not a 'qualifying venue,' as well as seeking an injunction to delay the township's attempt to collect the admissions tax and decide if such taxes can be collected going forward.
'This is an important legal issue and a matter of standing up for our guests, our mission, and our work in education, conservation, and animal care,' said Tom Schmid, President and CEO of the Columbus Zoo and Aquarium, in a statement.
'Through our educationally-focused wildlife conservation mission, we have rightly earned our designation as a tax-exempt not-for-profit institution, and it's critical for us to preserve this designation, not just for our organization, but for not-for-profit organizations throughout Ohio. '
The Independent has reached out to Liberty Township for comment about the lawsuit filed by Columbus Zoo and Aquarium.

Brown, 72, served for 18 years in the Senate before he lost to Republican Bernie Moreno last November in a 50.1%-46.5% vote. Republicans currently hold a 53-47 majority in the Senate, and Ohio could become the site of one of a half-dozen most competitive races in next year's elections. Husted was appointed in January to temporarily fill the seat vacated by JD Vance when he became vice president. The winner of the November 2026 special election would serve the remainder of Vance's Senate term, ending in January 2029. Brown anchored his long congressional career as a dogged fighter for blue-collar workers in Ohio, which has suffered job losses as steel, automotive and other jobs moved abroad. Once a battlefield state, Ohio has leaned increasingly Republican over the past decade. Last November, Republican Donald Trump handily defeated Democratic presidential candidate Kamala Harris 55.2%-44% in Ohio, where he remains a potent political force. Both Brown and Husted would be favored to win their respective parties' primary races next year. After his defeat last November, Brown founded the Dignity of Work Institute, aimed at improving pay and benefits for working-class people.

A man who fired a shotgun outside an upstate New York synagogue with dozens of children inside shortly after the start of the Israel- Hamas war was sentenced in federal court Tuesday to 10 years in prison. Mufid Alkhader, 29, was arrested in December 2023 after firing two shots in the air and shouting 'Free Palestine!' outside Temple Israel of Albany. No one was injured, but the incident terrified many of the 61 children attending preschool and the adult staffers who had to shelter in place. 'My daughter was in Hebrew class with her teacher, whose own child was on the other side of the building,' Rachel Mandel told the court. 'Her amazing teacher held, hid and comforted my child. She prepared herself and the children in her care to die as victims of hate.' The shots were fired hours before the first night of Hanukkah and two months after the surprise incursion by Hamas triggered the war. Federal prosecutors say Alkhader, whose gun jammed after the second shot, complained about events in the Middle East after his arrest. Under a deal with prosecutors, Alkhader in February pleaded guilty to obstructing the free exercise of religious beliefs by threat of force, brandishing a firearm during the commission of that offense and conspiring to purchase a firearm unlawfully. Alkhader, wearing an orange jail shirt, told the court Tuesday he felt terrible about what he did and for scaring people. 'I know I was not in my right mind,' Alkhader said, asking for forgiveness. Alkhader's public defender had argued for a more lenient sentence, citing his client's severe mental illness. But Judge Anne Nardacci sided with prosecutors, who said Alkhader should face 10 years in prison after traumatizing the children and adults in the synagogue. Prosecutor Richard Belliss said Alkhader wanted to scare the people in the building, 'and scare them he did.' Alkhader was born in a Palestinian refugee community near Baghdad and his family came to the U.S. as refugees in 2012, when he was 16. He became a naturalized U.S. citizen two years later and lived in nearby Schenectady at the time of the shooting. Another man was sentenced last fall to 14 months in prison for making a 'straw' purchase of the shotgun for Alkhader.
