
Owner of North Sea collision ship seeks to set up fund for legal claims
MS Solong Schiffahrtsgesellschaft MBH & Co KG, a subsidiary of Ernst Russ, which owns the ship Solong, filed documents at the Admiralty Court in London on Wednesday, according to court records.
It follows the Portuguese-flagged vessel crashing into the anchored tanker Stena Immaculate off the East Yorkshire coast on March 10.
Rescuers saved 36 people from both ships, with one sailor from the Solong, named as Filipino national Mark Angelo Pernia, 38, missing and presumed dead.
Court records show that the 'limitation of liability' claim was filed against logistics firm Samskip MCL BV, and 'all other persons claiming or being entitled to claim loss or damage arising out of or in connection with or resulting from the collision' between the two vessels.
The records also state that a separate legal claim has been filed at the same court by Stena Bulk Marine Services USA LLC, which owns the Stena Immaculate, and Crowley-Stena Marine Solutions LLC, the maritime company managing the ship, against MS Solong Schiffahrtsgesellschaft.
No further details about that claim are currently available, with Stena Bulk having been approached for comment.
In a statement on Monday, Ernst Russ said that the company was 'seeking to face claims' and was setting up the fund for those who have 'verified claims against Solong's owner'.
A spokesperson said: 'The North Sea collision and subsequent fire that involved the container vessel Solong caused substantial damage to both vessels.
'We remain mindful of the loss of a seafarer in this incident, and such a loss felt by the family of Mark Angelo Pernia, his friends and maritime colleagues.
'It became clear to us as owners, and all those involved in the salvage operation, that Solong was critically damaged in the collision and fire, and consequently Ernst Russ has sought a port of refuge for Solong in Aberdeen, to bring her to safety, undertake expert assessment of the damage sustained and deal with damaged containers and cargo on board.
'Whilst the Solong is likely to be a total loss due to the severe damage, Ernst Russ and their insurers remain committed to the safe conclusion of this tragic incident. Ernst Russ are also very grateful to the Port of Aberdeen for accommodating the stricken vessel.
'Given the substantial damage arising from the collision, it follows that the company is setting up a fund in the Admiralty Court in London. This 'limitation fund' is then available for parties who have verified claims against Solong's owner.
'The incident occurred in territorial waters of the UK and there are interested parties and potential claimants residing in the UK, such as public authorities, hence the setting up of a fund in the UK is the most appropriate way forward.
'Owners of the Solong are seeking to face claims and ensure a fund is available for any proven claims.
'This is usual process for large maritime casualties, and the fund provides necessary security for potential claimants' claims.
'Meanwhile, Ernst Russ continues to offer all necessary assistance in support of the ongoing investigations.'
Meanwhile, the Solong's captain, Vladimir Motin, 59, of St Petersburg, Russia, appeared at the Old Bailey on March 21, charged with gross negligence manslaughter and is due to face trial in January next year.
A previous court hearing was told that the collision happened at about 9.47am on March 10, at 10.2 nautical miles from the nearest point on the coast.
The Stena Immaculate anchored at the point of the collision at 6.50pm on the previous evening, with the Solong travelling at about 15 knots when it hit the port side of the other vessel.
Stena Bulk said following the incident that 17,515 barrels of jet fuel were lost due to the collision and the subsequent fire, with the Solong still burning a week after the collision before arriving in Aberdeen on Friday.

