Three litigants fined in land ceiling case against govt
A single bench of Justice Rajiv Roy, while dismissing the writ petition of one Ashok Kumar Tiwary and his two siblings, ordered the litigants to deposit the cost amount in the office of Bihar Legal Services Authority (BALSA) within four weeks.
The judgment was delivered on July 10, but it came in the public domain after being uploaded on HC website on Tuesday.
The matter relates to the initiation of three land ceiling cases in 1975-76 over 2,100 acres of agricultural land of a landlord named Shatrumardan Shahi of West Champaran district.
The three petitioners were purported purchasers of six bighas of land from the son of the landlord. Despite repeated demands made by every court and forum in the last 50 years, they could not furnish a single copy of their sale deed, which was allegedly executed on June 23, 1970.
Even the mutation of land was done 25 years after the alleged sale of land.
Justice Roy found that these litigants initiated an endless legal battle only to hoodwink the revenue authorities. The sole motive of such litigants was to delay and defeat the purpose of land reform laws of Bihar, whereby surplus lands of landlords (exceeding the area of the ceiling limit) have been acquired by the govt and distributed among landless or marginal farmers, he remarked.

New Delhi: Three individuals, including a woman, impersonated CBI officials and staged a fake raid at a house in Wazirabad, north Delhi. The trio intimidated the residents, looted gold and silver jewellery, and decamped with Rs 3 lakh in cash before fleeing to Uttarakhand. The accused have been identified as Shaina alias Tannu (22), Keshav Prasad (28), and Vivek Singh (20). Claiming they had an FIR and a search warrant, they demanded entry into the house. When Jameel asked for their documents, the imposters became aggressive and used abusive language. One of them ordered the family to sit quietly while the others began searching the house. They broke open an almirah and stole jewellery belonging to Jameel's wife along with Rs 3 lakh in cash. Two suspects were spotted riding a motorcycle registered to a woman named Shaina. A subsequent raid at her residence confirmed she was absconding. Using mobile surveillance, police arrested Shaina and Keshav in Mussoorie, while Vivek was apprehended in Haridwar. Based on their confession, police recovered Rs 1.75 lakh in cash, stolen jewellery, the motorcycle used in the crime. Probe revealed that Shaina, a graduate, was the mastermind behind the heist. She enlisted the help of her friend Keshav, who runs a store in Haridwar. Keshav, in turn, brought in his neighbour Vivek, a student, to assist them. After the robbery, the trio used part of the stolen money for personal luxuries and changed their locations to evade arrest.

Gang members checked into Madurdaha guest house citing medical emergency
Kolkata: Members of the gang involved in the shooting at a Patna hospital, who landed in police net on Saturday night at a guest house at Madurdaha, checked in on Friday night on the pretext of an associate's medical treatment, said the owner of the establishment. The three-storey guest house, Green Edge Regency, is merely 280 m away from Anandapur police station. Following the raid, in which five persons — Tauseef alias Badshah, Yunus Khan, Sachin Singh, Harish Singh, and a woman — were nabbed, cops asked other guests to move out and then sealed the guest house on Sunday. The lane adjacent to its entrance was barricaded. Santoshpur resident Madhumita Mukherjee, the owner of the guest house, said the accused sought emergency accommodation for the medical treatment of the woman. HC delivers split judgement on death sentence to 2 convicts in 2013 Pakur SP murder case
1 2 Ranchi: A division bench of Justices Rongon Mukhopadhyay and Sanjay Prasad of the Jharkhand high court delivered a split judgement on the confirmation of death sentence awarded to two convicts by the Dumka Sessions Judge on 26 September 2018 for the death of five policeman and former Pakur superintendent of police (SP) Amarjit Balihar. Hearing the criminal appeal filed by Pravir Murmu alias Pravir Da and Sanatan Baskey alias Tala Da, Justice Mukhopadhyay acquitted the convicts, while Justice Prasad found the convicts to be guilty and upheld the death sentence in the 197-page judgement delivered on July 17. The then Pakur SP Amarjit Balihar and his team travelling in two police vehicles were ambushed by extremists near Jamni crusher plant under the Kathikund police station limits in Dumka on 2 July 2013. SP Balihar, along with five personnel Rajiv Kumar Sharma, Manoj Hembram, Chandan Kumar Thapa, Ashok Kumar Srivastava, and Santosh Kumar Mandal, attained martyrdom. Constables Lebenius Marandi and Dhanraj Maraiya survived the carnage and became eyewitnesses. The prosecution examined 31 witnesses, including the two eyewitnesses, in the court of the Dumka Sessions Judge, which found accused Pravir Da and Tala Da guilty and awarded death penalty. Sanatan filed an appeal before the high court on 14 December 2018, while Pravir filed on 18 December 2018 against the verdict by the Dumka sessions judge . In the high court, Justice Mukhopadhyay held that the version of the eyewitnesses was not reliable. "The witnesses had deposed that they had become unconscious after the shooting and therefore could not have heard the names of the appellants. Though both Marandi and Maraiya were witnesses to the occurrence, they had not seen the convicts participating in the mayhem," the court observed. In para 68 of the judgement, Justice Mukhopadhyay set aside the order of conviction and the death sentence awarded to the convicts. Taking a contradictory view, Justice Prasad held that the eyewitnesses, who were police constables in the team of slain SP Amarjit Balihar, had identified Prabir Da and Tala Da in the court to be present at the place of occurrence. Justice Prasad further held that the gruesome death of an IPS officer, along with his police team in discharge of their official duty, were murdered in broad daylight does not evoke any sympathy. Affirming the death sentence awarded to the two appellants, Justice Prasad directed the state govt to provide a compensation of Rs 2 crores to the kith and kin of Amarjit Balihar and further provide a job in the rank of DSP/deputy collector to the son and daughter of the deceased police officer. Further, a compensation of Rs 50 lakh each should also be provided to the family members of the five police constables who died in the incident and a Grade-IV job in the govt on compassionate grounds.
