A street sweeper who won an unfair dismissal claim after he was fired for objecting to an Acknowledgment of Country has received a compensation payout from the council and is now considering running for parliament.
Melbourne man Shaun Turner, 60, was sacked from his role as a street sweeper for Darebin City Council in June 2024 after he questioned the ceremony at a toolbox meeting.
The council worker, whose father served in World War II, told the meeting: 'If you need to be thanking anyone, it's the people who have worn the uniform and fought for our country to keep us free.'
'It's getting out of hand and people are losing it, it is now being done at the opening of a postage stamp.'
Council officers investigated Mr Turner's alleged 'serious misconduct,' but the father of three doubled down and was let go.
'As far as I know half of us are born here, I don't need to be welcomed to my own country. If people don't want to be there, they can leave,' Mr Turner told the officers.
Mr Turner said that Acknowledgment of Country should be reserved for more formal or international occasions.
The Fair Work Commission upheld his unfair dismissal claim, with Mr Turner believing his legal win resonated with the 'silent majority' of people in Australia.
Mr Turner told the Herald Sun he had received a compensation payout that was 'satisfying' and that he would not return to working with the council.
He is now considering running for a spot in the Senate at the next election.
'I've had a lot of time to think and I'm thinking about (federal) politics,' he said.
Fair Work Commission Deputy President Richard Clancy ruled in favour of Mr Turner labelling his dismissal as 'harsh' and 'disproportionate'.
The commission is set to hold a hearing to consider Mr Turner's request for reinstatement and to determine the remedy for the unfair dismissal.
Mr Turner said he would not speak about the details of his case as the commission was deliberating, however he wanted it known that his actions were not racially motivated.
'When it comes to this, the first thing that happens is you are labelled racist. I may not like a lot of people but I have no problem with Aboriginal people,' Mr Turner said.
'I played football, I was brought up with people of all races in Broadmeadows. Some you get on with, some you don't. The easy thing to throw around these days if you can't win an argument is to call someone racist.'
Mr Turner believes Acknowledgement of Country is unsuitable for small meetings and should rather be reserved for large events attended by international visitors.
Before Mr Turner was dismissed, he attended another meeting with Council Chief of People Officer Yvette Fuller.
Ms Fuller informed Mr Turner that there was a firm expectation for an Acknowledgment of Country to precede all formal meetings.
Mr Turner questioned: 'Why didn't we do it in this meeting then?,' to which Ms Fuller then asked: 'Are you saying you will continue to disrupt an Acknowledgement of Country?'.
'I won't disrupt it but I want to be asked if I would like you to give me the courtesy to step outside,' he replied.
In his termination letter, Darebin City Council alleged during the May 21, 2024 meeting that Mr Turner had said 'the Acknowledgment of Country is not necessary'.
The council further alleged Mr Turner said Aboriginal and Torres Strait Islanders 'do not deserve an acknowledgment at the start of meetings'.
But Fair Work Commission's Deputy President Richard Clancy found Mr Turner's statements were not delivered in the manner or tone alleged by the council.
'I am not persuaded that Mr Turner said either 'The Acknowledgment of Country is not necessary' or that Aboriginal and Torres Strait Islanders 'do not deserve an acknowledgment at the start of meetings',' Mr Clancy said.
'I am satisfied, however, that Mr Turner made a comment to the effect that if anyone was to be acknowledged or thanked at a toolbox meeting, it should be the servicemen and women who had fought for this country (i.e. Australia) but I do not consider that expressing such an opinion constitutes a valid reason for dismissal.'
Mr Clancy said the Acknowledgement of Country would have caught the members of the street cleaning team off guard.
He added Mr Turner's specific question 'are you joking?' and his reference to the 'opening of a postage stamp' was the articulation of a reaction of surprise.
'I regard Mr Turner's various comments as having been a spontaneous expression of his opinion that Acknowledgements of Country are appropriate on special occasions but one was not necessary at the toolbox meeting,' Mr Clancy said.
'His comments were laced with his underlying frustration in relation to the various issues pertaining to his work.
'I have not been persuaded these particular comments of Mr Turner either rise to the level of having been disrespectful and aggressive in tone, or that they were perceived by anyone to be so.'
