Witness Throws Fraud Case into Disarray at Palm Ridge Court

The high-stakes fraud trial against businessman Rushil Singh took an unexpected turn on Wednesday when a key prosecution witness delivered testimony that appeared to contradict earlier claims, casting doubt on the foundation of the State's case.
Appearing before Judge Venter at the Palm Ridge Specialised Commercial Crimes Court, the witness — who had submitted three affidavits detailing how Singh and his late sister, Nishani Singh, allegedly defrauded Investec Bank — conceded under cross-examination that there may have been no intention to commit fraud.
Rushil Singh and Nishani Singh were accused of submitting fraudulent bank guarantees, allegedly issued by Stanbic Bank Ghana, to secure more than R150 million in credit facilities from Investec between 2017 and 2022.
The pair were arrested in 2023 and have been in custody ever since. Nishani, who suffered from severe health complications, died on Saturday at Chris Hani Baragwanath Hospital while awaiting trial. Now, the witness's testimony threatens to upend the State's case entirely.

Affidavits Under Scrutiny
During Wednesday's proceedings, the witness confirmed authoring three affidavits submitted to the State — all of which were accepted into the record by Judge Venter.
While the affidavits outline how guarantees were submitted and how the bank was allegedly misled, the witness admitted they do not directly prove criminal intent.'These affidavits establish a prima facie case,' he said, 'but they do not show that the accused acted with intent to defraud.'
He went further, explaining that the guarantees, which were meant to secure substantial loans, were represented as being backed by cash reserves held in Ghana by the Joint Investment Company (JIC). 'It made logical sense to assume the guarantees were backed by cash,' he told the court.
Pressed by the defence on whether Rushil or Nishani Singh knowingly provided false guarantees, the witness replied, 'No.'
He acknowledged that many of the email attachments used as evidence in the affidavits were genuine and not forged, a revelation that further weakens the prosecution's claim of fabricated documentation.
Defence Seizes Opportunity
The defence was quick to highlight inconsistencies in the witness's account, arguing that if the documentation was legitimate and the guarantees were presented in line with standard banking practices, then the case hinges on misunderstanding, not malice.
'This may be a case of reckless financial conduct, but not criminal fraud,' said the witness under questioning. With the State's star witness softening his earlier position, the defence believes the court may soon have little choice but to reconsider the charges against Rushil Singh.
Calls for Inquiry Into Sister's Death
Meanwhile, the death of Nishani Singh has sparked mounting public pressure for an independent investigation. She had been in visibly poor health during recent court appearances and was reportedly denied adequate medical care while in custody.
Her death has raised uncomfortable questions about the treatment of pre-trial detainees in South Africa's prison system.'If this testimony holds, it means Nishani may have died while innocent,' a legal analyst told reporters outside court.

Their lawyer, Musawenkosi Mkhize, said the twins are married, with Vukani having six children and Vukile having five. He said they also co-own a property worth R700,000 and cars, which include a Ford Ranger bakkie and a Mercedes-Benz. They both stated that they are breadwinners who earn approximately R35,000 a month. He said their employees were not paid their salaries due to their incarceration, and that is why they should get bail. Mkhize said it was an exceptional circumstance that his clients were running a company. Additionally, he said his clients were traditional healers who also ran a church. Mkhize said his clients should get bail because the State has a weak case against them. 'How are the two applicants linked? The incident occurred around January this year. The number of months has lapsed, arrests were only made in July,' he said. Mkhize said, judging by what the investigating officer is saying in his affidavit, the State relied on one witness, Shange. As he was arguing, Magistrate Siyanda Mlaba asked Mkhize to tell him about the exceptional circumstances of his clients. Senior State prosecutor, Calvin Govender, said it is the onus of the applicants to prove that they have exceptional circumstances, and they have failed to do so. He reminded the court that this was a bail application and that all evidence would be led during the trial. Govender said the police wanted to get their ducks in a row before making an arrest. 'That is why there was a delay,' he explained. He submitted that the State is of the view that there would be interference with the witnesses should the twins get bail. He said the previous manager from Prasa had to resign because of the twins, who wanted to be paid for work that Prasa was not satisfied with. He said Khoale paid with his life because he also refused to pay the twins for work that Prasa was not satisfied with. 'Everyone at Prasa is afraid of the applicants due to the known fact that they threatened their colleague and killed the other,' Govender added. Delivering his ruling, Magistrate Mlaba reminded that the bail was under Schedule 6 of the Criminal Procedure Act. He said the accused were facing serious allegations, and further emphasised that this was not a trial but a bail application. Mlaba criticised Mkhize, saying that he said a lot of things but failed to tell the court why his clients should get bail. 'I remember asking him to hit the nail in the hand. I even asked him the definition of exceptional circumstances. But the attorney was not giving what I was expecting. I ended up just keeping quiet,' he said. He said the worst part was that there was no alternative address for the twins should they receive bail. He said the defence failed to tell the court those exceptional circumstances. The matter has been postponed to September 29 for further investigation.

