
St James's Hospital apologises to trans woman
In a public statement made before the Workplace Relations Commission (WRC) this afternoon, the hospital acknowledged there is a "lacuna in the care pathways" for people in her position.
Its management has apologised for the "unsatisfactory and upsetting" experience she faced and undertook to meet with a trans advocacy group to discuss its concerns.
The patient, Paige Behan, brought a statutory complaint against the hospital's board alleging that she was discriminated against in breach of the Equal Status Act 2000 when she came in seeking emergency treatment on 16 August last year.
Her complaint has now been resolved by agreement.
The case opened before adjudication officer David James Murphy this afternoon, following a short adjournment for talks between the parties.
Ms Behan's barrister, Michael Kinsley BL, appearing instructed by solicitor Seamus Hempenstall of Daly Hempenstall LLP said: "The matter has been resolved and the only action required is that a public statement be read out by the hospital."
The statement was then read out by counsel for the board of St James's Hospital, Mairead McKenna SC, who was instructed by Arthur Cox in the matter.
"St James's Hospital acknowledges there is a lacuna in the care pathways available for patients who have received gender-affirming surgery abroad," Ms McKenna said.
"[The hospital] apologises to Paige Behan for the unsatisfactory and upsetting experience she had during her attendance at the emergency department on 16 August 2024. The hospital deeply regrets the upset caused to Ms Behan," Ms McKenna continued.
"St James's Hospital is committed to learning from Paige Behan's experience at the hospital and has agreed to meet with Transgender Equality Network Ireland (TENI) at Paige Behan's request to discuss the concerns regarding the care available to patients who are returning from abroad following gender-affirming surgery," she concluded.
The adjudicator, Mr Murphy noted the withdrawal of the equal status complaint pursuant to an agreement between the parties.
He praised the "hard work" of the litigants in coming to the agreement, and commended their commitment to "improving the service to everyone's benefit" before closing the hearing.

Agency nurse's two complaints alleging penalisation rejected by Labour Court
An agency nurse working in intellectual disability residential services who reported a staff colleague for pouring water over a patient has had two complaints alleging penalisation in the aftermath of the incident rejected by the Labour Court . Gerard Foy appealed decisions by an adjudication officer at the Workplace Relations Commission where it was found, while he had made a valid protected disclosure in respect of the incident, he had failed to establish this had directly led to him failing to secure staff jobs he applied for or to the reduction of his hours as an agency nurse. At the Labour Court hearing, the HSE acknowledged the incident Mr Foy witnessed in April 2020, which was the pouring of a cup of water over a patient by a female colleague who was directly employed at the facility, amounted to an assault. It said he followed all the correct procedures in the way he reported the incident to management, but breached GDPR guidelines by also reporting it to two other colleagues coming on duty at the end of his shift. READ MORE Mr Foy said he was told by his line manager if it had been a staff member who had witnessed the incident it would not have been reported. Despite this, he said he believed the incident had not initially caused him any problems in his work and the person who he had reported apologised to him for putting him a difficult position. This changed over time, he suggested, and he began to feel colleagues turned against him. In January and February 2022 he applied for staff nurse roles he felt he was more than qualified for but failed to secure the positions. He said they went to far less experienced candidates. He appealed the outcome but an initial investigation upheld the decision of the interview panel and he did not take the matter further. He began to get fewer hours, however, and fewer premium shifts. He said he was told this was in part because the colleague he reported, who had been moved to a different area of the facility but was employed there, said she did not want him rostered to work with her and this was facilitated by senior management. The HSE said because other staff positions were filled, there was less need for agency staff. Mr Foy wrote to the regional director of nursing for the area, Eva Hayes, to say he felt unsupported by management in the wake of the incident. Mr Foy said he met Ms Hayes to discuss the situation in October 2022 when he was surprised by the weight attached to the GDPR issue. He was, he told the court, pressured to apologise for the privacy breach to the staff member he had reported and, fearing he would lose more work, had to agree to undertake GDPR training. The apology he subsequently made to the colleague was in writing because she would not deal directly with him. He said he felt 'isolated, bullied, victimised and punished' because he had acted properly. The HSE said the incident had been fully dealt with in a confidential process and he had been treated fairly at all times. The court found he had made a protected disclosure but agreed with the WRC that he had failed to establish a direct link between his report of wrongdoing and his subsequent failure in the recruitment process or what he regarded as other examples of penalisation. It also said he had failed to prove penalisation during the six-month period it had jurisdiction to consider and the WRC's decision that his two complaints were not well founded was upheld.

