'Fake News' Clause Removed: Karnataka Govt RevisMisinformation Bill After Facing Flak

The initial draft had proposed the creation of a 'Fake News on Social Media Regulatory Authority' and included severe penal provisions but this was seen as overreaching
The Karnataka government is set to revise its proposed Misinformation and Fake News (Prohibition) Bill, 2025, after an earlier draft triggered widespread criticism and raised questions over legal tenability.
The words 'fake news" have been removed from the new version and, as it stands revised titled the Karnataka Misinformation Regulation Bill, 2025, it is expected to be tabled during the monsoon session of the state assembly.
According to sources, the scrutiny committee headed by state law minister HK Patil has cleared the draft, which is likely to be placed before the cabinet. News18 accessed a copy of the draft bill, which comes at a time when governments across India are stepping up digital regulation.
WHAT DOES THE DRAFT BILL SAY?
In the draft bill that will be submitted in the upcoming monsoon session beginning August 19, the definition of misinformation has been retained: 'knowingly or recklessly making a false or inaccurate statement of fact, whether wholly or in part, in the context in which it appears, excluding opinion, satire, religious or philosophical sermons, and parody – as long as a reasonable person would not interpret the content as factual".
The bill defines 'communication" as dissemination of information to 10 or more persons in Karnataka, through any medium — including bots, computer resources, television, or in-person communication. This applies to content originating both inside and outside Karnataka, as long as it reaches people within the state.
The offence of misinformation is defined as follows: 'no person, whether inside or outside Karnataka, shall communicate or abet the communication of misinformation to persons in Karnataka if such communication disrupts public tranquillity, affects the conduct of free and fair elections in any part of the state, or incites others to commit an offence. Anyone found guilty can be punished with imprisonment ranging from three months to five years and a fine. Abetment carries a punishment of up to two years' imprisonment and a fine."
SPECIAL COURTS TO DIRECT MEDIA HOUSES
The draft bill states that special courts may be established to issue directions to media houses to correct or take down content. Non-compliance can lead to up to two years' imprisonment and a daily fine of Rs 25,000.
'For the purpose of providing for speedy trial of offences under this Act, the State Government shall, with concurrence of the Chief Justice of the High Court of Karnataka, by notification in the Official Gazette, establish Special Court comprising a Sessions Judge," the draft bill states.
CONTROVERSIAL 'SANATAN' CLAUSE TO BE DROPPED?
'The first 'so-called draft' seen in the public domain was fake. We have been working on a comprehensive one that will control misinformation and also ensure that people get what is 'real news'," a source in the IT/BT ministry said.
The bill had come under fire from several quarters after the draft included terms flagged as excessive, especially a clause that proposed a seven-year jail term for the 'publication of content amounting to disrespect of Sanatan symbols and beliefs on social media platforms". This clause was among the most controversial and is likely to be dropped or reworded, sources said.
The revised version is presently under scrutiny of the IT BT, home, and law departments. The first two are reviewing the penal clauses, which were earlier flagged for their severity. Officials involved in the review said several portions of the earlier draft had been directly lifted from the Union government's 2019 Fake News (Prohibition) Bill.
'It mentions ministers like information and broadcasting, which is not even a state subject. Section 15, which deals with company offences, was also reportedly taken verbatim from Section 7 of the Union bill. All of this, officials said, has now been reviewed and reworked in the revised version. Even the Rs 10 lakh penalty was copied from the Centre's bill, all of it had to be reviewed and worked upon," a senior official told News18.
In April last year, the ministry of corporate affairs introduced the draft Digital Competition Act to tackle anti-competitive behaviour by tech giants such as Google, Meta, Amazon, Microsoft and X. In a similar development, X Corp (formerly Twitter) filed a writ petition in the Karnataka High Court in March, questioning the Centre's powers under Section 69A of the IT Act after being ordered to block more than 8,000 accounts in India.
Later that year, Meta was fined Rs 213.14 crore by the Competition Commission of India for alleged violations of competition law linked to WhatsApp's 2021 privacy policy, which reportedly allowed data to be shared across Meta platforms. WhatsApp was also asked to trace the origin of flagged messages, raising questions around its end-to-end encryption. It has challenged the 2021 IT Rules in the Delhi HC.
State IT-BT minister Priyank Kharge had earlier told News18: 'We're not trying to change any policy but only trying to strengthen what already exists and ensure that there is 'news' and not misinformation that is given out to people," adding, 'the idea is to look at what already exists, connect the dots, and bring out an effective bill."

‘Bhoomipujan' for facelift of Raxaul rly station performed

Motihari: Raxaul railway station under East Central Railway (ECR), located near India-Nepal border in the Darbhanga-Narkatiyaganj section, is set to get a facelift at a cost of Rs 54 crore in the first phase under the Amrit Bharat scheme. Once developed, the station will resemble a replica of the famous Pashupati Nath Mahadeo temple of Kathmandu. The foundation stone for remodelling of the station was laid by Prime Minister Narendra Modi. After performing the 'bhoomipujan' of the project on Saturday, Sanjay Jaiswal, MP, said the new station building will be four storeyed and will have four domes like the Pashupati Nath temple. He said the station will have facilities for foreign travellers too. A state-of-the-art railway yard will also be built on the station premises. Jaiswal expressed hope that after remodelling of the station, trade and movement between India and Nepal will further improve. Divisional railway manager (DRM) of Samastipur rail division, Vinay Srivastav, said the station will have entrances on both the north and south sides, which will facilitate movement of passengers from Nepal. The DPR of the station has already been prepared, and a contractor has been appointed for carrying out the remodelling work. Prajwal Revanna, former JD(S) MP, given life sentence in rape case