Mr Clancy labelled Mr Turner's dismissal as 'harsh' and 'disproportionate' to the context within which his comments were made.
'I reiterate that even if the reasons for the dismissal relating to the comments about Acknowledgements of Country and Mr Turner's colleague were regarded as valid, the dismissal was harsh,' Mr Clancy said.
'It was disproportionate having regard to the context within which his comments were made and Mr Turner's circumstances.'
The Council's submissions indicated that it took particular offence to Mr Turner's use of the word 'courtesy' when asked if he would be given the option to 'step outside' during an Acknowledgement of Country.
Council said the use of the word 'displayed contempt to the council's Indigenous employees and community'.
But Mr Clancy disagreed with the council's assessment.
'That Mr Turner holds a different point of view when it comes to Acknowledgements of Country does not, of itself, make him contemptuous of the Respondents.'
Mr Clancy noted that both Ms Fuller and Elizabeth Skinner, who was the city works manager at the time, were sufficiently concerned by Mr Turner's conduct that they each contacted his Indigenous support person after the meeting to offer an apology.
However, during the Fair Work proceedings, there was no evidence given to show the support person felt offended.
In his testimony for the Fair Work claim, Mr Turner said he believed he was 'being made out to be a racist'.
'I've got to say that I was brought up on Broadmeadows. I come from a family of eight,' he said.
'My best friends out at Broadmeadows happen to be Aboriginal [people], one of them marrying my sister. I have a niece and great-niece and nephews who are all Aboriginal.'

Labor MPs are increasing pressure on the government to speed up reform of the controversial Morrison-era job-ready graduates (JRG) scheme that has 'failed' students. The Albanese government has flagged its intention to reform the scheme, but MPs have told Guardian Australia it should be a priority early in Labor's second term. Louise Miller-Frost, a South Australian Labor MP, said the JRG scheme, which has been widely condemned for hiking the cost of humanities and social science degrees, has angered voters. 'It is something that gets raised quite often, particularly when I'm talking to students about the 20% off Hecs which is very popular and people love it, but this is the next step,' she said. The matter has also been raised with Victorian MP Carina Garland, who studied humanities and has worked as an academic. She said the reforms needed to be done as soon as possible. 'I would hate to see the scheme becoming too entrenched,' Garland said. 'It's really clear from my community that they want the government to act on the current job-ready graduates scheme, and it should happen sooner rather than later. 'The [universities] accord was pretty clear in its assessment and the minister has said we will move progressively to implement the recommendations. I've advocated for change [directly] to the minister's office and will continue to do so.' The scheme, introduced in 2021, changed the fee structure for university courses to increase costs for subjects including arts and law, and lowered course fees for degrees in Stem areas. The scheme also introduced a rule to remove Hecs debt eligibility for students who failed more than 50% of their units. Labor commissioned the universities accord to outline a reform path across the entire sector, which made several key findings on the JRG scheme. In July 2023, the accord released its interim report, which found the fee structure needed to be 'redesigned before it causes long-term damage to Australian higher education by increasing the cost of gaining a qualification', and recommended the 50% pass rule should be scrapped. Labor immediately abolished the 50% pass rule, and later established the Australian Tertiary Education Commission (Atec) to make recommendations on changing the fee structure under the scheme. The education minister, Jason Clare, has provided no timeline on when Atec, which has been in place since 1 July, will make its recommendations. Clare said the accord had 'made a number of recommendations and called out the previous government's job-ready graduates program as a failure'. 'We've bitten off a big chunk of its recommendations already – 31 of 47 in full or in part. This includes changes to make the repayment system for Hecs fairer, which we passed through parliament last week,' he said. Labor MP Sally Sitou railed against the 'failed' rules in parliament last week. Sitou told Guardian Australia the previous Morrison government 'actively undermined and underfunded the university sector' and said reform was 'complex' and would take time. '[The Coalition government] introduced the job-ready graduate scheme which the universities accord said [has] failed, and it made recommendations about how to address this,' she said, adding that Atec would 'help to steer reform across the sector, including advice on the setting of course fees'. Sitou said Labor had made significant progress on reform, and wants a rethink of the rules. The parliament's youngest-ever senator, Labor's 21-year-old Charlotte Walker, said 'stigma' around arts degrees, exacerbated by the JRG program, must end. 'There's a stigma around, 'Oh, why would you want to do that? You're not actually going to be able to get a job'. I do genuinely think that sort of stigma turns students away from studying things,' Walker said. 'I really hope we can start moving past that.'

