
A challenging Real ID process is stranding immigrants
Why it matters: As of May 7, Real IDs (or passports) are required to board commercial flights.
Those in the U.S. without those documents are now stuck.
Refugees and asylum seekers aren't required to have a passport, and many don't have travel documents because of the way they fled their countries.
Between the lines: Real ID concerns come as many immigrants — and some of their attorneys — are being told to leave the country even if they are here legally.
What we're hearing: Community Refugee & Immigration Services clients are arriving to Ohio BMVs with documents that prove their legal status in the country in an effort to attain Real IDs, only to be turned away, staff attorney Vincent Wells tells Axios.
For many, issues begin with the requirement for immigrants to show the BMV a work authorization card proving full legal name and date of birth.
But asylum seekers and refugees don't need that document to work — they " are authorized to work indefinitely because their immigration status does not expire."
"The federal government was issuing these to make it easier for employers to understand their status," Wells says. "If I have a refugee coming in to my office with an expired work authorization card, the first thing I say is, 'Good news: You don't need a work authorization card to work.'"
The fine print: Even if an immigrant does have their work authorization card, that's not enough to prove legal presence in the U.S. — one of several elements of identification required by the Ohio BMV.
Immigrants also need the original approval notice for that card. But some never got the card and some who did may not have known the importance of keeping the approval notice.
"My clients will show up with an unexpired work authorization card and an unrestricted social security card, and [the BMV] will say, 'We can't issue a Real ID because you don't have the approval notice," Wells says.
State of play: The Ohio BMV is also required to verify immigration status with federal databases, spokesperson Lindsey Bohrer tells us, and that can sometimes "take longer" and require a wait "for a response from the appropriate federal agency."
The big picture: The process isn't just difficult for immigrants. It's also putting unnecessary stress on federal administrative systems.
Normally, a green card would eventually replace work authorization and allow them to get an ID.
But green cards aren't being processed, so attorneys like Wells have to file for otherwise superfluous work authorization cards.
"It's just an incredibly inefficient process … to apply for unnecessary work documents being processed at the cost of the federal government."

Automaker Claims Franchise Law Harms Consumers When Tesla bypassed traditional franchised dealerships over a decade ago and started selling its electric vehicles directly to customers it started a legal battle with the car-dealer lobby that continues to this day. This time it's Rivian's turn to skirmish. On Monday, Rivian filed a lawsuit against the registrar of Ohio's Bureau of Motor Vehicles (BMV) in federal court in order to be able to sell its EVs directly to consumers in that state. The lawsuit argues that the Ohio BMV is harming consumers by blocking direct sales, according to TechCrunch. Like Tesla, Rivian has been selling cars directly to its customers from the beginning. It's never used franchised dealerships, so it is not competing against its own franchisees, which is the argument behind franchise laws that prevent established automakers from engaging in direct sales. Rivian is currently able to sell cars in 25 states and the District of Columbia, but not Ohio. 'Irrational In The Extreme' "Ohio's prohibition of Rivian's direct-sales-only business model is irrational in the extreme: it reduces competition, decreases consumer choice, and drives up consumer cost and inconvenience—all of which harms consumers—with literally no countervailing benefit," Rivian's lawyers wrote in the suit. Rivian customers in Ohio currently have to buy their cars in other states that allow direct sales, after which they're shipped to a Rivian service center in the Buckeye State for delivery. Rivian is asking the court to grant it a dealership license so it can sell vehicles in the state. Such a license was previously granted to Tesla, which has been selling cars directly to customers in Ohio since 2013. The obstacle Rivian faces is a 2014 law, which the automaker says came after intense lobbying by the Ohio Automobile Dealers Association (OADA) that essentially shut the door behind Tesla, allowing that firm to keep its dealer license but blocking other manufacturers from obtaining one. The Fight Continues Tesla's Ohio situation is a result of the state-by-state legal battles the automaker fought in the its early days of volume sales. It was able to win concessions for itself, in some cases, but state dealership lobbies were too entrenched to achieve any broad concessions in favor of direct sales. That leaves Rivian and other upstart automakers to re-fight these battles. Rivian, along with Lucid, was granted a dealership license in Illinois in 2021, and the automakers successfully fended off a legal challenge from that state's dealer association to block direct sales. In 2022, Lucid also filed a lawsuit in Texas challenging that state's direct-sales ban. That suit was unsuccessful, but Lucid has appealed, according to federal court records. Not every automaker has gone the direct-sales route. Polestar adopted a hybrid approach, with company-owned showrooms and online sales, but servicing handled by Volvo dealers. Vinfast initially planned for direct sales only, but later pivoted and signed up some franchised dealers. The Volkswagen Group's new Scout Motors brand has discussed direct sales, but is already facing legal challenges from the VW Group's franchised dealers. Additionally, it said that during the quarter, it purchased 1,757 homes, which was down 51% from the previous quarter and down 63% from the same quarter a year earlier. For its current Q3, Opendoor issued revenue guidance of $800 million to $875 million. But unfortunately for the company's shareholders, after Opendoor announced its results, the stock plummeted over 20%. When are OPEN shares down so much? There are a few reasons why OPEN shares have fallen so much since the company announced its results yesterday. The first is that the company reported a disappointing revenue guidance for the current Q3. It said it expects revenue of $800 million to $875 million. As noted by CNBC, that would represent a 36% decline from the same period a year ago. This revenue decline is partly expected due to the current challenging home-buying environment. High interest rates, which in turn make mortgage rates high, deter home buyers, resulting in decreased home sales. Another possible factor in Opendoor's stock price slump today is that the company did not give much detailed information on its evolving business model, which it has dubbed 'Product to Platform.' This new model will see Opendoor 'moving from a single product to a distributed platform with multiple offerings delivered through agents,' according to comments from CEO Carrie A. Wheeler on the company's earnings call. When a company radically changes its business model, it introduces uncertainty—and uncertainty makes investors nervous. A third possible reason why OPEN stock is falling so much today is much simpler: It's a meme stock, and meme stocks are highly volatile. Yesterday's earnings announcement was the first since OPEN stock went stratospheric last month, and the lackluster results may be prompting some investors who got in at the right time to take profits. OPEN stock's wild summer Over the past month, Opendoor's stock has been on a wild ride. Starting around mid-July, the stock surged in popularity within the meme stock community. Shares went from being worth around 75 cents each to surging to over $3.20 per share in little more than a week. As of yesterday's close, OPEN shares had surged more than 313% in the past month.