Galway woman faced uphill struggle to find accommodation as a disabled HAP tenant
After a long-term lease ended due to a 'no-fault' eviction, a termination not based on tenant wrongdoing, Ms. Nolan was forced to re-enter the housing market in search of new accommodation. However, after an illness in 2021 left her with reduced mobility and degenerative health conditions, forcing her to step down from a physically demanding job, her search became significantly more challenging. She said she had to 'completely adjust [her] frame of mind' about housing, as mobility, accessibility, and, most importantly, finances became major factors in her search. Ms. Nolan became a recipient of the Housing Assistance Payment (HAP) in February 2023. The HAP is a social housing support provided by the local government where local authorities pay a landlord on a tenant's behalf. The HAP tenant then pays a weekly contribution towards the amount to the landlord. Residents who are applying for HAP must find their own private accommodation within specific rent caps governed by the local authority. 'I went into it with a pretty realistic approach,' she added, 'I can't drive so it has to be somewhere that's connected to the public transport system. If there isn't a bus stop within a 5–10-minute walk, I will end up housebound the majority of the time.' The situation became increasingly dire as she realised how little housing was available. She began considering accommodation that didn't suit her needs but felt she could manage, saying, 'It doesn't matter if there are stairs, I just need a house. I will deal with it when I am housebound, and my joints are acting up – I will deal with that then'. 'Right now, disability wise, I can afford to be in a place that isn't quite right.' Another concern for Ms. Nolan, who is in her early thirties, was the prospect of living with strangers. The limited housing options left her considering rooms in already-occupied properties. 'I don't think I had ever lived with strangers at this point. I have always ended up living with someone I at least kind of knew. The home Ms. Nolan currently lives in and hopes to stay in 'as long as they will have [her]', doesn't meet all the requirements for full accessibility. Still, she says its proximity to the city centre and ease of transportation make up for the challenges, at least for now. She was referred to her current landlord through a recommendation — likely the reason her application was accepted, she says. But disclosing to landlords that 'you come with extra paperwork' as a HAP tenant can mean your application gets denied. Technically, denying a tenant because of their status is illegal. According to the HAP website, it's considered discrimination saying, '[landlords] cannot treat a tenant getting HAP support any differently'. But they are also not 'legally required to rent to a person getting HAP'. Prospective tenants who believe they have been discriminated against for their HAP status must fill out an Equal Status Form under the Workplace Relations Commission which requests the name, address, and PPSN of the landlord. Once the form is complete with the complaint in detail, it is sent to the landlord requesting a response back. Ms. Nolan feels as though it's a 'huge flaw in the system' to say the discrimination is illegal but have 'such a [reporting] process that isn't fit for purpose". 'You are basically advised to not disclose that you are a HAP tenant until you are offered somewhere because there is a bias there. 'The unofficial advice given is one should try and see if you can pay up front for the first couple months, because once you are awarded the tenancy… it's a lot harder for them to say no to you. But if you are disclosing from the get-go… that's when they can say no without the recourse.' In addition to financial constraints, properties that fall within HAP guidelines are limited to begin with. Tenants must stay within a budget set by the council, and eligible homes must meet HAP requirements, including undergoing repeat inspections. At the time Ms. Nolan was on the hunt she was given a working figure that the maximum monthly rent could not exceed €650 a month. Designated HAP properties are in critically short supply. The most recent Locked Out of the Market report from Galway Simon highlights an alarmingly low number of properties available for HAP assistance in Galway. Over a three-day observation period, 38 standard rental properties were available across Galway city and its suburbs. Of those, only one home in the city and one in the suburbs qualified as HAP properties. This marks an increase from the previous report, which was covered by the Irish Independent and showed that no properties were available throughout Galway in March 2025. The study was 'designed to reflect the lived experience of people with access to HAP support trying to find a home to rent'. The lived experience of most though, is one of exhaustion and stress. 'Those 12 months that I spent house hunting and overholding were some of the most stressful 12 months of my life and when you have underlying illnesses where stress is a trigger, that's not good.' 'We are great at building committees and oversites and reports but put that funding into building public housing. The private market isn't working.' In the meantime, while Ms. Nolan doesn't see herself owning a home in Galway anytime soon, she remains hopeful about securing a long-term lease in an accessible home of her own. 'Housing shouldn't just be this asset. It should be a human right.'