Here's everything that's happened in Trump World in the last 24 hours that you need to know about. Deep breaths, we're going in. ‌ 1. Donald Trump keeps telling you to reject the evidence of your eyes and ears Trump is still fuming about those job numbers that were published on Friday. You remember, the ones that were so bad that Trump decided to shoot the messenger and fire the head of the Bureau of Labour Statistics (BLS). Erika McEntarfer was confirmed as commissioner of the BLS last year, with the Senate voting in favour by 86 to 8. ‌ She was a credible, career public servant who just happened to have been hired during the Biden administration. And because Trump didn't like the numbers her organisation announced on Friday, he smeared her as a political operative and accused her baselessly of essentially committing fraud. He claimed the numbers were "RIGGED in order to make the Republicans and ME, look bad." ‌ And on the tarmac at Allentown airfield in Pennsylvania, as he switched between Marine One and Air Force One, Trump indicated he was still fuming. "The numbers were ridiculous, that she a scam, in my opinion. In my opinion it's just additional scam." 2. Trump has some thoughts about Sydney Sweeney You will be delighted to learn that 79-year-old convicted felon and, according to a New York Court, sex abuser Donald Trump has some thoughts about 27 year old actor Sydney Sweeney. ‌ It follows the definitely not confcted discourse carnage after she featured in an American Eagle advert with the slogan "Sydney Sweeney has great genes". While people were working out whether the ads were a bit Nazi, or just thirsty, someone looked her up and found she was a registered Republican. Well, someone told Trump that during a huddle on the tarmac and he ‌ "She's a registered Republican?" he said. "Ohhh, now I love her ad. Is that right? Is Sydney Sweeney? I wouldn't have known, but I'm glad you told me that. "If Sydney Sweeney is a registered Republican, I think her ad is fantastic." ‌ He went on to describe the ad as "the "HOTTEST" ad out there" on Truth Social, and compared it to the "TOTAL DISASTER" of Jaguar's "WOKE" rebrand. Then, for some reason he brought up Taylor Swift. "Just look at Woke singer Taylor Swift. Ever since I alerted the world as to what she was by saying on TRUTH that I can't stand her (HATE!). She was booed out of the Super Bowl and became NO LONGER HOT" ‌ None of these things are true. 3. Democrats flee Texas so Trump can't rig the midterms Meanwhile, Democrats in Texas have literally fled the state to avoid Trump's Republicans re-drawing the constituency map to rig the mid-term elections. The Republican-dominated House was unable to establish the quorum of lawmakers required to do business. ‌ Texas Gov. Greg Abbott has made threats about removing members who are absent from their seats. And the House quickly issued civil arrest warrants for absent Democrats and Abbott ordered state troopers to help find and arrest them, but lawmakers physically outside Texas are beyond the jurisdiction of state authorities. Trump, calling into CNBC this morning, was pretty straightforward about what the aim of the gerrymandering is. ‌ "We have an opportunity in Texas to pick up five seats..." He said. "I got the highest vote in the history of Texas as you probably know. And we are entitled to five more seats." 4. Obama and co to face a Grand Jury Trump is delighted to hear that a Grand Jury will be set up to consider the harebrained conspiracy nonsense the Justice Department keep pumping out making unsubstantiated claims of election interference and manufacturing intelligence, neither of which are actually crimes. ‌ Even if they found a crime to claim was committed - say, obstruction of justice - the statute of limitations is 5 years on that, so they'd be SOL with that too. It's almost like this isn't actually about indictments and prosecutions, and all about trying to steal news cycles away from Jeffrey Epstein. ‌ Either way, Trump is delighted. "You've talked how you want success, not retribution," CNBC host Joe Kernan said, incredibly charitably. "The DOJ is now tapping a grand jury to look into the intelligence community's assessment of what was happening with Russia. ‌ "You have nothing to do with directing that?" "Nope," Trump replied. "I have nothing to do with it. I will tell you this, they deserve it. I was happy to hear it." 5. 