Bengaluru: A Special Court here on Saturday sentenced to life imprisonment, former MP and suspended JD(S) leader Prajwal Revanna in a rape case. The Special Court for MPs/MLAs Judge Santosh Gajanan Bhat also imposed a total fine of Rs 10 lakh on the accused. The court had on Friday convicted the 34-year-old in one of the four sexual abuse and rape cases registered against him and reserved the sentencing for Saturday. The case pertains to a 48-year-old woman who was working as a help at the family's Gannikada farmhouse in Hassan district's Holenarasipura. She was allegedly raped twice — at Hassan farm house and Bengaluru residence– in 2021 and the act recorded by the accused on his mobile phone. Earlier in the day, while the prosecution sought life sentence for Revanna, the 34 year-old sought leniency, claiming he did nothing wrong and that his only mistake was his 'fast' growth in politics. He broke down in court as he appealed to the judge for a lesser punishment. He told the court that he is a BE Mechanical graduate, and has always passed on merit. '…they say that I have raped multiple women, but none of the women have come out voluntarily to complain, they came six days prior to election (Lok Sabha polls last year)…the prosecution side brought them purposefully and made them give a complaint,' Prajwal told the court. Pointing out that the woman (victim) had not complained to anyone including her husband or kin about the alleged rape, he said that she comes and gives complaint when certain videos were circulated. Stating that he will bow down to the court's conviction, Prajwal said, 'I have a family, I have not seen my mother and father for six months now…..please give me a less sentence is what I request the court.' 'The only mistake I made in my life is growing fast in politics,' Prajwal, arrested in May last year upon his arrival from Germany, told the court. The Special Investigation Team (SIT) which probed the case had filed a 1,632-page charge sheet with 113 witnesses in the case in September, 2024. Revanna was booked under sections 376(2)(k) (being in a position of control or dominance over a woman, commits rape on such woman), 376 (2)(n) (repeated rape on the same woman), 354A (sexual harassment), 354B (assault or use of criminal force to woman with intent to disrobe), 354C (voyeurism), 506 (criminal intimidation) and 201 (disappearance of evidence) of the IPC, and Section 66E (violation of privacy) of the IT Act. Special Public Prosecutor Ashok Nayak and Additional SPP B N Jagadeesha following Prajwal Revanna's conviction on Friday had said that the court had accepted the prosecution's case and convicted him on all counts. Noting that the prosecution examined 26 witnesses and marked 180 documents and the main evidence is of the victim, Nayak said the prosecution relied not only on the oral evidence, but also the digital and technical evidence, DNA report and Forensic Sciences Laboratory report. 'The clothes that were worn by the victim during the rape were also identified and the Investigation Officer (IO) was successful in seizing them even after three-four years. Also, digital evidence played a role as the accused himself had recorded the video.' Four separate cases have been registered against Revanna, who is facing charges of rape and sexual harassment, and the SIT was tasked with probing cases. Prajwal Revanna is the grandson of former Prime Minister and JD (S) patriarch H D Deve Gowda. The cases came to light after pen-drives containing explicit videos allegedly involving Revanna were reportedly circulated in Hassan, ahead of Lok Sabha polls there on April 26, 2024. Revanna was arrested by the SIT on May 31 last year, upon his arrival at Bengaluru Airport from Germany in connection with a case registered at the Holenarasipura Town Police Station. Revanna had failed in his bid to retain the Hassan parliamentary constituency in the 2024 Lok Sabha polls. JD(S) suspended him from the party following the cases filed against him.

Maha govt mute spectator to rising crime, Rs 4,900 cr freebie scam: Sule

NCP (SP) leader Supriya Sule on Saturday slammed the BJP-led Mahayuti government for failing to address the rising crime rate in Maharashtra, accusing it of being a mute spectator as miscreants had no fear of the law. Speaking to reporters here, the Baramati MP claimed that a Rs 4,900 crore scam had taken place in the Majhi Ladki Bahin Yogana, the government's flagship scheme that provides a monthly assistance of Rs 1,500 to women. She said parts of the state, including Pune and Beed districts, have witnessed a steady surge in crimes, while the government remains a mute spectator. "People have lost faith in the system. There is no fear of the law. Who is backing these criminals? Instead of looking into these questions, the government chooses to stay silent," she said. Sule criticised the delay in the formation of a special investigation team (SIT) to probe the 2022 murder of Parli-based businessman Mahadev Munde. "Only after Munde's wife, Dnyaneshwari, attempted self-immolation and met Chief Minister Devendra Fadnavis, did the government act. We demand a fair and transparent probe by the SIT," she said. Sule also raised concerns about the recent communal unrest at Yavat in Daund tehsil, where groups of persons, angered by a social media post, vandalised and set ablaze properties. "This is a sensitive region. Political leaders and outsiders coming in and inciting unrest is unacceptable. I urge the chief minister and deputy chief ministers to control their people," she said. Sule urged Deputy Chief Minister Ajit Pawar, also the guardian minister of Pune, to ensure peace and communal harmony in Daund. "We have deep roots in Daund. Let's not allow outsiders to disturb its social fabric," she said. Maharashtra has become an example of how power and money can derail governance, she claimed. "There is a Rs 4,900-crore scam in the Ladki Bahin scheme. Farmers are committing suicide, and yet the government is focused on self-promotion," she alleged. Maharashtra Women and Child Development Minister Aditi Tatkare recently admitted that nearly 26.34 lakh ineligible persons, including men, were availing benefits of the Ladki Bahin scheme. On Fadnavis's recent remarks about rising hooliganism in Pune, Sule said, "If you acknowledge there's a law and order issue, what action have you taken? Who is protecting these contractors and gangsters?" She also flagged irregularities in the Election Commission's handling of voter rolls in Bihar, demanding a detailed discussion in the Parliament on electoral transparency and accountability.
