Boots Ireland guilty of misleading Black Friday discounts

Boots Ireland has admitted breaking pricing laws during a 2023 Black Friday sale, triggering a Competition and Consumer Protection Commission (CCPC) investigation.
The retail giant was summonsed to appear before Judge Anthony Halpin at Dublin District Court today, with the case centred on electric toothbrushes and perfume.
It was prosecuted under a law that compelled traders to base any discount on the lowest price in at least the previous 30 days and to display this price clearly on any price tag or advertisement.
The case centred on Oral B toothbrushes. Noting that the wrongly advertised price information stemmed from "human error", the firm's lack of prior convictions and its guilty plea. Judge Halpin said Boots could avoid a court conviction.
He adjourned the case until June 26, saying that if it paid €4,624 toward the CCPC costs and €1,000 to the Little Flower Penny Dinners charity, he would apply the Probation of Offender's Act.
It was among the first batch of prosecutions under new sales pricing rules introduced in 2022.
Cathal Ó Braonáin BL, for the competition regulator, said the offence arises when a retailer announces a reduced selling cost without announcing the product's prior price, which must be the lowest offered by that trader in the preceding 30 days.
Boots Ireland pleaded guilty to a sample count, with two others withdrawn. Counsel explained that a proposal was accepted on the basis that the company would pay costs and the court would hear facts on all three charges.
Mr Ó Braonáin said CCPC authorised officer David Mulholland was tasked with overseeing and managing traders' price reduction announcements on their websites for the November 17, 2023, Black Friday sale.
Data collected from Boots revealed there had been three breaches.
The first involved a black limited edition Oral-B iO 10 electric toothbrush, which was advertised for sale at €470, and the prior price indicated was €999.99.
The date of the reduction announcement was November 16, 2023, but that was not the lowest price applied to the product over the previous 30 days.
Judge Halpin heard that from November 11 – 14, it was offered for sale at €470, the same price, so €999.99 was not the correct prior price.
The next item was another Oral B electric toothbrush advertised on November 16 for €240, with the indicated prior sale price being €590.99. However, from November 9 – 14, it was offered at a lower cost of €228.
The final charge involved the sale of Dior Eau de Toilette at €104 when the previous price indicated was €123, but it had been offered at a lower cost of €94 earlier that month.
Boots' solicitor, Eoin Mac Aodha, pleaded for leniency, telling Judge Halpin that it was a human error and the firm was remorseful.
He stressed that there were about 104,000 products on promotion on Black Friday, and these offences represented a tiny number of items on sale.
A full review of internal processes has since taken place, and guidance, protocols, and governance have been updated.
Mr MacAodha submitted that Boots was happy to make a charitable donation and to pay costs.
Judge Halpin remarked that Boots was a very reputable firm in Ireland with branches and employees throughout the country, and he noted a senior compliance officer from the company had travelled over from the UK to attend the proceedings.
The charge came under the European Union (Requirements to Indicate Product Prices) (Amendment) Regulations introduced in November 2022.
Lifestyle Sports (Ireland), DID Electrical Appliances, Rath-Wood Home and Garden World pleaded guilty to the same charges on March 10. Today, Judge Halpin noted they had each paid €1,000 to the Little Flower Penny Dinners and the costs of the CCPC; consequently, he spared them convictions and applied the Probation of Offenders Act in their cases.
Following the court hearing, Brian McHugh, Chairperson of the CCPC, said: "Misleading sale discounts harm consumers and harm competition. Businesses need to be able to compete for consumers openly and honestly on price.
"Transparency around sales discounts allows consumers to make informed decisions about their purchases and to shop with confidence."

Deputy Nash said: "Given the limited reliable data that is publicly available on supermarket profits, it is a big stretch for the CCPC to definitely claim that the Irish arms of global retailers are no more or less profitable than their EU counterparts. This is a peculiar conclusion to reach under the circumstances. "This is exactly why Labour's Unfair Pricing Bill, which could compel operators to share data on profit margins with the CCPC so they can undertake more robust market analysis and surveillance to ensure competition is working and consumers are treated fairly, must be enacted by the government. "Because the CCPC says that current prices in Ireland are in line with other EU countries is little comfort to hard-pressed Irish households where salaries are not rising as quickly as prices. "We need to get a better understanding of why prices for the basics in Ireland have remained high for so long; why they are not coming down and why there is only moderate competition with no new, major entrants in 25 years. "This report does not have the answers and it reveals in stark relief how limited the actual functions of the CCPC are. "Farmers have the Agri-Food Regulator to stand up for their interests, while the limited interest the government has in how competition and consumer protection works in the interest of citizens and small retailers means citizens are left to suck up high prices."

A limited supply of accommodation has left students working against the clock to find a place to live during their studies . Jamie McGinty (19), a second-year engineering student from Achill, Co Mayo, says his 'stress levels are through the roof' as he commits to 'a full-time thing checking groups and websites constantly' while working six or seven days a week to afford staying in Galway. In addition to facing a limited supply of expensive housing, the Competition and Consumer Protection Commission (CCPC) this week warned students to be cautious of rental scams. Last year, An Garda Síochána reported that about one third of all accommodation fraud reports occur during August and September, with 34 per cent of victims aged under 25, and 66 per cent aged under 33. READ MORE McGinty has come across plenty of posts online which he believes to be scams: 'So many people are trying to get you to pay deposits or a booking fee for a viewing.' One red flag noted by Muriel Dolan, deputy director of financial education at the CCPC, is landlords claiming 'to be out of town or living abroad and cannot show the property in person'. Maria Balan (23) has just completed a four year art degree at IADT 'This one's quite common', says Maria Balan (23), who has just finished a four-year art degree at IADT. 'It's somebody who poses as a landlord from a different country, in the sense of like, 'Oh I live in London right now, so I cannot come down to see you for a viewing if you don't send me some money,'' says Balan. While Balan is aware that no reputable landlord 'will ask you for money before a viewing', she said it can be difficult to filter out scam advertisements, especially on Facebook and Gumtree. 'The moment that they [landlords] realise I'm from abroad, they would kind of, you know, shy away a little bit, and probably just not talk to me any more,' she says. During her third year of studying, Ms Balan paid €600 per month to live in a 'very small space' which housed three other people. Ronan Meleady (20), a law student at the University of Limerick, says some accommodation advertisements 'don't have any pictures' and don't offer viewings until a payment is given. Meleady, originally from Waterford, secured accommodation in Limerick through a family connection. He is beginning a mandatory placement for his degree in Cork in September and has found 'reasonable enough' digs in the city at €650 a month. I'm not in the same scenario as someone who has no accommodation and desperately needs it,' he said. Ronan Meleady (20) studies Law at the University of Limerick He is concerned that the 'number of students going to college every year is increasing, and we're not really seeing an increase in the amount of student accommodation that's actually affordable for people, and that's actually accessible for people'. Commuting is not an option for Cora Howson (18) from Carrick-on-Shannon, who is going into the second year of an arts degree in Maynooth University this September. Her mother Rachel Howson says that because her daughter doesn't drive, 'It's not feasible for her to commute. She would be doing 12- to 14-hour days [by train] and wouldn't be able to put the focus on her studies.' The search for accommodation is 'absolutely just a nightmare' for the family. Cora is the first in the family to attend university and her mother says the family is having to navigate the market by themselves. Scams on Facebook are rampant, according to Howson: 'Every time I put up a new post on Facebook I get two comments with links. I wouldn't touch anything with a link. I would make sure I can have a viewing, and that deposits are only handed over after we've met the landlord. 'If we don't find something, we'll have to look at taking a year out.'