Fusion Interior Design reopens its doors to the public with a new store in Cascais
Founded in 2007 (where Nicolau now stands), Fusion Interior Design reopened its doors to the public in Cascais in mid-June. Since the pandemic, the architecture and interior design firm had operated solely from an atelier and showroom in the town. "At the time, we were juggling many projects and had long wanted to focus on just an atelier. But Portugal and Cascais are buzzing right now, so it made perfect sense to reconnect with the public", the company's founders, designers Maria Ana Noronha and Teresa Matos Correia, told Time Out. They're now joined by Teresa Lopes Ferreira, who leads the new store. 'We had many clients who would visit us and say they were sorry we had closed the shop. Often, someone wants to do a project but ends up just buying a piece – a chair or a lamp. We missed that closeness, that contact with people. Being closed for four years in our little bubble really showed us that', they add. Now housed in a fully renovated former barbecue joint – done by the team themselves, naturally – the new space showcases furniture, lamps, ceramics, cushions, lampshades, rugs, fabrics and wallpapers. There are pieces from international brands like Élitis, Pierre Frey and James Malone, alongside Portuguese labels such as Bárbara Osório fabrics, traditional Menezes blankets, Pladec wall coverings, and rugs from Ferreira de Sá and Sugo. In the 100-square-metre shop – complete with a corner dedicated to all things made in Portugal – you'll also find pieces designed by Fusion Interior Design for their own projects. Think the Book lamp, created for the boutique hotel Dream Guincho; the Fantasma shelves for Joaquim Chaves Saúde; or the Ouriço lamp made for the M'ar Puro Hotel in Ericeira. Since day one, the company has maintained a strong focus on sustainable, eco-friendly design and on championing Portuguese talent. 'We value national talent, working closely with Portuguese artists, artisans and suppliers, helping to promote what's made in Portugal. Many of our pieces are designed in-house, always with a focus on bespoke design that aims to reflect the unique identity of each person and each space', they explain. The new shop also features a private studio space, where the designers can meet with clients and work on their projects – an intimate, tucked-away room designed to spark creativity and encourage the free flow of ideas. As the company is very much centred around the work developed by its founders, they admit they don't have overly ambitious plans for the future. An expansion of Fusion Interior Design isn't currently on the table, but they're open to the idea of running pop-ups in other parts of the country. 'Last year, we did a pop-up in Tavira – it was a really fun adventure. That's not to say we wouldn't consider doing the same elsewhere in Portugal'.

Or at least regarding the destiny of one rumoured transfer target in fellow Dane Morten Hjulmand. The Sporting CP midfielder is reportedly on United's wish list as they look to bolster the engine room. And Eriksen, who departed this summer following three years at Old Trafford, might assist his former club in securing his own successor. The Manchester Evening News report Juventus and Manchester City are also vying to snap up Sporting's defensive midfielder. Nevertheless, Portuguese daily A Bola suggested they will allegedly only permit their star to depart if his £69million release clause is activated. That sum could prove too steep for United to complete a deal this summer, though Eriksen's sway might tip the scales in their direction. Hjulmand, who was also on United's wish list last summer, regards his international colleague as a mentor figure, while his existing bond with Ruben Amorim will also strengthen his position. Despite severing ties with the Red Devils this summer, Eriksen seemed to leave on excellent terms. And he was especially praising of Amorim and his contribution since taking over from Erik ten Hag last autumn. "The manager has come in with new ideas," said the Danish stalwart in March. "He's a very honest guy, straightforward, and we're just trying to adapt and get into the system and the habits in his style of play. "He's a good manager. The defensive midfielder arrived in Portugal from Italian side Lecce during the summer of 2023, with the club securing his signature for a reasonable £17m fee. He claimed the Primeira Liga title under Amorim during his debut campaign at the club before being handed the captain's armband in July 2024. That appointment demonstrates the admiration Amorim holds for the player and his leadership abilities, and it seems the sentiment goes both ways. Hjulmand would also be reunited with fellow Danes Rasmus Hojlund, Patrick Dorgu and Chido Obi in Manchester. And he has previously outlined the beneficial impact Amorim has had on his development, saying he was "sad" to see him leave Lisbon. "Ruben was one of the reasons why I came to Sporting," said the midfielder during the international break last November. "When you are coached by him, you get a clear idea of the way he sees football and how he sees us being part of the team. "It's a very important image for the player, to know what his role is, what he can contribute to the team. It was very important when I joined Sporting. The way he sees the players, how he manages the team on and off the field... it's something I've never seen in my career. Manchester United will be in good hands with Ruben."
