Delhi court orders Medha Patkar's release after arrest in L-G defamation case
New Delhi: Offering relief to activist Medha Patkar, a Delhi court on Friday ordered her release on furnishing a Probation Bond and payment of Rs one lakh compensation in a defamation case filed in 2001 by Delhi Lt Governor V.K. Saxena. The order came within hours of her arrest at a city railway station.
In a related development, Patkar withdrew her plea from the Delhi High Court against the orders of lower courts.
A subordinate court ordered her release within hours of being arrested on her arrival at a Delhi railway station at 6 a.m. for being presented before a judge in the Saket district court complex.
She was arrested to execute a non-bailable warrant (NDW) issued against her in the defamation case. The court had observed that she was deliberately flouting its sentencing order to submit probation bonds and Rs one lakh as fine in the defamation case.
The Delhi court had on Wednesday issued an NBW against Patkar over her non-appearance and non-compliance with the sentence order in connection with the 2001 defamation case linked to developments in Ahmedabad, where Saxena headed an organisation called National Council of Civil Liberties.
In 2001, Saxena filed two defamation suits against Narmada Bachao Andolan (NBA) leader Patkar. One pertained to allegedly derogatory remarks she made during a television interview, while the other involved a press statement.
The legal tussle arose from an earlier suit filed by Patkar in 2000, accusing Saxena of publishing defamatory advertisements targeting her and the NBA.
In the High Court on Friday, Patkar's counsel sought permission to withdraw her plea against the orders of the sessions court and the trial court, with the liberty to file a fresh petition, which was allowed by Justice Shalinder Kaur.
"Counsel for the petitioner seeks to withdraw with liberty to file afresh. The petition is dismissed as withdrawn with liberty as prayed," Justice Kaur said.
Earlier, Additional Sessions Judge Vishal Singh of Saket court had observed that instead of appearing before the court to comply with the sentencing of April 8, the 70-year-old social activist had remained absent.
On April 8, Patkar was ordered to be released on probation of good conduct for a period of one year, subject to prior deposit of a compensation amount of Rs one lakh, to be released in favour of the complainant (Saxena).
The appellate court had modified the order of the trial court, which sentenced Patkar to five months of simple imprisonment, apart from ordering her to pay Rs 10 lakh as compensation to Saxena for the harm caused to his reputation.
Advocates Gajinder Kumar, Kiran Jai, Chandra Shekhar, Drishti and Somya Arya, represented Saxena, before the court.

The tribunal noted that the respondents failed to counter these findings or provide contrary evidence. Although the family claimed a monthly income of Rs 30,000 for the deceased, the court accepted a notional income of Rs 16,000 due to a lack of documentary proof, using Karnataka Legal Services Authority guidelines. It awarded Rs 6.4 lakh for loss of dependency. Thane: A day after the train-fall incident near Mumbra killed four passengers and injured nine, passengers living in Kalyan-Dombivli and beyond are demanding that the govt implement the growth centre that the MMRDA had planned in 10 villages of Kalyan, similar to Mumbai's BKC. Such a centre would mean that people would not have to travel to Mumbai, Navi Mumbai and Thane for jobs, resulting in a reduction in local train passengers. Some passengers believe that the govt should prioritise the ongoing infrastructure projects connecting Kalyan-Dombivli to Thane, Mumbai and Navi Mumbai, which would also reduce the number of people travelling by train. Pune: Justifying his decision to join hands with the BJP, Nationalist Congress Party (NCP) chief Ajit Pawar on Tuesday said he and his colleagues were not "saints" who could remain in the opposition and be content with protesting and shouting slogans. Speaking at an event here to mark the 26th Foundation Day of the undivided NCP, Ajit Pawar, currently Maharashtra deputy chief minister, made no definitive statement about the possibility of reuniting with his estranged uncle Sharad Pawar's faction. "The NCP was founded on the ideologies of Chhatrapati Shivaji Maharaj, Mahatma Phule, Dr Babasaheb Ambedkar and Rajarshi Shahu Maharaj. Some people question our decision to join hands with the BJP and the Mahayuti coalition," said Ajit Pawar, who parted ways with his uncle in 2023. "But didn't we align with the Shiv Sena in 2019? Even then, compromises were made. Just sitting in the opposition, raising slogans and taking out protest marches is not enough. We are not saints. We are here to give a direction, address people's issues, and practice the politics of inclusion," he said. The party did not form an alliance with the BJP at the cost of ideology, Ajit Pawar claimed. "When we decided to join the NDA and Mahayuti in Maharashtra, we saw that leaders like Chandrababu Naidu, known for secular ideology, had also aligned with the NDA. In the past, leaders such as West Bengal Chief Minister Mamata Banerjee were also part of the NDA. Our focus is want the schemes of the Centre and state government to reach the last man in society, to improve the people's standard of living and ensure that no section of society feels excluded," he said. On speculation surrounding a possible merger of the two NCP factions, Ajit Pawar said party workers may hold differing opinions, but the final decision rests with the leadership. "It is the party leaders who deliberate and decide on such matters," he added. A systematic campaign was underway to spread misinformation about fund distribution by his ministry, said Pawar who holds the finance portfolio in the BJP-Shiv Sena-NCP government. "Compared to the previous budget, we have increased allocations for Scheduled Tribes," he said, referring to a row over alleged diversion of funds from the ST department for the Ladki Bahin scheme for women. He also refuted rumours that the Ladki Bahin scheme, under which eligible women receive Rs 1500 per month, was being discontinued.
