The story so far: The Karnataka government has proposed to bring an amendment to the Karnataka Shops and Commercial Establishment Act, 1961, to increase the daily working hours to 10 from the current nine hours, besides allowing more overtime hours.
What is Karnataka Shops and Commercial Establishment Act, 1961?
The Karnataka Shops and Commercial Establishment Act, 1961 is a law that governs working hours and labour conditions in shops and commercial establishments in the State. It sets the legal framework for how long employees can work, and how overtime, records, and compliance are handled.
What are the key amendments?
The new amendment aims to simplify procedures like record-keeping and certification, especially for smaller establishments. Supporters of the move believe it will enhance the ease of doing business and legitimise working-hour patterns that are already in practice.
The work hours can be increased to 10 hours a day and 48 hours a week. The total number of hours of work, including overtime, shouldn't be more than 12 hours a day.
An employee can work overtime for 144 hours in a period of three continuous months. At present, it is 50 hours. Firms with employees fewer than 10 are exempted from this Act.
Who will benefit from the amendment?
The biggest beneficiaries of the proposed amendment to this Act will be companies in the Information Technology and Information Technology-Enabled Services (IT & ITES) sectors. These include businesses offering software services, backend IT operations, hardware sales, and similar services. These companies are expected to benefit from the formal extension of working hours and the easing of compliance burdens.
What are the concerns?
Trade unions argue that the move legalises existing violations and could lead to exploitation of workers, including wage theft, due to poor enforcement mechanisms and staff shortages in the Labour Department.
The law is ambiguous on increasing the wage proportional to the increased work hours.
Which other states have 10-hour work shifts?
After the Union government passed four Labour Codes in 2019 and 2020 that allowed increasing the work hours, the BJP-ruled Chhattisgarh, Gujarat, Maharashtra, Uttar Pradesh, and Uttarakhand have passed legislations. Recently, Andhra Pradesh Cabinet approved increasing work hours to 10 per day.

A high-level committee under the chairmanship of Union Home Minister and Minister of Cooperation Amit Shah on Wednesday approved central assistance of Rs 2,006.40 crore to Himachal Pradesh for recovery and reconstruction activities in the aftermath of flood, landslides, and the cloudburst incident in 2023. A statement issued by the central government said, 'Out of this (Rs 2,006.40 crore), Rs 1,504.80 crore will be the central share from Recovery and Reconstruction Funding Window under National Disaster Response Fund. Earlier, on December 12, 2023, the Ministry of Home Affairs had approved additional financial assistance of Rs 633.73 crore from the NDRF for Himachal Pradesh…' The committee, comprising the Finance Minister, Agriculture Minister and NITI Aayog Vice-Chairman, considered the proposal for financial assistance to the state through the Recovery and Reconstruction funding window under the National Disaster Response Fund (NDRF). The state government under Chief Minister Sukhvinder Singh Sukhu has long been blaming the Centre for not releasing the Post Disaster Need Assessment (PDNA) funds of approximately Rs 9,000 crore. The issue has been a topic of heated discussions between the ruling party MLAs and the Opposition BJP legislators during various Assembly sessions. Senior BJP leaders, including national president J P Nadda and former chief minister Jai Ram Thakur, hailed the central government on Wednesday for approving the assistance. The Centre had earlier approved Rs 1,658.17 crore for Uttarakhand in the aftermath of the land subsidence in Joshimath, and Rs 555.27 crore for Sikkim in the wake of the glacial lake outburst flood (GLOF) in 2023. Further it also approved projects with an overall financial outlay of Rs 7,253.51 crore for mitigating the risks pertaining to a number of hazards in the areas of urban floods (Rs 3,075.65 crore), landslides (Rs 1,000 crore), GLOF (Rs 150 crore), forest fire (Rs 818.92 crore), lightning (Rs 186.78 crore) and drought (Rs 2,022.16 crore). This additional assistance is over and above the funds released by the Centre to the states under the State Disaster Response Fund (SDRF) which is already placed at the disposal of the states. During the 2024-25 financial year, the Centre released Rs 20,264.40 crore to 28 states under the SDRF and Rs 5,160.76 crore under the NDRF to 19 states. Additionally, Rs 4,984.25 crore was released from the State Disaster Mitigation Fund (SDMF) to 19 states and Rs 719.72 crore from the National Disaster Mitigation Fund (NDMF) to eight states.

