The prosecution is raising its concerns.
As day 21 of Sean 'Diddy' Combs' sex tracking trial began, assistant U.S. attorney Maurene Comey shared June 11 that her team is seeking to remove one of the 12 members of the jury, according to NBC News reporters in the courtroom.
'We were very reluctant to put in this letter,' she told Judge Arun Subramanian before the jury entered the New York City courtroom. 'It appeared to be a lack of candor with the court that raises serious issues with us.'
The lead prosecutor added, 'We did not want to do this. We were compelled to do that.'
Defense attorney Alexandra Shapiro—who said that Juror No. 6 is among the panel's Black members—asked for one or two days to 'respond in writing' and 'go over case law.'
The conversation comes after concerns about the juror were first brought forward yesterday by the prosecution in a sealed conversation with the judge. However, in the partial transcript obtained by NBC News, Shapiro said the defense opposed removing the juror and wanted the 'opportunity to be heard' before any decisions were made.

Judge Subramanian said today that he will 'reserve on handling logistics' about the juror—who also stayed the full duration of day 20—until a decision is made.
With the jury seated, Combs' ex-girlfriend—who is going by 'Jane' during the trial and was identified as 'Victim-2' in the indictment—returned for her second day of cross-examination. The witness has continued to testify to the alleged emotional, physical and financial abuse she suffered during their relationship.
She said that participating in 'hotel nights,' details of which are nearly identical to the 'freak offs' his ex recalled in her testimony, felt like a responsibility since she was financially dependent on him. With Combs paying her rent since April 2023, Jane admitted that she felt resentful after being 'introduced' to a lifestyle that was 'built under a lot of emotional manipulation and pressure.'
'I was already so hooked from the beginning,' she testified June 10. 'I fell in love with somebody who I didn't understand the terms and conditions of what our relationship would be like.'
She also testified that Combs had physically assaulted her during arguments, including in one instance where she accused him of kicking and punching her after learning that he was seeing another woman.
Combs has pleaded not guilty to sex trafficking, racketeering conspiracy, sex trafficking by force, fraud, or coercion, as well as transportation to engage in prostitution.

Cyberattack leads to Whole Foods shortages

A cyberattack on a primary organic food distributor has led to empty shelves at Whole Foods stores across the country. The company, Rhode Island-based United Natural Foods Inc. (UNFI), is one of the country's largest organic food distributors and a major partner with Whole Foods. It became aware of a cyberattack on June 5, according to a filing with the Securities and Exchange Commission, and took some of its systems offline, hampering its ability to distribute orders to customers. A spokesperson for United Natural Foods declined to share specifics about the cyberattack, saying it was an ongoing operation. But it comes in the wake of a series of cyberattacks where a notorious cybercriminal gang has been targeting major retail customers with ransomware, rendering key systems inoperable as hackers demand payment. A corporate Whole Foods spokesperson apologized for the inconvenience and said the company is working to restock shelves quickly, but declined to answer specific questions. Two Whole Foods employees, who were not authorized by the company to speak with the press about the incident, told NBC News that the shortages were significant. 'It's affecting operations in a very, very significant way,' an employee at a Sacramento Whole Foods said. 'Shelves don't even have products in some places. The shipments we receive are not what we need, or we did need it but it's too much of one product because UNFI can't communicate with stores to get proper orders.' A Whole Foods employee in North Carolina said: 'We had to shut down our sandwich station on Tuesday because we didn't get any bread delivered. My store almost ran out of trash bags the other day.' The UNFI spokesperson said there was not a clear timeline for when distribution would return to normal, but that on Thursday it had begun gradually bringing some systems back online. John Braley, the director of the Food and Agriculture-Information Sharing and Analysis Center, a nonprofit cybersecurity advisory nonprofit for the food and agriculture industry, said the food supply chain's complexity means that if a company is suddenly hampered by a cyberattack, it can cause trickle-down effects that keep food from reaching customers. 'For a standard, moderately processed food product found in a major supermarket, 10 or more companies can be involved in the supply chain. Even fresh produce — such as an apple sold at a farmers' market — may involve multiple companies, such as the farm itself, local distributor/food hub, and the retailer,' he said in an emailed statement to NBC News. Beyond Whole Foods, smaller companies have also faced shortages from UNFI being unable to automatically process orders. The Community Food Co-Op in Bellingham, Washington, told customers on Facebook Monday that, as UNFI is its primary distributor, 'you'll see sparsely stocked shelves in some of our aisles' and asked customers to limit purchases to two of each item. Caitlin Smith, a logistics coordinator at C.R. England, a trucking and logistics company, told NBC News that the UNFI outage has left her company unable to deliver refrigerated foods to a dairy processing customer. 