[UPDATED] Daim's family condemns MACC's 'vindictive' call to seize assets
KUALA LUMPUR: The family of the late Tun Daim Zainuddin has strongly criticised Malaysian Anti-Corruption Commission (MACC) chief commissioner Tan Sri Azam Baki for what they claim is a politically charged and legally unsound call to seize the former finance minister's alleged undeclared assets.
Lawyer Rajesh Nagarajan, who appeared for Daim's widow Tun Puan Na'imah Abdul Khalid and family, condemned Azam's remarks as "absurd, untenable and vindictive."
"Why the MACC chief is making press statements instead of applying to the court is difficult to understand.
"To suggest Daim's assets be seized is an absurd, untenable and vindictive suggestion as Daim has died and no charges are pending against him.
"On what basis can his assets, now administered by his estate, be seized?
"Did the MACC seek and receive legal advice before saying this?" he said in a statement today.
The lawyer also questioned whether Azam had consulted the Attorney-General before making the statement, saying it "beggars' belief" that the MACC would act without sound legal advice.
He said that the forfeiture of assets is only permitted when a 'serious offence', as defined in the Second Schedule of the Anti-Money Laundering Act 2001, has been proven in court and is supported by a court order.
"No such charge has ever been brought against Daim, except for the technical offence of non-declaration of assets, which is not a 'serious offence.'
"Forfeiture certainly cannot be done over this newest claim of alleged non-declaration of assets, made by Azam yesterday.
"In other words, property of citizens cannot be simply forfeited because the MACC or the government claims to have suspicions about the source or origin of the assets.
If that is the case, no one's property will be safe," he said, adding that the endless campaign of slander, harassment and intimidation directed towards Daim's widow and family is disgraceful, high-handed and must stop.
It was reported that Azam said eight new investigation papers have been opened in the probe into the ownership of the properties, which are worth more than RM2 billion.
Azam said they were working towards forfeiting ownership of properties belonging to the former finance minister and his family, worth in excess of RM2 billion.
He said the commission had been conducting a probe into Daim since February 2023 and had opened several investigation papers, including the latest ones initiated recently.
Daim died Daim died on Nov 12, last year, at the age of 86.
Following Daim's passing, the Kuala Lumpur Sessions Court discharged and acquitted him of charges related to failing to comply with a notice under Section 254 of the Criminal Procedure Code (CPC).

According to Amira, she will record her statement under Section 504 of the Penal Code and Section 233 of the Communications and Multimedia Act following an order from the Papar district police in Sabah. 'I have been summoned and investigated in connection with many previous peaceful assemblies,' she said in an X posting today. 'I remain steadfast in the struggle to bring truth and justice. As long as I can, I will continue to move forward with this struggle.' On the night of May 25, some 60 protesters marched to Dataran Merdeka to protest Azam's third-term extension as MACC chief. The participants, who included representatives from NGOs such as rights group Suaram, electoral reform group Bersih and political parties like Muda and Parti Sosialis Malaysia (PSM), marched from the Sogo shopping complex just after 8pm. At the rally, Amira had called for greater transparency from the government and not to weaponise the anti-graft agency.

Anti-Israeli protestors disrupt diners in Korean restaurant: Legit action or just plain nuisance?
JUST where does one draw the line? Showing solidarity with Palestine in the on-going Israel-Hamas conflict can take many forms – peaceful protests, social media campaigns and of course, boycotts. But can protestors single out individuals and their family members as targets of their ire? This is apparently the case as highlighted by a post by journalist Sulaiman Ahmad (@ShaykhSulaiman) showing a video of a group of anti-Israel protestors taking their demonstration inside a restaurant in Seoul. The incident which took place on April 22 shows a group of protestors targeting the Israeli ambassador to South Korea Rai Harpaz. In the footage, one protester can be seen telling the ambassador, 'Science and technology should not be used as tools of genocide' while another holds a Palestinian keffiyeh scarf near Harpaz's table. Harpaz was dining with three other people. The Israeli embassy later confirmed that Harpaz was joined by family members. The ambassador is seen responding calmly with a 'thank you' while trying to avert his attention by making calls on his phone. The situation was diffused by a man claiming to be a police officer who instructed the protestors to leave as there were other customers in the restaurant and that this was not the proper platform for a demonstration. Don't emulate this in Malaysia However, the protestors claimed the Israeli embassy refused to acknowledge them or have a dialogue. Eventually, the protestors did leave and it was reported that no arrest were made. Is such conduct acceptable? One commenter highlighted the obvious error in ethnicity whilst applauding their actions. Highlighting that 'humanity is universal', the pro-Palestine brigade praised the protestors for their bravery in standing up the 'occupying force'. One netizen went as far as to assert that Israelis were not welcome anywhere. Despite Malaysia's official pro-Palestine stance, it must be underlined that this sort of behaviour cannot be normalised. Why? Imagine a group of Malaysian protestors doing the same to foreign diplomats in Kuala Lumpur by accusing them of being 'complicit' in the atrocities in Gaza. Or harassing those whom they believe have Jewish heritage. Make no mistake for this is a very emotive and sensitive issue but therein lies the need to keep emotions in check.
