Court Awards Rs 27 Lakh Compensation To Man Injured In 2019 Road Accident
New Delhi: A motor accident claims tribunal awarded Rs 27 lakh as compensation to a man injured in a 2019 road accident. The man, Prahalad Rai, was riding his two-wheeler from Kalindi Kunj to Madanpur Khadar when a rashly driven truck rammed his vehicle on July 9, 2019.
The tribunal computed the total compensation under various pecuniary and non-pecuniary losses. It directed the insurer, United India Insurance Company Limited, to pay the entire compensation along with interest.
Presiding officer Shelly Arora stated that the psychological and emotional consequences of the injury diminished Rai's capacity to adapt to alternative employment or social settings, thus compounding the overall effect on his earning ability.
"Given the substantial impact on his ability to undertake field-oriented work, his functional disability is assessed as 50%concerning his earning capacity," the court, in an order dated June 4, said.
The tribunal stated that it was established that the accident occurred "on account of the speedy and rash driving" by the truck driver.
The court further said that according to the precedents of the Supreme Court and high courts, medically determined permanent disability cannot be equated with loss of earning capacity due to functional disability, as it would result in non-objective and absurd compensation.

The court noted that the claimant, who was employed as a delivery boy, endured substantial disability, including deformity in the left lower limb. "This impairment significantly restricts mobility, a critical requirement for his prior employment, which heavily relied on driving and physical activity. The nature of his injury directly impacts his ability to perform essential job functions, particularly those involving extensive fieldwork and continuous driving, which are indispensable for a delivery boy," it stated.

33 ground victims of Air India crash will also get Rs 1 crore compensation from Tatas
While the death toll in the Air India Dreamliner crash in Ahmedabad touched 274 as of Saturday, 33 people who died on the ground will also get the compensation announced by the Tata group. According to the Tata group, people who died on the ground will be eligible for the Rs one crore compensation and the Tatas will cover the medical expenses of those who were injured in the crash. They will make sure that injured individuals receive all the care and support they need. People who died and were injured in the crash are believed to include doctors, students, hospital staff and local residents from the Meghaninagar area, which is close to the airport. The Tatas will provide support in the reconstruction of the B J Medical's hostel, which was hit and badly damaged in the Dreamliner crash. The death of 241 passengers and crew were confirmed dead on board the plane. There is one survivor of the crash. The remaining 33 victims were likely individuals present on the campus of Ahmedabad's BJ Medical College at the time of the crash. When asked whether the Tatas will provide any assistance beyond the financial compensation like offering jobs to the next of kin, an official said, 'nothing has been decided at the moment. We are still assessing the situation and investigation has begun.' Apart from Rs one crore announced by the Tatas, passengers who died in the crash will also get compensation of nearly Rs 1.5 crore from insurance companies. The primary insurers for the Air India policy are: Tata AIG General Insurance (lead insurer with over 40 per cent share), ICICI Lombard General Insurance, New India Assurance and other PSU general insurers. The final bill will be taken by the reinsurers led by AIG.

On Friday, the Supreme Court issued a notice to the Karnataka government, seeking its response to a petition requesting protection against threats targeting the screening of Kamal Haasan's film 'Thug Life'.The makers of Kamal Haasan's film accused the Karnataka government of failing to protect against threats to the film's screening, following backlash over the actor's controversial remarks about the Kannada their petition, they claimed no FIR had been registered despite the threats. Despite these open and public threats, not a single FIR was registered, nor was any prosecution initiated by the State Government. On the contrary, the government appeared to adopt the position of the very fringe elements that issued those threats. We are aggrieved by this inaction and are now before the Supreme Court, seeking enforcement of this Court's past directions..."Advocate Navpreet Kaur added, "We approached the Supreme Court after fringe groups issued open threats on social media to burn down theatres screening 'Thug Life', targeting both cinema halls and the Tamil linguistic minority in Karnataka.
