Madras High Court stays amendments taking away T.N. Governor's power to appoint Vice-Chancellors

The Madras High Court on Wednesday (May 21, 2025) stayed the operation of a series of amendments carried out by the Tamil Nadu Legislative Assembly to make the State government, instead of the Governor, the appointing authority for Vice-Chancellors of various State-run universities.
A summer vacation Bench of Justices G.R. Swaminathan and V. Lakshminarayanan granted the interim stay pursuant to a public interest litigation petition filed by advocate Kutty alias K. Venkatachalapathy of Tirunelveli to declare all the amendment Acts as null and void.
The orders were passed after hearing senior counsel Dama Seshadri Naidu, assisted by V.R. Shanmuganathan, for the petitioner and Advocate-General P.S. Raman as well as Senior Counsel P. Wilson representing the Chief Secretary and Higher Education Secretary respectively.
Initially, the A-G as well as Mr. Wilson urged the court to grant time for filing a counter affidavit and contended that there was absolutely no urgency in taking up the stay petition for hearing during the summer vacation hearing. However, the Bench rejected their request.
The Division Bench was also informed that the State government had already filed a petition before the Supreme Court urging it to transfer the PIL petition, pending before the High Court, to itself and hear it along with connected cases already pending before the top court.
Higher Education Secretary C. Samayamoorthy too filed a memo before the High Court contending that the PIL petition was politically motivated as it had been filed by a person who was the Tirunelveli district secretary of Bharatiya Janata Party (BJP) and an advocate by profession.
Though the petitioner had challenged the State laws on 56 grounds, his primary contention was that the laws were repugnant to Regulation 7.3 of the University Grants Commission Regulations on Minimum Qualifications for Appointment of Teachers and Other Academic Staff in Universities and Colleges, 2018.
Stating the validity of Regulation 7.3 was in itself a subject matter of the litigations pending before the Supreme Court for quite sometime now, the Secretary said it would only be appropriate to transfer the present PIL petition to the top court and tag it along with the cases pending there.
The memo also stated that a mention was made before a Bench headed by Chief Justice of India (CJI) B.R. Gavai on May 19, 2025, seeking early listing of the transfer petition and that the CJI had orally asked the counsel for the State government to inform the High Court about the transfer petition.
The Higher Education Secretary further stated there was no grave urgency involved in the case for the High Court to hear the matter during summer vacation, without providing sufficient time for the State government to file a detailed counter affidavit, meeting out all 56 grounds.
He urged the Division Bench led by Justice Swaminathan to defer the hearing on the PIL petition until the disposal of the transfer petition filed before the Supreme Court.

It is not only obligated to protect their lives and keep them safe from avoidable losses, it remains obligated and duty-bound to offer remedies and care where such unintended loss may be suffered. It is undisputed that the management of the Kumbh Mela was in the hands of the state and no other authority," the bench its order passed on Friday, the court directed the state authorities to file an affidavit disclosing full details of the total number of claims received for the payment of ex-gratia compensation; the number of claims decided and pending, together with the dates of receipt of such claims with minimal details of the claimants as also the date of their court directed for the impleadment of multiple medical institutions and authorities in Prayagraj as parties to the petition and asked them to file affidavits disclosing all deaths and the details of the medical handling of victims between January 28 and the conclusion of the Maha to the facts of the case, the petitioner's wife was injured in the stampede and was initially believed to be missing. Later, her body was handed over to her son from the mortuary of the Motilal Nehru Medical College in Prayagraj on February inquest report and the post-mortem or autopsy report were not prepared at that stage. DEHRADUN: Uttarakhand High Court has asked the state government to respond within four weeks to a contempt petition that accuses it of ignoring earlier court orders to phase out the revenue police system and set up regular police stations in certain areas. Justice Manoj Kumar Tiwari of the single-judge bench heard the petition filed by Haldwani resident Amit Kholia. He alleged that the state government has not implemented the court's May 2023 order to end the revenue police system. "The government had assured the court that it would take steps to establish regular police stations in areas where the revenue police system is currently in place. However, no significant progress has been made in this regard," Kholia's petition stated. The petition pointed out that the Supreme Court had, back in 2004, underlined the need to do away with the revenue police system, as its personnel lacked proper training and modern facilities. "Revenue police personnel are not trained like civil police and lack basic facilities like forensic investigation, DNA testing, and fingerprint analysis," it stated. The High Court had issued similar directions in 2018, but those too were not followed. The matter has drawn renewed attention after the Ankita Bhandari murder case, which raised serious concerns about the effectiveness of the revenue police. In response, Chief Minister Pushkar Singh Dhami had ordered steps to quickly transfer control from the revenue police to the regular police. The revenue police system, which still exists in some parts of Uttarakhand, dates back to the British era. Under this system, local revenue officials have to perform police duties, including maintaining law and order and investigating crimes. Critics argue that the system is outdated and ineffective, and that regular police forces are needed for better law enforcement.

Tirupati: Chittoor MP Daggumalla Prasad Rao has directed the district administrations of Chittoor and Tirupati to reach out to distressed mango farmers by enforcing the MSP of Rs.12,000 per ton for the Totapuri variety as declared by state govt. The delay in procurement of the Totapuri variety by the pulp units coupled with the abysmal drop in the prices has left the mango farmers of Chittoor and Tirupati districts in dire straits this year. While mangoes are grown in about 2.8 lakh acres in the two districts, the Totapuri variety is grown in close to 90% of the total extent. While farmers received between Rs 18,000-30,000 per ton for this variety last year, the price has dropped to Rs 4,000 a ton. Under such circumstances, farmers would be staring at huge losses if govt doesn't turn up to their rescue. "Chief minister Nara Chandrababu Naidu has directed the officials to immediately engage with the owners of the pulp units across the two districts and prompt them to initiate procurement measures as the season itself is drawing to an end", MP Prasad Rao asserted. "The State had fixed an MSP of Rs12,000 per ton for the Totapuri variety of mangoes, and collectors of Chittoor and Tirupati districts have been instructed to ensure that the farmers suffered no losses at all," he asserted. Moreover, he assured that various enforcement measures, to prevent the illegitimate sale of mangoes at the interstate borders, will also be taken up in the interest of the farmers.
