NPA rejects consolidation of Zibuse Mlaba's murder case with alleged killer

The National Prosecuting Authority (NPA) has denied the request to consolidate the murder cases of Zibuse Mlaba, a former KZN MPL, and Mncedisi Gwala, a hitman who allegedly killed Mlaba for the bail purposes of the mastermind behind the assassinations.
This was heard in the Mlazi Magistrate's Court on Friday morning, where the alleged mastermind, Duncan Patrick Mzamo Mlaba, who reportedly paid R130 000 for the hit on Mlaba, made a brief appearance.
The State prosecutor, Advocate Sanele Ntombela, confirmed that the defence is aware of the decision of the Deputy Director of Public Prosecutions, Advocate Lawrence Gcaba, not to consolidate the two murder cases for Mzamo's bail application.

The denial of the request is due to issues of jurisdiction, as Mlaba's matter is in the Camperdown Regional Court while Gwala's is at the Mlazi Magistrate's Court.
When Mzamo made his first appearance for the murder of Gwala last month, his attorney, Arvina Harricharan, told the court that they would be making representations to the State to have both the murder cases consolidated so that Mzamo could apply for bail once.
She said once they know the outcome, they will indicate if they are applying for bail. However, for Mlaba's murder case, which is now at the Camperdown Regional Court, Mzamo abandoned bail.

According to the plea of Fortune Dlamini, a coordinator in Mlaba's murder, he said Mzamo is the one who told him that he wanted Mlaba dead.
Dlamini said he organised the hitmen for Mzamo. Mlaba, who was once the ANC provincial deputy chairperson and regent chief of KwaXimba area in Camperdown, was gunned down at Wareing Shopping Centre outside his office on October 21, 2021.
'At some stage after the killing of Mlaba, Gwala was arrested for unlawful possession of an unlicensed firearm. I also learnt that the police collected DNA at the murder scene of Mlaba, and Mzamo instructed me to arrange hitmen to kill Gwala,' Dlamini said in his plea.
He said on February 8, 2022, Gwala was gunned down. Dlamini identified Gwala as the shooter who ended the life of Mlaba.
Dlamini has since been sentenced to 18 years' imprisonment by the Camperdown Regional Court.
Attorney Abdul Karrim, who was standing in for Harricharan, told the Mlazi court that they intend to apply for bail in July as advocate Ntombela would not be available on May 20.
However, the court raised concerns about the date of the bail application being far.
'The accused and the family are waiting for a specific counsel to do the bail application,' Karrim said.
The matter was then set for two days for the bail application in July.