Pressure mounts to capture murder suspect linked to Roodepoort police killings
Calls for the arrest of murder accused Zimbabwe national Jabulani Thabang Moyo are intensifying, Roodepoort Record reports. This after the fatal shootings of two police officers, 51-year-old Warrant Officer Vuyisile Sintwa, and 45-year-old Sergeant Simon Masenye, in the Roodepoort CBD on August 8. When the incident occurred, the officers were transporting Moyo to Boksburg prison from the Roodepoort Magistrate's Court, where he appeared on a charge of business robbery. New information with regard to what transpired on the day is slowly surfacing: According to reports, Warrant Officer Sintwa, attached to Roodepoort police station, was shot inside the vehicle while it was stationary outside the BP garage at Albertina Sisulu Drive and Kroon Street. He was rushed to Millpark Hospital, where he was declared dead on arrival. Sergeant Masenye, a detective at Florida police station, allegedly tried to flee, but was caught in the crossfire and killed on the scene. The Roodepoort Record has learned that CCTV footage shows the suspect, Moyo, fleeing the scene in the state vehicle, which was later discovered abandoned in Onslow Avenue, Horison, just a few kilometers from the crime scene. Police have issued a R150 000 reward for information leading to his arrest. In a statement, the Gauteng Provincial Legislature's Portfolio Committee on Community Safety chairperson, Bandile Masuku, has expressed deep outrage following the incident. 'The committee views this heinous act not only as an attack on our law enforcement officers, but also a direct assault on the rule of law and the safety of our communities,' he says. 'The committee calls on the police and all relevant law enforcement agencies to act swiftly and decisively in apprehending the suspect. No one should be allowed to evade justice after committing such a despicable crime. 'The murder of police officers, who are entrusted with the critical responsibility of protecting our citizens, must be met with the full might of the law.' Masuku adds the committee demands that the suspect be hunted down, arrested, and made an example of to send a clear message that such violence will not be tolerated. 'Furthermore, the committee calls on government to strengthen mechanisms that ensure the safety of police officers and create a conducive working environment for them. 'Police officers must be empowered and supported in their duties, including being allowed to use necessary force when their lives are in imminent danger.' The Police and Prisons Civil Rights Union (Popcru), also expressed shock at the incident. 'These murders are not just an attack on our members but an attack on the very fabric of law enforcement and public safety in our communities,' reads their statement. 'The cold-blooded killing of officers in the line of duty underscores the extreme risks faced daily by police officers and highlights the urgent need for stronger measures to protect them.' Both entities have expressed their heartfelt condolences to the families, colleagues, and friends of the slain officers, and called on community members to come forward with any information that may lead to Moyo's arrest. Govender brothers face trial for murder at Durban High Court

This is after they made a brief appearance in the Durban Magistrates Court on Friday morning, where they were served with their indictments. The brothers were arrested in January 2025 for the murder of Durban businessman Shailen Singh. Singh was shot dead at Umhlanga Ridge on December 29, 2024. The cause of his death was multiple gunshot wounds to the head and torso. The State is alleging that the murder was pre-planned by the brothers, with Ferrel identified as the shooter. Ferrel is also facing 14 charges: murder, two counts of assault, two counts of assault with intent to cause grievous bodily harm, five counts of crimen injuria, a data message that threatens violence, attempted murder, and two counts of unlawful possession of a firearm. According to the State, Ferrel was previously divorced, and at some stage in 2024, he got into a relationship with Varushka Maharaj. 'Maharaj was previously romantically involved with Byron Moodley,' the State said. On May 18, 2024, Ferrel called Moodley, swore at him, and threatened him with violence. Moodley ended the call, and when he later called Ferrel, he threatened his life. In June, while Moodley was at Cubana, he was confronted by Ferrel and a companion. They both assaulted Moodley by shoving and kicking him. On July 4, Moodley applied for a protection order against Ferrel; however, attempts to serve him with it were unsuccessful. 'On July 5, Ferrel communicated with Moodley via a messaging service and again threatened Moodley's life and swore at him. This continued on July 6 and 7,' the State alleges. Moreover, the State alleges that Ferrel was romantically involved with Salona Ramrutton/Kisten. Ramrutton/ Kisten was residing in one of Ferrel's houses at Kindlewood Estate, where Singh also resided. At some stage, Ferrel became aware that Ramrutton/Kisten had been involved in a sexual relationship with Singh. 'This resulted in a strain in their relationship, which resulted in verbal and physical abuse of her,' the State said. On December 21, 2024, the State alleges that Ferrel assaulted her, and she sought medical treatment. The following day, Ferrel requested Ramrutton/Kisten to visit him, and she obliged. He assaulted her, armed himself with an unlicensed firearm, and fired shots at her. 'Although she was not struck by the bullets, she was thereafter admitted into the hospital with serious injuries,' the State alleges. Additionally, the State alleges that Ferrel, who was enraged with Singh having an affair with Ramrutton/Kisten, conspired with Darren to kill him. The brothers will appear at the High Court on November 13.