Remove Ads New Delhi: All central government employees part of the Unified Pension Scheme UPS ) will now be eligible for retirement and death gratuity benefits available under the Old Pension Scheme (OPS), Union Minister Jitendra Singh said on to this long-pending demand by a large section of government employees, he said, the move addresses a significant demand of government staff and brings parity in retirement benefits Singh, the Minister of State for Personnel , said the new provision reflects the government's commitment to ensure social security for all categories of employees under the National Pension System (NPS).Addressing a presser on the "transformational" journey of the Ministry of Personnel, Public Grievances and Pensions over the last 11 years, he highlighted a series of reforms aimed at simplifying governance, empowering citizens, and humanising government employees covered under the UPS will now be eligible for retirement and death gratuity benefits, as per the provisions of the Central Civil Services (Payment of Gratuity under National Pension System) Rules, 2021, Singh Department of Pension and Pensioners' Welfare (DoPPW), under the Personnel Ministry, on Wednesday issued an order on the "options to avail benefits under Old Pension Scheme on death of government servant during service or his discharge from government service on account of invalidation or disability for central government servants covered under Unified Pension Scheme"."The order gives an employee the option to revert to OPS in case of death in service. It is progressive in nature and addresses the clarifications being sought by employees," DoPPW Secretary V Srinivas told of the All India NPS Employees Federation , Manjeet Singh Patel, welcomed the order and termed it a historic and much-needed move by the said the inclusion of death-cum-retirement gratuity in UPS will remove all the misconceptions of the said, the inclusion of OPS benefits in case of death or disability of any employee during the service under UPS is a great justice."Therefore, a lot of employees will opt for the UPS now," Patel DoPPW had notified the Central Civil Services (Implementation of National Pension System) Rules, 2021, to regulate service-related matters of central government employees covered under the these, Rule 10 provides for the option to be exercised by every central government employee covered under the NPS for availing benefits under the NPS or the Old Pension Scheme in the event of death of a government servant during service or his discharge on the ground of invalidation or disablement."UPS has been notified as an option under the NPS. Therefore, it has been decided that the central government civil employees who opt for UPS under the NPS shall also be eligible for option for availing benefits under UPS or the CCS (Pension) Rules, 2021 or the CSS (Extraordinary Pension) Rules, 2023 in the event of death of the government servant during service or his discharge on the ground of invalidation or disablement," the order finance ministry, on January 24, issued a notification regarding the introduction of UPS as an option under the NPS for recruits to the central government civil service with effect from April 1, 2025. It gives a one-time option to the central government employees covered under the NPS for inclusion under the central government servant who opts for the UPS under the National Pension System shall, at the time of joining the service, exercise an option in Form 1 for availing benefits under the UPS or under the CCS (Pension) Rules, 2021 or the CCS (Extraordinary Pension) Rules, 2023 in the event of his/her death or boarding out on account of disablement or retirement on invalidation, the order said."Existing government servants, who have opted for the Unified Pension Scheme under the National Pension System, shall also exercise such option as soon as possible after the notification of these clarifications," it the case of the death of a government servant while in service, the last option exercised by the deceased employee before his death shall be treated as final, and the family shall have no right to revise the option, said the order issued to all central government DoPPW also issued another order on Wednesday to clarify that the central government employees covered under the UPS shall also be eligible for the benefit of retirement gratuity and death gratuity under the provisions of the Central Civil Service (Payment of Gratuity under National Pension System) Rules, Secretary Srinivas said this order "brings parity between the NPS and UPS pensioners and they will be eligible for Rs 25 lakh gratuity also".Both these orders were released by Singh during the conference.
