Calcutta HC says judges shouldn't be bloodthirsty, commutes death sentence to life term in murder case

KOLKATA: Observing that judges should never be "bloodthirsty", the Jalpaiguri Circuit Bench of the Calcutta High Court has ordered commutation of the death sentence of a man to life imprisonment for the murder of his maternal uncle.
Passing the judgment, Justice Sabyasachi Bhattacharyya said that the evolution of society has been towards a reformative approach towards penology, as opposed to a retributive approach.
"There are three cardinal pillars of punishment -- retribution, deterrence and reformation. Whereas deterrence still holds good as a justification, retribution has gradually given way to the reformatory aspect of penalties in modern criminal jurisprudence, both in India and elsewhere," the court said.
Justice Bhattacharyya commuted the death sentence awarded to Aftab Alam by the Jalpaiguri sessions court for committing offence under Section 396 (dacoity with murder) to life sentence for the rest of his life, without any option of premature release for 20 years, unless exceptional circumstances are made out to the satisfaction of the court concerned.
"Judges should never be bloodthirsty. Hanging of murderers has never been too good for them," Justice Bhattacharyya observed.

The Kolkata Police on Saturday (August 16, 2025) stopped the trailer launch of 'The Bengal Files', its director Vivek Agnihotri claimed. The trailer of the film was slated to be screened at a five-star hotel in the metropolis in the afternoon. Police personnel present at the venue refused to comment on the issue. Mr. Agnihotri, however, alleged that it was an attack on the democratic rights of people, as the censor board had cleared the film and 'the Calcutta High Court stayed a ban on it'. The screening of the trailer was first stopped by a representative of the hotel around 1 p.m., who said that permission had been granted for only a press conference, he said. As the trailer was shown again a little later, 'suddenly five-six Kolkata Police officers entered the banquet hall where the programme was being held and stopped the screening midway,' the director claimed. The filmmaker was also seen engaged in a heated argument with the police personnel and a hotel staff. Mr. Agnihotri alleged that the screening was stopped at the behest of the ruling Trinamool Congress and Chief Minister Mamata Banerjee, and that her party leaders also threatened the hotel management to halt the trailer midway. Addressing reporters, Mr. Agnihotri asserted that 'The Bengal Files', 'which is based on facts and has passed the censor hurdle', is being prevented from screening by 'the person who is at the helm of the administration in Bengal'. Asked if he meant Ms. Banerjee, he said, "Yes, you are right." "There can be only one reason behind such a move, to ignore the conspiracy to divide Bengal again. I wish to believe this government is not anti-Hindu," Mr. Agnihotri said. 'The Bengal Files' delves into the communal violence in undivided Bengal during the 1940s. The film is scheduled to release in theatres on September 5. The producer of the film Abhisshek Agarwal later told PTI that "no force can stop us to release the film on September 5." "We are taking advice from legal experts. The trailer launch programme had no legal hurdles. We will move the court soon after today's development," he said.

The filmmaker further alleged that a huge contingent of the Kolkata Police was deployed both inside and outside the hotel premises, and that the laptop to be used for screening was also seized by the cops. On Friday, Agnihotri had stated that he would hold the trailer launch event at a private hotel after the program was cancelled at a movie hall. Speaking to the media, Agnihotri said, 'All the screens have been put up, all tests have been conducted from last night, now at the last minute they are saying we cannot screen it. There is some form of political pressure… who is the most powerful person in this state? If this is not a dictatorship, fascism, then what is it? Law and order in your state has failed, and this is the reason that everyone supports The Bengal Files.' 'Why was it not stopped in the morning? Why is it being stopped now? We have all the permissions. Screenings of films are being stopped in the land of filmmakers like Satyajit Ray…. The ruling party has lodged so many FIRs against me, I had gone to the Calcutta High Court, where a stay was given. If required, I will go to the Supreme Court,' he added. Detained in Odisha last month along with more than 400 others on suspicion of being illegal Bangladeshis, Sainur Islam, 34, became a talking point in the West Bengal migrant issue after his family moved the Calcutta High Court over the matter. Weeks later, however, Sainur left his home state and moved to Tamil Nadu. 'I heard that in Tamil Nadu and Kerala, there is no harassment of Bengali-speaking migrants. It is safe for us, unlike in Odisha, Haryana, Delhi, Rajasthan and others,' Sainur, who arrived in Chennai on July 28, said, speaking over the phone to The Indian Express. A resident of Hariharpara in Murshidabad district, he is currently working in Ayapakkam in Tamil Nadu's Thiruvallur district. The incident sparked a controversy in West Bengal, with Trinamool Congress MPs like Mahua Moitra and Samirul Islam highlighting the matter and threatening to go to court. While Sainur was released four days later, his father filed a habeas corpus petition at the Calcutta High Court with the help of the West Bengal Migrant Labour Welfare Board. The case is ongoing, and the high court has summoned the Odisha advocate general. 'I returned home, but I could not find any jobs. I have been working in Odisha for the last 20 years as a construction worker,' Sainur said. 'I called up contractors and sought a job opportunity. I cannot sit idle at home. I stay with my wife and 14-year-old son, who is in Class 7. He gets private tuitions. I have to take care of my mother and father,' he added. Saying that he had a pending loan of Rs 1 lakh, Sainur said, 'Nine months (of EMI) is due. So when I got an offer of Rs 1,000 a day in Tamil Nadu, I accepted it. In Odisha, I got paid Rs 700.' Sainur's advocate Shabnam Sultana said the Calcutta High Court has directed the advocate general of Odisha to appear physically in court on August 29, when the next hearing will take place. 'Our stand is that through the detention, the man's fundamental right has been violated. There has been a breach of legal process, since they were not produced to a local court within the stipulated time. They were detained for four days,' Sultana said. Saying that Sainur was free to work anywhere, Sultana added, 'Now the illegal detention and compensation part will be heard in court.' 'It is only natural that a migrant will move out for better pay. Apart from the fact that there is no proper job for them here to match the standard they used to live, the state government is yet to announce any scheme for work and rehabilitation to those who have returned or are returning from other states,' Arnab Pal, the convenor of the Paschim Banga Parijayi Sramik Aikya Manch (Joint Platform of West Bengal Migrant Labourers), said.
