
Bihar's SIR row: Supreme Court declines to stay publication of draft electoral rolls
A bench of Justices Surya Kant and Joymalya Bagchi observed that since the petitioners did not seek interim relief during the initial hearing, it could not be granted at this stage, and the matter would be interpreted once and for all.

In a short hearing, the apex court emphasised that the ECI should consider Aadhaar cards and Electoral Photo Identity Cards (EPIC) for voter verification.
As senior advocate Rakesh Dwivedi, appearing on ECI's behalf, raised reservations about the documents, adding that many fake ration cards have been issued, the court said: "As far as ration cards are concerned, we can say they can be forged easily, but Aadhaar and voter cards have some sanctity and have a presumption of genuineness. You proceed with these two documents (Aadhaar and EPIC). Wherever you find forgery, that's on case-to-case basis."
Several petitions have been filed before the Supreme Court claiming that if the June 26 decision of the ECI directing SIR is not set aside, it can "arbitrarily" and "without due process" disenfranchise lakhs of voters, disrupt free and fair elections and democracy.
The petitioners have questioned the timing and legality of the revision exercise, arguing that the poll body initiated an extensive revision process in a poll-bound state without sufficient safeguards or public clarity.
In an earlier hearing, the apex court advised the ECI to consider accepting Aadhaar cards, ration cards, or previously issued voter ID cards as valid identification for electoral rolls verification.
In its order passed on July 10, the Supreme Court outlined three core issues to be addressed in the hearing: The legal authority of the EC to conduct a special revision, the validity of its procedures, and the timing of the exercise, given its proximity to a crucial state election.
As per the SIR schedule released by the poll body, every elector who has submitted the enumeration form — with or without supporting documents — will be included in the draft electoral roll set to be published on August 1. Electors who have not submitted their forms will still be entitled to seek inclusion in the final roll by filing a claim in the prescribed form along with the required declaration.
"Therefore, any person excluded from the draft roll has another opportunity to be included by submitting the form with the necessary declaration and documents. This claims period will remain open for 31 days following the publication of the draft roll, i.e., until September 1, 2025," the Commission said in an affidavit filed before the Supreme Court.
After the completion of the entire process, the final roll will be published on September 30, the reply document added.
The ECI also submitted that even after the final roll is published, new electors may still be enrolled up to the last date for filing nominations for the upcoming Bihar Assembly elections.

New Delhi, Jul 30 (PTI) The Supreme Court on Wednesday pulled up the Tamil Nadu government for implicating more than 2000 persons in cash-for-jobs scam cases involving ex-minister V Senthil Balaji, and sought the details of all the accused and witnesses. Terming the trial in cases involving ex-minister as "rudderless ship", a bench of Justices Surya Kant and Joymalya Bagchi said that had there not been judicial intervention, the "reluctant state" wanted to give a decent burial of cases involving ex-minister Senthil Balaji in the cash-for-job scam case. "With over 2000 accused and 500 witnesses it will be the most populated trial of India. A small courtroom of the trial court will not suffice and a cricket stadium will be needed to even mark the presence of the accused. Several Artificial Intelligence-generated accused will pop up to mark their presence," the bench told senior advocate Gopal Sankaranaryanan, appearing for Y Balaji, representing victims of the scam and opposing the decision for clubbing of the cases. On a prayer for appointment of a special public prosecutor, the bench told senior advocate Abhishek Singhvi, appearing for the state, that when a powerful minister and affluent people are accused in a case, there is a perception that a lone public prosecutor will not be able to do justice. On Tuesday, the top court expressed displeasure over the Tamil Nadu government "attempting to delay" the trial in cases involving Balaji by implicating more than 2,000 people as accused in the alleged cash-for-jobs scam and described the attempt as a "complete fraud on the judicial system". Balaji resigned from the M K Stalin-led state Cabinet on April 27 after being pulled up by the top court. The apex court asked Balaji on April 23 to make a choice "between post and freedom" as it warned him that his bail would be cancelled if he did not step down as a minister. It took exception to the fact that Balaji was reinstated as a minister in the southern state, days after he obtained bail in a money-laundering case related to the alleged cash-for-jobs scam. On September 26, 2024, the top court granted bail to Balaji in a case probed by the Enforcement Directorate. With Balaji spending more than 15 months in jail, the top court had observed that there was no possibility that the trial would be concluded in the near future. Balaji (48) was sworn-in as a minister on September 29 last year, and assigned the same key portfolios of electricity, non-conventional energy development, prohibition and excise that he had held previously in the Stalin Cabinet.

No decision yet on updating National Population Register, says Centre
The Union government is yet to take a decision on updating the National Population Register, the Ministry of Home Affairs told the Lok Sabha on Tuesday. The National Population Register is a list of all the usual residents of India. It was first prepared in 2010. In 2015, information in some fields, such as name, gender and date and place of birth, was updated. Details on Aadhaar, mobile and ration numbers were also collected. In 2022, the home affairs ministry stated that there was a need to update the National Population Register to incorporate changes due to birth, death and migration. After the Union government announced in June that India would conduct its population census in 2027, reports stated that this would also pave the way for the National Population Register to be updated. The National Population Register is the first step to creating an all-India National Register of Citizens, which will identify undocumented migrants residing in the country. While the National Population Register itself does not determine citizenship or require residents to submit documents, its link with the National Register of Citizens and the Citizenship Amendment Rules has raised concerns. Indian Muslims fear that this could be used to harass and disenfranchise them. The Citizenship Amendment Act aimed to provide a fast track to citizenship to refugees from six minority religious communities, except Muslims, from Bangladesh, Afghanistan and Pakistan, on the condition that they have lived in India for six years and have entered the country by December 31, 2014. On March 11, 2024, the Centre notified the Citizenship Amendment Rules, enabling the implementation of the Act. The Centre has claimed that it has no plans to conduct the National Register of Citizens exercise across the country. In August 2019, Assam published an updated National Register of Citizens to distinguish Indian citizens from undocumented immigrants living in the state. More than 19 lakh persons in Assam were left out of the final list of the National Register of Citizens – around 6% of Assam's entire population.