'I have three drivers sitting stuck because of this whole UNFI debacle,' she said. The costs from the cyberattack will end up being passed onto the consumer, she said. 'At the end of the day, you and I as customers will end up paying for this. So it does have a domino effect.' Ransomware attacks are common. But a particularly vicious campaign has hit major retailers in recent months. At least three major British retailers were hit earlier this year, including Marks & Spencer, which had to pause online orders for weeks; the Co-op, which saw hackers leak significant customer data to the BBC; and Harrods, which had to restrict some internet access at stores. Google said last month that those attacks overlap with a loosely affiliated group the cybersecurity industry has dubbed 'Scattered Spider,' largely English-speaking young men who have mastered the ability to trick people into giving them restricted online access. The same group was accused of breaking into Las Vegas casino companies in 2023. It has begun targeting major American retailers in earnest, Google said. "Jane" — the pseudonym for one of Combs' accusers at his sex-trafficking trial — said on the witness stand this week that Combs sulked and threw a fit after discovering she attended a sex party hosted by another hip-hop star months earlier. In her testimony, Jane said she attended the event, hosted in a Las Vegas hotel room in January 2024, when she believed her relationship with Combs was on a break. Jurors were asked about their knowledge of a list of other celebrities who had some connection to the trial. Prosecutors haven't accused any of them of wrongdoing in the case. Prosecutors have accused Combs of sex trafficking and racketeering, saying he coerced women into participating in elaborate, drug-fueled sexual performances called "freak offs" with other men while he watched. Jane called them "hotel nights." Combs' attorneys have said that his relationships were consensual and that the sex was part of a "swinger lifestyle." The January 2024 incident in Las Vegas indicates that at least one other celebrity hosted a sex performance, which Jane understood Combs saw as a "lifestyle." Jane said she was invited on the trip while speaking to a friend who is the rapper's cousin. The group was going to Las Vegas to celebrate the birthday of the rapper's girlfriend, and she joined them on his private plane, she said. After they landed, the group went out to play and to a celebratory dinner, she said. To Jane's surprise, another person at the dinner was a man named Antoine, with whom she had sex during Combs-arranged freak offs, she said. After a post-dinner trip to a strip club, the unnamed rapper invited Jane to a hotel room, she said. There, she saw Antoine having sex with another woman on a bed while a small group of people watched, she said. The rapper's girlfriend was also present at the sexual performance, she said. "I remember I walked in and Antoine was having sex with a woman, and everybody was watching," she testified. Jane said she and the rapper engaged in "a little flirtatious banter" and that she left after 20 minutes. "He said something along the lines of that that he thought I was beautiful, and he always wanted to blank me," Jane said Thursday, censoring herself. Jane said she and Combs were "on a break" and it was "unnecessary" to tell him about the incident. Combs learned about anyway it in June of that year, she said. The two were spending time with each other again and had invited Antoine to her home for another sexual performance. Jane testified that the two had gotten into a heated argument with each other earlier, yelling and throwing objects at each other, and that Combs physically beat her multiple times. "A woman's power does not override a man's," Jane testified Thursday. After that fight, Combs saw text messages on her phone referencing the Las Vegas sex performance involving the other rapper, she said. As Antoine was arriving, Jane told Combs about the event, she said. He felt betrayed, as Jane described it. "I feel like his heart sank. And he just was like 'I can't believe what you're telling me right now,'" Jane said. "Like, 'Do you have this porn star having something over on me? Did you just cheat on me? Did you just slip away from us?" Combs pulled her into the bathroom and handed her a pill of ecstasy, she said. "I remember him opening his hand with a pill in it, and he said take this fucking pill. Take this fucking pill. You're not going to ruin my fucking night," she said, quoting Combs. Jane said that after she had sex with Antoine while Combs watched, Combs remained emotionally distant. She said the moments after freak offs were when she and Combs could "connect" and "cuddle" with each other. But that night, Combs remained upset about the Las Vegas sex performance and considered it cheating. "He just said, like, 'I can't believe you cheated on me, I can't believe you went outside of us,'" she said. Jane said Combs believed it was a