Birkenstock sandals are pieces of design, not art, court finds
KARLSRUHE, Germany, Feb 20 (Reuters) - Birkenstock (BIRK.N), opens new tab sandals, which have evolved from a symbol of counterculture to a trendy fashion item, do not qualify as art and are therefore not protected by copyright, Germany's highest civil court ruled on Thursday.
The Federal Court of Justice dismissed a lawsuit brought by the German company, which had sought to prevent competitors, such as Germany's Tchibo, from selling similar models.
"The claims are unfounded because they (the sandals) are not copyright-protected works of applied art," presiding judge Thomas Koch said.
Under German law, copyright protection is valid for 70 years after the creator's death, while design protection hinges on the product's lifespan and ends after 25 years.
The legal distinction between design and art in German law lies in a product's purpose. Design serves a practical function while works of applied art require a discernible level of individual artistic creativity.
Shoemaker and Birkenstock dynasty member Karl Birkenstock, born in 1936, is alive. However, since he crafted his initial designs in the 1970s, some sandals no longer enjoy design protection.
As a result lawyers asked the court to classify the shoes as art.
Konstantin Wegner, Birkenstock's lawyer, said the sandals had an "iconic design" and announced further litigation after the decision was announced. "We want to add arguments in these pending proceedings", said Wegner without elaborating.
Once popular with hippies, tech enthusiasts and medical professionals, Birkenstock gained widespread attention after Australian actress Margot Robbie wore a pair of pink Birkenstocks in the final scene of the 2023 hit movie "Barbie".
Founded in 1774, Birkenstock was run by the namesake family for six generations until it sold a majority stake to L Catterton, a U.S. private equity firm backed by French billionaire Bernard Arnault and his luxury goods empire LVMH (LVMH.PA), opens new tab.
L Catterton remained Birkenstock's biggest shareholder after the company went public in 2023.

Fan favourite show Ginny and Georgia has returned to Netflix for an all new series which sees more dramatic storylines than ever but not all viewers are happy with the new episodes Ginny and Georgia fans have all said the same thing about brother's age leap in new series. The show has returned to Netflix for its third series, which viewers have waited two years for. Season three picks up just hours on from season two's finale - but not everyone looks the same. Many have pointed out that Ginny's brother Austin has grown up a lot since the last season. Fans have noticed that the actor who plays Austin looks a lot older than nine-years-old which is what he is meant to be in the show. Actor Diesel La Torraca who plays Austin is actually 14-year-old in real life so is five years older than the character he is playing. Many took to social media to point out the ridiculous age gap thanks to the huge break between filming the two series. The show has not aired for two years but has picked up where it left off in season two meaning there should be no age change in the character. Taking to X, one viewer wrote: "I fear ginny and georgia is going to have to recast the little brother because this is deeply unserious." When season 3 filming began in 2024 she shared a side-by-side photo of herself and Diesel after filming season 1 compared with now which showed how much he had grown. He was originally much shorter than the actress and now he towers above her. Ginny and Georgia first arrived on Netflix back in 2021 and quickly became a fan-loves show. It is now in its third series and has got even more dramatic than before. Series two left off with a murder which mum-of-two Georgia is now being accused of, despite it actually being her son who committed the crime.

Sunderland make £8.5m demand as Jobe Bellingham Dortmund talks reach deadlock
Borussia Dortmund want to sign Sunderland midfield starlet Jobe Bellingham before the Club World Cup and the two clubs remain in negotiations for the player, who has agreed a five-year deal with BVB Borussia Dortmund have been told they must up their bid by £8.5million to strike a deal with Sunderland for Jobe Bellingham. The 19-year-old midfield starlet has already agreed to join the German giants on a five-year contract but they are yet to shake hands on a transfer with the Black Cats. It's understood Bellingham's release clause is currently set at £33.7m (€40m) but Dortmund are not currently willing to reach that figure and have instead communicated they would be willing to propose a £25.2m (€30m) package. The offer would be worth £21m upfront with a further £4.2m in achievable add-ons but Sunderland want the buy-out clause met in full before they sanction the move. German sources have indicated BVB's first official bid was worth around £21m all in and was swiftly rejected. Dortmund were of the belief that Bellingham could leave Sunderland for £25.2m (€30m) due to an alleged gentleman's agreement between the player and his current club but they now face a race against the clock to get a move over the line before the Club World Cup. Championship play-off winner Bellingham was named in Lee Carsley's England U21 squad for the European Championships on Friday. However, if Dortmund thrash out a deal before Tuesday's transfer deadline, they would hold all the cards and could take Bellingham to the Club World Cup should they wish as per FIFA rules, clubs are not obliged to release players for the U21 Euros. Liam Delap will be travelling to the United States with Chelsea after he sealed a £30m move from Ipswich Town earlier this week. Carsley claimed on Friday that Bellingham would currently be travelling to Slovakia with the Three Lions, explaining: 'The FIFA window closes on the 10th of June, so we just have to make sure that we're flexible, similar to what we've done with all of the players. We're here to support them, make sure we help them as much as we can. Jobe is an important part of our squad and will be travelling with us.' The England U21 boss will be allowed to make changes to his squad right up until his side's tournament opener against Czechia in Dunajska Streda next Thursday. Dortmund have been pushing hard to reach an agreement with Bellingham since the end of the season despite rival interest from fellow German side Eintracht Frankfurt. In early May, BVB officials Lars Ricken and Sebastian Kehl plus head coach Niko Kovac flew to the North East for discussions with the player. Departing CEO Hans-Joachim Watzke also flew to England to meet the Bellingham family before later jetting to Ibiza, where Bellingham was on holiday, for a final round of talks that look to have swung the balance.