Lynne Brown, the former Public Enterprises Minister deeply implicated in enabling Gupta-linked State Capture at Eskom, Transnet and Denel, is back in the ANC fold – this time helping strategise in the Western Cape. Her reappearance underscores the ANC's blurred lines between renewal and regression, as no top State Capture figure has faced jail despite damning findings by the Zondo commission. The ANC has confirmed that a former Cabinet minister at the heart of the State Capture project has been called on to help the ANC in the Western Cape with strategy. 'The ANC Western Cape legislature caucus confirms, as widely publicised, that former leaders of the party who served in the legislature and the party's provincial structures were invited to participate in the caucus's strategic planning,' said the ANC's Khaled Sayed, who is the leader of the opposition in the Western Cape legislature. The meeting was first reported by City Press/Rapport. (City Press is paywalled.) Brown was at the heart of the State Capture project as she enabled the Gupta network at Eskom, Transnet and Denel by using her position as the minister of public enterprises to influence board appointments at various state-owned companies, the commission of inquiry into State Capture found. As Marianne Merten reported, a prior parliamentary inquiry found that Brown and her predecessor, Malusi Gigaba, had been 'grossly negligent in carrying out their responsibility'. The commission made the finding, but did not recommend further investigations or prosecutions as it did with other political leaders who faced its scrutiny. Daily Maverick reported that Brown escaped a recommendation for further criminal investigation, but described her testimony as 'ludicrous' and a 'ridiculous excuse'. The commission found that she had lied under oath when she said she did not communicate with State Capture linchpin Salim Essa, who engineered the Guptas' extractive network. Its investigators found that he had a hotline to her when she served as a Cabinet minister. Asked if her presence was not out of kilter with the ANC's plans for renewal (code for the party's anti-corruption drive), Sayed said: 'These leaders (Brown was invited along with James Ngculu and former US ambassador Ebrahim Rasool) were invited and engaged based on their previous experience and knowledge, owing to the respective capacities in which they have and do serve the ANC as loyal cadres and members of the movement. 'The current phase of renewal of the ANC, including in the Western Cape, involves drawing on the experience, wisdom, lessons and learnings, arising from the reservoir of leaders who have and continue to serve the ANC in various capacities,' said Sayed. Old liberation struggle loyalties make the ANC do strange things in democratic times. Image: File A Law Enforcement officer from Cape Town's Anti-Land Invasion Unit has been arrested on charges of kidnapping, extortion and murder, following a ransom demand and the discovery of a victim's body in a shallow grave. The Hawks confirmed the arrest was made on Monday in Bellville following an intense investigation and a multi disciplinary intelligence operation. It's alleged the victim was kidnapped in Kraaifontein in May and was last seen by friend in Bellville, while intending to purchase a vehicle. The victim was then kidnapped and assaulted and a ransom amount of R100 000 was made, later being reduced to R10 000. Hawks spokesperson, Siyabulela Vukubi, said the officer's alleged four accomplices were arrested in May and the victim's body was found on Macassar in a shallow grave. 'On May 17, the team followed all the leads that led them to addresses in Philippi and Kleinvlei, which resulted in the arrest of the four accused - Mogamat Samuels (33), Thokozani Kamnjunga (36), Existing Mudivari (33) and Yasseen Jele (30), who have already made a court appearance,' he said. 'The team was led to an open field on the dunes between Monwabisi Beach and Macassar, where one of the accused pointed out a shallow grave where the victim was killed and buried. 'The multi-disciplinary intelligence led operation consisting of the Hawks, Provincial Anti-Kidnapping Unit and Provincial Organised Crime resulted in the arrest of a 43-year-old suspect on June 9, on charges of kidnapping, extortion and murder. 'Upon further probe, it transpired that the City of Cape Town Law Enforcement vehicle, which was driven by the suspect, was utilised in the commission of this heinous crime. 'The suspect will make first appearance in the Blue Downs Magistrate's Court on June 10, thereafter he will be joining his co- accused who will appear on June 12 in the same court for bail application.' Inspector Wayne Dayson for the City's Law Enforcement said they have been working together with the Hawks to secure an arrest. 'The officer who is stationed at the Anti-Land Invasion Unit was arrested amid an investigation by our Safety and Security Information Management Systems unit in collaboration with the Directorate of Priority Crime Investigation (Hawks) into an incident in May. 'While the arrest of the officer is disappointing, the Safety and Security Directorate is committed to rooting out corrupt and criminal elements and will not hesitate to investigate and take the required action when wrongdoing is uncovered. 'This matter is also being dealt with in terms of City policies and processes, and a disciplinary process is under way." The arrest, during a multi-disciplinary operation led by the Hawks, Provincial Anti-Kidnapping Unit, and Provincial Organised Crime, resulted in the arrest of the 43-year-old officer on charges of murder, kidnapping, and extortion. The officer is attached to the Anti-Land Invasion Unit. The provincial spokesperson for the Hawks, Lieutenant Colonel Siyabulela Vukubi, said the kidnapping is alleged to have taken place on May 16 in Kraaifontein. 'The victim was last seen by a friend who reported that the victim(friend) went to Bellville to view a vehicle he intended to purchase and never came back. Instead, another friend of the victim received a call from the victim reporting that he had been kidnapped and was being assaulted,' Vukubi said. Simultaneously, the suspects demanded a ransom of R100,000 for the victim's release. The suspects made further phone calls, and the ransom was reduced to R10,000. 'The suspects subsequently provided a bank account where the money should be deposited. It was alleged that an amount of R5,000 was deposited into that bank account, and the suspects continued to demand the balance,' Vukubi said.
