
Transgender woman treated as ‘hostile invader' when joining women-only app Giggle for Girls, court hears
Giggle for Girls and its CEO, Sall Grover, are challenging Justice Robert Bromwich's landmark federal court judgment that found Roxanne Tickle was indirectly discriminated against when she was barred from the platform in September 2021. The case was the first gender identity discrimination case to reach the federal court.
On the second day of the appeal hearing in Sydney, Tickle's barrister, Georgina Costello KC, told the court her client was directly discriminated against, both when she was barred from the app and when the app refused to readmit her.
Costello said her client was treated 'as a hostile invader', rather than how a cisgender woman would have been treated when joining Giggle for Girls.
The court heard Tickle, who is from regional New South Wales, presented as a woman in an onboarding selfie she uploaded to the app, including by wearing a low-cut top and with her hair down. Grover checked the photo and barred Tickle from membership to the app.
Tickle then approached Grover multiple times asking for her membership to be reinstated. Grover's actions in response were again in breach of the Sex Discrimination Act because she saw Tickle as a man, despite Tickle's continued presentation and identity as a woman, the court heard.

Costello said Bromwich erred when he did not consider evidence including that Tickle presented as a woman in her selfie, that she politely inquired as a female about her access to the app not functioning, and that Grover treated her as a woman when she said she would 'look into' the issues.
'She thinks she's dealing with a woman, then she looks at the photo and decides she is dealing with a man,' Costello said, adding that Grover had a 'wilful blindness to gender identity'.
Tickle's team put to the court that Grover knew she was dealing with a transgender woman – a claim that Grover has always denied.
Grover's denial she knew Tickle was a transgender woman was 'not a defence to direct discrimination', Costello said. If it was, a person could simply deny knowledge of an attribute protected by the Sex Discrimination Act, which would subvert its function, the court heard.
In response to Costello's arguments, Grover's barrister, Noel Hutley SC, said Bromwich was correct in finding direct discrimination had not occurred and that his client was not aware Tickle was transgender.
When dealing with Tickle's potential readmittance to the app, Grover was reacting to a photograph only, he said.
'My client looked at that and formed the view that the respondent was a male,' he told the court, adding that the organisation was having to review 'thousands' of selfies a day.

He said Costello should have cross-examined Grover in court about her affidavit containing evidence she was aware of Tickle's full name, had communicated with her as a female and only then saw her photo.
The court heard Tickle's core sense of identity and self had been undermined by Grover's actions.
Tickle is seeking a total of $40,000, which includes $30,000 in general damages, and $10,000 in aggravated damages. Her team will argue previously awarded damages of $10,000 are inappropriate and did not take into account Grover's conduct around the proceedings.
The court's attention was taken to a candle depicting a crude caricature of Tickle, on sale as part of fundraising efforts for Giggle's campaign. In April 2024, the court was not shown the candle as Bromwich found it too offensive.
Tickle's team claimed further damages should be awarded because of Grover's continued campaign of misgendering of their client and because she laughed at the caricature in a full court room, 'exacerbating the embarrassment and stress'.
Hutley said Grover's laughter in court – described by Bromwich in his judgment as 'obviously disingenuous … offensive and belittling' – should be excluded on the basis that it was the fault of Tickle's counsel for submitting the candle as evidence.
The hearing continues.

He needs to be arrested and the full force of the law thrown onto him.' Former Coalition Speaker of the House Bronwyn Bishop was just as horrified at the shocking scenes. But she pointed the finger the federal Labor government, which has since made the landmark decision to recognise the state of Palestine. Five protesters were arrested for obstructing the roadway, who will be charged on summons. The protest was held days after a massive pro-Palestine rally involving up to 90,000 people across the Sydney Harbour Bridge brought the city to a standstill.

