CCPA's recent advisory on dark patterns sent to over 50 online platforms

India's consumer protection watchdog recently issued an advisory to over 50 online platforms, asking them to eliminate dark patterns and conduct self-audits within three months. The Central Consumer Protection Authority (CCPA) sent the directive not just to e-commerce giants such as Amazon and Flipkart but also to travel aggregators, food-tech platforms, ride-hailing firms, medi-tech start-ups, streaming services, and fintech companies. Business Standard reviewed a copy of the 5 June email, which noted ongoing instances of dark pattern use despite existing guidelines. In some cases, the CCPA said it had issued notices. The advisory cited Rule 4(9) of the Consumer Protection (E-Commerce) Rules, 2020, which mandates that consumer consent for purchases must be explicitly obtained — not automatically recorded through pre-ticked checkboxes or similar mechanisms. Companies are still evaluating the advisory. Flipkart, in a statement, said the company welcomes the CCPA's emphasis on fostering online consumer confidence. 'We are currently assessing the self-audit requirements to ensure comprehensive and timely compliance, and we see this advisory as a reaffirmation of the values already central to our Flipkart Marketplace Platform.' The statement further added: 'Flipkart has been committed towards the dark pattern guidelines and has taken several measures to increase its awareness. Our active collaboration with the government and other stakeholders has been key to jointly shaping a responsible e-commerce ecosystem.' Another platform acknowledged the advisory but noted that the dark pattern guidelines are not legally binding. It argued that such practices are not an industry-wide issue and that companies routinely experiment with design elements to boost engagement and sales. Business Standard wrote to platforms including Amazon, Meesho, Apple, Uber, BookMyShow, Paytm, Namma Yatri, Meta, Nykaa, Zomato, Swiggy, BigBasket, Tata 1mg, and Snapdeal. However, these queries did not elicit a response till the time of going to press. Dark patterns refer to deceptive or manipulative design elements in websites or mobile applications that trick users into taking actions they might not have intended, such as making a purchase or subscribing to a service. In 2023, the government issued guidelines identifying 13 specific types of dark patterns. These include tactics such as creating false urgency, adding items to a cart without consent (basket sneaking), guilt-tripping users (confirm shaming), forcing actions, trapping users in subscriptions (subscription traps), manipulating interfaces (interface interference), bait-and-switch tactics, hiding full costs (drip pricing), disguising advertisements, persistent prompts (nagging), misleading wording, unclear SaaS billing practices, and deceptive malware behaviours (rogue malware).

Meta Platforms is reportedly in advanced discussions to invest over $10 billion in artificial intelligence startup Scale AI. According to a Bloomberg report, the financing, if finalised, would represent Meta's largest external investment in AI to date and one of the most significant private funding rounds in the sector's history . The terms of the deal are reportedly still under negotiation and could change. So far, Meta and Scale AI have not commented on the discussions. Scale AI's growth and valuation trajectory Founded in 2016 by CEO Alexandr Wang, Scale AI specialises in data labeling services essential for training machine learning models. The company has experienced rapid growth, generating approximately $870 million in revenue in 2024 and projecting to double that figure to $2 billion in 2025. As of May 2024, Scale AI was valued at $13.8 billion following a $1 billion Series F funding round led by Accel, with participation from investors including Amazon, Meta, and Nvidia. Scale AI and Meta have previously collaborated on Defense Llama, a large language model built on Meta's Llama 3 architecture, tailored for US national security applications. Defense Llama is designed to assist military planners and intelligence analysts with tasks such as operational planning and threat assessment. Meta's AI investment strategy This potential investment aligns with Meta CEO Mark Zuckerberg's commitment to making AI a central focus for the company. In January, Zuckerberg announced plans to allocate up to $65 billion for AI-related projects in 2025, including infrastructure expansion and team growth. Meta's approach to AI development has traditionally emphasised in-house research and open-source models. However, this prospective deal with Scale AI indicates a strategic shift towards significant external investments, mirroring moves by other tech giants like Microsoft and Amazon, which have invested heavily in AI startups such as OpenAI and Anthropic. Should the investment proceed, it would not only bolster Scale AI's position in the AI ecosystem but also signal Meta's intensified commitment to advancing AI capabilities. The collaboration could accelerate the development of AI technologies across various sectors, including national security, and reshape competitive dynamics within the industry.

A viral video claimed that a portion of the iconic Fifth Avenue in Manhattan was shut down as Amazon founder Jeff Bezos reportedly had furniture delivered to his penthouse on the Upper East Side. In a video posted on TikTok, business owner Raffi Arslanian shared footage of a massive crane hoisting what appeared to be furniture to the top floor of a towering building at the intersection of Fifth Avenue and 26th Street. Arslanian, who owns the luxury candle brand Thompson Ferrier, captured caution tape, barricades, and moving trucks occupying the street below. As he walked by, he zoomed in on the crane's top, showing a large, wrapped item suspended by a rope. Several workers were seen managing traffic as the item was hoisted toward the 24-story building known as 212 Fifth Avenue, where Bezos reportedly owns five apartments worth $119 million, according to the New York Post. 'You want to see how Jeff Bezos delivers his furniture? Let me show you,' Arslanian said in the video. 'Look at that crane. He owns the top floors there. Today is the day he is getting furniture delivered. I think we all can relate to this.' 'I don't know what he is doing but there are more cranes here. He has got monster cranes. There are police escorts here. This is once-in-a-lifetime thing I am showing you. Now back to reality, where, when we move, we get a U-Haul and we do it ourselves but we don't close the street,' he joked. The clip has since gone viral, racking up millions of views. Social media users were quick to chime in, cracking jokes and speculating on the cost of such an extravagant operation. 'Amazon Prime delivery, billionaire subscription,' quipped one user. 'We would all do the same if we had 100 billion dollars,' said another. 'When you're Jeff Bezos, even a whole street takes a coffee break just to move your couch,' joked a third.