‘Burned out' bra saleswoman wins €15,800 for constructive dismissal
A lingerie saleswoman who said she was forced to quit her job of nearly 20 years over the health impact of workplace stress at due to a 'toxic' work environment at a Dublin department store has won €15,800 for constructive dismissal. Karrin Breslin was awarded the sum on foot of a complaint under the Unfair Dismissals Act 1977 against Chantelle Lingerie Ltd, the operator of a concession in the lingerie department of the unidentified store. The Workplace Relations Commission (WRC) awarded Ms Breslin her full losses after ruling that the international lingerie brand repudiated her contract of employment by failing to address grievances about understaffing and rostering while her health deteriorated over the course of two years. It was submitted on behalf of Ms Breslin – an employee of the brand since 2004 – that when the department store reopened in May 2021 following the Covid-19 lockdown, her section was down to 12 staff with just two full-time, compared with 10 full-timers out of 17 before the pandemic. READ MORE The tribunal heard Ms Breslin had moved from north Co Dublin to Co Wexford during the pandemic closure. She asked at that stage to be given a set working day of 9am to 5.30pm, she said. Her employer's response was that 'this was not a request that could be granted given the opening hours of the shop and the need for a fair departmental roster', the tribunal was told. The tribunal was told that the department store, rather than the lingerie brand, was responsible for setting the roster governing Ms Breslin's working hours. 'I feel my mental and physical health has deteriorated ... I don't have a good work/life balance and it's going to get worse due to the late closing times coming back again,' she wrote. Ms Breslin's case was that her job was made 'overwhelming and physically hard' because of these issues and that she began to experience anxiety, low mood, high blood pressure and gastrointestinal problems 'as a result of work-related stress'. Following a medical absence in June 2022, Ms Breslin again wrote to her employer and set out that because the department was so 'understaffed' that sales were being lost because customers were walking out without being served. Her employer's position was this was 'a commercial point and not a personal grievance'. Ms Breslin had seven periods of certified medical leave between January 2022 and the summer of 2023, the tribunal heard. In an exchange of emails with her employer during her fifth period of medical leave in June 2023, Ms Breslin said she believed her illness was 'work-related'. 'There are major obstacles stopping me from doing a good job and this has been going on for years. It's got far worse in the last 4 months and definitely having a negative impact on my working life due to a stressful and sometimes toxic work environment,' she wrote. In responding correspondence, she was told: 'I am hoping you can get to the bottom of your sickness so you feel better,' the WRC heard. The tribunal heard that Ms Breslin worked her last shift on 25th June 2023 and ultimately did not return to work before she tendered her resignation on 31st October that year. Chantelle's managing director, who gave evidence, said she had assumed Ms Breslin would return to her job when she got better and that her resignation 'was pleasant and made no mention of issues or other employees' behaviour'. When it was put to her in cross-examination that Ms Breslin had told her she was 'burned out', the managing director said she 'understood there was an issue' of work-related stress but that she 'did not relate this' to Ms Breslin's resignation. Asked what she had done to respond to the staffing issues raised by Ms Breslin, the managing director said these were 'a matter for the shop'. In her decision, adjudicator Patricia Owens wrote Ms Breslin had been raising 'serious concerns for her physical and mental health' starting in October 2021. While the managing director made efforts to resolve 'minor issues' for Ms Breslin around medical certs and annual leave, 'more complex matters' around roster problems and staff shortages 'were never addressed', Ms Owens wrote. 'I consider that the respondent failed in its duty of care to the complainant to protect her health, safety and wellbeing while at work,' Ms Owens wrote. She considered the firm's failure to respond adequately to amount to 'repudiation of contract', upholding Ms Breslin's unfair dismissal claim. Ms Owens awarded the claimant €15,800, her full losses for five months' unemployment. A further complaint of disability discrimination under the Employment Equality Act was ruled out of time by the Commission. Ms Breslin was represented by Aisling Irish of Parker Law Solicitors in the case, while human resources consultancy Tom Smyth and Associates appeared for the employer.
