Singer Yasin freed as Court of Appeal overturns life sentence, whipping

The Court of Appeal overturned the conviction of composer and singer Yasin Sulaiman on all three drug-related charges.
PUTRAJAYA : The Court of Appeal today acquitted composer and singer Yasin Sulaiman on all three drug-related charges.
In a unanimous decision, a three-judge panel comprising Justices Che Ruzima Ghazali, Collin Lawrence Sequerah and Azmi Ariffin overturned the High Court's conviction sentencing Yasin to life imprisonment and 16 strokes of the rotan.
However, it reinstated the sessions court's decision ordering Yasin to be placed at Hospital Bahagia Ulu Kinta, Perak, at the pleasure of the Sultan of Selangor.
The appeals court ruled that the lower court had made an error when it dismissed the report provided by the first defence witness, Dr Ian Lloyd Anthony, a consultant forensic psychiatrist from Hospital Bahagia, as hearsay.
'After deliberating and reviewing the authorities submitted, we are of the view that the evidence presented by the defence witness (Dr Ian Lloyd Anthony) is not hearsay.
'This is because the medical report and evidence by Anthony were based on his direct observation of the appellant,' said Che Ruzima.
The court also noted that the trial judge had made findings on the issue of legal insanity but there was no detailed elaboration provided on these.
'This raises the question of whether the High Court judge was entitled to revisit and make findings on the issue,' she added.
Che Ruzima also said Yasin did not make an unsubstantiated claim about his bipolar disorder condition.
'There were medical reports from the Universiti Malaya Medical Centre, Hospital Canselor Tuanku Muhriz UKM (formerly Hospital Universiti Kebangsaan Malaysia) and Pantai Hospital that confirmed that the appellant indeed had issues related to the bipolar disorder and that the condition was detected in 2007.
'There was also evidence that the appellant was given medication to deal with the condition,' he said.
Veteran lawyer Hisyam Teh Poh Teik represented Yasin, while deputy public prosecutor P Sarulatha appeared for the prosecution.
On Aug 22, 2024, the Shah Alam High Court sentenced the Mimpi Laila singer to life imprisonment and ordered that he also be given 16 strokes of the rotan after he was convicted of three drug-related charges.
Judge Norsharidah Awang meted out the sentence after allowing the prosecution's appeal against the sessions court's decision to acquit and discharge him in 2023.
The sessions court ruled that Yasin was not mentally sound when he was arrested on March 24, 2022, despite being aware of his actions, and ordered that he be sent to Hospital Bahagia for treatment.
Yasin was charged in March 2022 with self-administering '11-nor-delta-9 tetrahydrocannabinol-9-carboxylic acid', a primary active component of cannabis.
He was also charged with possession of 193.7gm of cannabis and cultivating 17 cannabis plants at his home in Kota Damansara.
All three charges were framed under the Dangerous Drugs Act 1952.

State Customs director Wan Jamal Abdul Salam Wan Long said the seizure was made after the Rantau Panjang East Zone Narcotics Unit inspected a bag left in the said area and found 10 transparent plastic packets of ganja flowers. He said his department also conducted a check on a Thai man at the same location and found in his bag 15 transparent plastic packets of suspected ganja buds, the potent flowering tops of the cannabis plant. "The total seizure involved two bags containing 25 transparent plastic packets with an estimated weight of over 14kg of suspected ganja buds, worth RM1.43mil. "The cannabis flowers were suspected of being smuggled through an illegal base in Sungai Golok. The man was brought back to the Enforcement Division office in Rantau Panjang for further investigation," he said in a statement Monday (June 16). Wan Jamal Abdul Salam said the case is being investigated under Section 39B of the Dangerous Drugs Act 1952 and if convicted, the offender could be sentenced to death or life imprisonment, and if not sentenced to death, the offender could be sentenced to whipping of not less than 12 strokes. - Bernama

KUALA LUMPUR: The High Court today allowed Tan Sri Muhyiddin Yassin's application to transfer his seven charges of abuse of power and receiving funds from unlawful activities from the Sessions Court to the High Court. Justice Datuk Muhammad Jamil Hussin granted the application after hearing submissions from Muhyiddin's counsel, Datuk Hisyam Teh Poh Teik, and deputy public prosecutor (DPP) Datuk Wan Shaharuddin Wan Ladin. 'I have considered the arguments from both parties and find that the applicant has met the threshold under Section 417(1)(b) of the Criminal Procedure Code for the case to be transferred to the High Court. The three questions of law arising from the charges are of exceptional complexity. 'While I have full confidence in the Sessions Court judge's legal competence and ability to conduct the trial, it is more appropriate for the High Court to determine these legal issues,' the judge said. The court then fixed July 14 for case management. Earlier, Hisyam submitted that the application had satisfied the necessary threshold, and there were sufficient merits for the court to exercise its additional powers under Section 12 of the Schedule to the Courts of Judicature Act 1964. 'In the applicant's affidavit in support, (it is stated that) a number of critical questions of law of unusual difficulty are likely to arise in these criminal proceedings, and that for the ends of justice, the case should be transferred to and tried before the High Court,' he said. Hisyam said the first legal issue is whether the learned Sessions Court judge may invoke both statutory presumptions against the applicant, or is limited to relying solely on the presumption under Sections 23(2) and 50(1) of the Malaysian Anti-Corruption Commission (MACC) Act. 'The second issue is whether, in law, the monies allegedly received by Bersatu constitutes unacceptable gratifications or legitimate political donations, and the third legal issue is whether the word 'organisation' in the context of the MACC Act can be interpreted and construed to also include a political party like Bersatu,' he said. Meanwhile, Wan Shaharuddin submitted that the prosecution had no doubts regarding the competence and capability of the Sessions Court judge to adjudicate all legal issues raised, including those advanced by Muhyiddin in the present application. 'The Sessions Court judge has served on the bench for over 13 years and has nearly three decades of experience in public service. The fact that the applicant is a former Prime Minister does not, by itself, entitle him to choose the court in which his case should be heard,' he said, appearing with DPP Wan Nur Iman Wan Ahmad Afzal. Muhyiddin, 78, who was then Prime Minister and Bersatu president, was charged with four counts of abuse of power for allegedly soliciting RM232.5 million in bribes for the political party from Bukhary Equity Sdn Bhd, Nepturis Sdn Bhd, Mamfor Sdn Bhd, and Datuk Azman Yusoff in connection with the Jana Wibawa project. He was accused of committing the offence at the Prime Minister's Office, Bangunan Perdana Putra, Federal Government Administration Centre in Putrajaya between March 1, 2020, and Aug 20, 2021. The Pagoh member of parliament also faces three charges of receiving RM200 million in illegal proceeds from Bukhary Equity Sdn Bhd, which were deposited into Bersatu's Ambank and CIMB Bank accounts. The offence was allegedly committed at AmBank, Amcorp Mall branch, Petaling Jaya on Jan 7, 2022, and CIMB Bank, Menara KL Branch, Jalan Stesen Sentral, between February 25 and July 16, 2021, and Feb 8 and July 8, 2022. Meanwhile, speaking to reporters after the proceedings, Wan Shaharuddin said the prosecution will file an appeal against the decision by the High Court today.