violation within the "lifestyle" for her to attend another man's sex performance. "I understood that he was trying to reference that we were part of some sort of lifestyle and that I betrayed him by being a part of someone else's lifestyle moment, this porn type of thing," she testified Monday. NEW YORK — The identity of an iconic rapper described as having ties to a male escort allegedly hired by Sean 'Diddy' Combs for sordid sex parties remained a mystery during trial testimony Thursday. The day's proceedings began with a closed-door conference between Manhattan Federal Judge Arun Subramanian, prosecutors, and the mogul's lawyers, who have argued in support of identifying famous people who may arise in the questioning of Combs' accuser 'Jane,' which is an alias. Earlier this week, under questioning from the government, Jane described going to Las Vegas in January 2024 with a famous rapper, whose cousin she was friends with, and the rapper's girlfriend. On the trip, she said she bumped into one of the many escorts Combs had forced her to sleep with, Antoine. She said she walked in on him having sex with another woman while the rapper, his girlfriend, and others watched. On Thursday, Combs' attorney, Teny Geragos, shed more light on the rapper's identity, referring to them as 'iconic' and 'very close to Mr. Combs.' She asked Jane if the public figure and his partner had discussed other male escorts with her. 'They were asking me if I knew anybody else in the lifestyle,' the witness said. 'They were looking for someone.' Jane previously testified that she didn't participate in the Vegas sex party, but that Combs later accused her of cheating when he learned about it — reacting in a sadistic manner by forcing her to perform oral sex on Antoine. Her testimony was expected to wrap up later Thursday, following almost three days of cross-examination and six days total on the stand. The feds on Wednesday indicated they are near the end of their case against, Combs, 55, who has pleaded not guilty to sex trafficking, racketeering conspiracy, transporting individuals for prostitution, and related counts. The charges carry a potential decades-long prison sentence. Jurors have heard that the once larger-than-life figure in hip-hop, whose infamous annual 'White Party' at his Hamptons estate hosted some of the most famous faces in the world, was for decades preying upon and sexually humiliating vulnerable young women in highly orchestrated hotel room performances he called 'freak offs.' The drug-fueled sessions typically involved Combs masturbating in a corner while directing women to engage in dehumanizing acts with male escorts, witnesses have described. The alleged victims subjected to 'freak offs' included in the government's case— Jane and Casandra 'Cassie' Ventura— each described an initial period of being showered with affection and promises of a serious relationship with Combs before he took off the mask of his public persona. They said they wanted desperately to have a normal, loving relationship, but he ultimately relegated them to playing one role in his life, in 'freak offs.' Ventura, who was signed to Combs' record label at 19 years old a year before she became involved with him, in 2007, said he got off on disgusting rituals like making escorts urinate in her mouth and requesting she privately massage their semen onto his chest. She described him as pressuring her into 'freak offs' when she was healing from his regular beatings and chronic medical issues resulting from the days-long 'freak offs,' like urinary tract infections, mouth sores, and gastrointestinal problems. Jane, a single mom when she met Combs, has described being in a toxic on-and-off-again relationship with him from 2021 through the lead-up to his 2024 arrest. Jurors have heard graphic testimony about him allegedly beating her in June 2024 when she confronted him about dating a woman much younger woman and then forcing her to perform oral sex on Antoine with a swollen head and developing black eye. Combs has also faced allegations at the trial from a former assistant, testifying under the pseudonym 'Mia,' who alleged he raped, sexually assaulted and imprisoned her against her will. Combs' legal team maintains that while he has beat women, he's not charged with such and never pressured anyone into nonconsensual sex. They've sought to portray his accusers as driven by financial greed and victims of buyer's remorse, not abuse. In seeking to counter the defense's narrative, prosecutors have elicited testimony from Ventura and friends of hers about Combs threatening to to release footage of her at 'freak offs' to keep her compliant. She and Jane said he threatened to render them homeless when they sought to exercise agency and in reams of correspondence shown in court told him they didn't want to sleep with other men, testifying they felt obligated to fulfill Combs' demands. The Manhattan U.S. attorney's office alleges Combs routinely brutalized women with help from high-ranking staff, members of a criminal enterprise who committed sex trafficking, kidnapping, arson, drug distribution, and other crimes. Jurors have heard testimony from several witnesses about how Combs' staff procured him drugs, supplies like baby oil for 'freak offs,' and set up and cleaned the hotel rooms before and after the events. _____