'We can't relitigate that' ‌ In the same interview, Trump repeatedly lied about the 2020 election being "rigged", which countless court cases and investigations have proved it was not. Still, the best Kernan could do was to tell the President: "We can't relitigate that". ‌ 6. Trump says he'd "like to run again" Trump said (again) that he got the highest numbers in the history of Texas - adding: "A record that won't be beat unless I run again..." Asked if he was going to run again, which would be illegal, Trump said: " not." Of course, he couldn't just leave that hanging. ‌ "I'd like to..." He added. 7. ...and he keeps lying about his numbers - even when challenged Then he went into an unhinged (and entirely untrue) rant about how his numbers are the best he's ever had, and that his approval is up in the 70s. "I have the best poll numbers I ever had," he said. ‌ Kernen, to his credit, corrected the President, saying his numbers are only good "among Republicans". "No. I'm talking about generally," Trump insisted. Kernen (sigh)... said: "Your haters cite polls that have you down in the 30s." ‌ To be clear, it's not just the "haters" who have Trump down in the 30s. It's people who are at all interested in facts and reality. "They're fake polls," Trump retorted. "You also have me in the 70s." He also went on at length about a segment CNN analyst Harry Enten presented a day earlier, where he "went crazy about how well Trump was doing." ‌ The segment he was referring to - which has generated a huge number of complaints to CNN - saw Enten declare Trump "the most influential President" this century. Hundreds of jobseeker payments cancelled illegally by government IT system, watchdog finds

The legality of the system designed to penalise jobseekers has been thrown into doubt after the commonwealth ombudsman found a government department's automatic system unlawfully cancelled payments. The ombudsman has found 964 jobseekers had their payments unlawfully cancelled between April 2022 and July 2024 by the automated IT system that underpins the targeted compliance framework (TCF) system. TCF is designed to make sure jobseekers meet requirements such as attending meetings with an employment provider and applying for jobs to continue to receive their payments. Payment cancellations have been paused since January after the government found a further 1,326 people had financial penalties 'applied incorrectly' due to an IT issue. On top of this, 45 people had their payments illegally cancelled because the system continued to operate in error. On Wednesday, the ombudsman found the payments had been cancelled unlawfully and recommended the government continue to pause cancellations until the it could review the legality of the entire TCF system. The ombudsman, Iain Anderson, said he investigated cancellations where public servants working at the Department of Employment and Workplace Relations had failed to consider individual circumstances before cancelling a payment as laid down by law. 'They were just automating the cancellation without considering the individual circumstances of the jobseeker and whether it was appropriate to cancel the payment or not,' he told Guardian Australia. 'The target compliance framework itself has been very problematic in that regard.' Anderson said that in 2022 DEWR was also meant to put in a 'digital protection framework' to ensure jobseekers were treated fairly, but the department had failed to do so. Anderson said the secretary of DEWR, Natalie Jones, needed to be 'completely confident' the system was working properly before the cancellations resume. 'The targeted compliance framework has had a number of different problems, and so the secretary of DEWR needs to do much more than simply look at the unlawful cancellation issue. 'They need to be really certain that the entire target compliance framework is going to comply with the law and be fair.' He said there were also concerns as to whether the suspension of payments, which happens in tens of thousands of cases each month, was legal. 'We have some concerns as to whether the suspension process is happening fairly and reasonably,' he said. On top of this, Guardian Australia understands a Deloitte report into the IT system that underpins the TCF has found that it is not functioning within the proper legal frameworks. The Deloitte report – which has yet to be published – recommends overhauling the TCF's IT system to ensure that the suspension or cancellation of payments is done legally. The Greens have called for the government to abolish the TCF and release the report. 'It is clear that the TCF is an expensive hangover from a conservative government which has been heartlessly prolonged by this Labor government for far too long,' senator Penny Allman-Payne said. The DEWR is also conducting a legal review to examine the way decisions are being made under the legislation. The Ombudsman will continue to investigate the TCF with another report due out later in the year.