Alleged house of horror double killer smirks and winks in court - after he's accused of murdering mum-to-be and decapitating her partner before putting his head on a spike
A homeless man smiled and winked as he faced court charged with murdering a pregnant woman and decapitating her partner before putting the father-to-be's head on a spike. Ross Judd, 34, wore a simple t-shirt as he fronted Melbourne Magistrates' Court in shackles and flanked by security on Wednesday morning. Judd winked after he tripped as came into the dock but then smiled throughout the brief filing hearing over the two counts of murder. The prosecution asked the court for a ten-week extension because 'it's a complex crime scene with significant amounts of DNA evidence'. The prosecutor also said it was anticipated the autopsies will be delayed as alleged murder victim Athena Georgopoulos, 39, was pregnant when she died. Daily Mail can reveal Ms Georgopoulos was set to face a plea hearing at Ringwood Magistrates' Court on September 1 for car theft and burglary charges. Judd's Legal Aid lawyer didn't oppose the longer than usual period to serve the brief but told the court it was her client's first time in custody. Judd is also facing charges relating to prior allegations of making threats, the Daily Mail can also reveal. The lawyer also said Judd required to see the custody nurse for 'follow-up medication and physical health issues'. Ms Georgopoulos, 39, was allegedly killed alongside her partner Andrew Gunn, 50, in what police believe was a targeted attack at their Mount Waverley home, in Melbourne's south-east. On Wednesday, her mother Petty Georgopoulos paid tribute to her daughter in a heratbreaking post on social media. 'My little heart, you left life so unfairly that I still cannot believe it,' she said in the touching Facebook post. 'In recent days you were so happy - we made dreams together for our little granddaughter that you were going to bring into your life. 'And suddenly, everything was erased in one night, when an [alleged] murderer cut the thread of your life and of my little granddaughter's life that you were going to bring into the world in four months. 'No matter how much they separated us, I will never stop loving you. Forever. Until we meet again, my little girl, in the light of the angels.' She and Mr Gunn were found dead after police received calls from neighbours on Monday night about yelling coming from the property. Heavily armed police swarmed the Adrienne Crescent home at 9.55pm. Inside the small unit, officers allegedly found Mr Gunn's mutilated body next to the body of Ms Georgopoulos. The pair have yet to be formally identified. Judd, who was with two large dogs, was arrested just hours later at nearby Westall Railway Station, about 6km from the crime scene, at around 1.40am on Tuesday. He has since been charged with two counts of murder. Police allege the Judd was known to the couple, and that one of the victims lived in the unit. Police are still working to establish the accused man's connection to the alleged victims and the alleged motive. Ms Georgopoulos was five months pregnant when she died, with her aunt Patty Dilveridis saying her niece was over the moon about becoming a mother. Ms Georgopoulos had also been the primary carer of her mother Petty, who had only recently met Mr Gunn's parents after learning her daughter was pregnant. She had worked as a customer service representative for several electricity and insurance companies. Several of Ms Georgopoulos' friends have posted touching tributes to the mum-to-be who is understood to been with her partner for three years. 'Rest in peace sweet soul. Another upset friend wrote: 'R.I.P Tina I'm lost for words how the f*** can someone just kill someone' Ms Georgopoulos was set to face a plea hearing at Ringwood Magistrates' Court on September 1 for car theft and burglary charges Investigators are also examining whether graffiti scrawled outside the property, including the phrases 'U R Gay,' 'Enough is Enough,' 'Betrayal,' and 'Karma' - is linked to the horror inside. The messages were sprayed in luminous yellow-green and black paint on the home's fence and exterior walls. Detective Inspector Dean Thomas from the Homicide Squad said police received several calls regarding the incident at the address prior to the grim discovery. 'Police were called at about 9.20pm in relation to a welfare check at the address based on some yelling that was heard from the property,' he said. 'A second call was then made that suggested it was perhaps more urgent than the first call and police arrived minutes later, and obviously they found the male and female inside the premises deceased.' Det Insp Thomas said forensic crews and investigators would be at the scene for most of the day, and counselling was being offered to those living in neighbouring units. One neighbour said he did not know the people at the house and had never heard of any trouble or police attending the unit prior to Monday night. 'It's a quiet area,' the man said. A Victoria Police spokesperson confirmed investigators were probing the graffiti. 'Police are aware of graffiti on the property in Mount Waverley where the bodies of two people were located last night,' the spokesperson said. 'Homicide Squad detectives will work to determine if the graffiti is relevant to the murder investigation.' Det Insp Thomas said heavily armed specialist officers, assisted by the police helicopter, tracked the arrested man to the station, where he was taken into custody. 'The person that we took into custody was in the company of two large dogs, I think that would look fairly obvious to people who may have been in the area,' he added.
