IDT officials implicated in alleged tender fraud

A forensic investigation into the R836 million Pressure Swing Adsorption (PSA) Oxygen Plant project tender has exposed widespread procurement irregularities, fraud, and governance failures within the Independent Development Trust (IDT).
The project aimed to install oxygen plants at 60 state hospitals nationwide.
Minister of Public Works and Infrastructure Dean Macpherson on Tuesday released the findings and recommended disciplinary action against IDT chief executive officer Tebogo Malaka, general manager for supply chain management Dr Molebedi Sisi, and other officials.
He has also taken steps to implement consequence management, including referring the matter to the Hawks and meeting with the newly appointed IDT board.

The minister reaffirmed his commitment to building a capable and ethical state, directing the department to implement all report recommendations to restore the IDT as a trusted partner in social infrastructure delivery.
The investigation by PricewaterhouseCoopers (PwC) revealed that several companies, including Bulkeng (Pty) Ltd, were awarded contracts without valid South African Health Products Regulatory Authority (SAHPRA) licences.
Macpherson stated that Bulkeng submitted a SAHPRA licence belonging to Atlas Copco Industrial SA without their knowledge or consent, constituting "clear misrepresentation" and "fraud".
Furthermore, Bulkeng planned to subcontract over 25% of its responsibilities without disclosure, violating procurement regulations.
The investigation also found significant flaws in the bid evaluation process, including the deliberate removal of SAHPRA compliance requirements, allowing ineligible bidders to participate and win contracts.
Macpherson expressed shock at the missing or incomplete meeting minutes.
The investigation report also revealed multiple irregularities in the tender process, including improperly constituted committees, undocumented bid scores, and non-transparent price negotiations.
The report noted that the project's costs escalated significantly, from an initial estimate of R216.9m to R253.3m at the design stage, and eventually to R592.5m for implementation.
Bulkeng was awarded contracts worth R428m, despite its CIDB grading limiting it to contracts up to R200m.
The report found that Malaka failed to exercise adequate oversight, ignoring red flags raised by the Department of Health, and failing to convene necessary risk committees.
Dr Sisi was also implicated for misleading stakeholders and failing to fulfill his responsibilities.
The report stated that Dr Sisi advised against cancelling the RFQ process despite warnings from the Department of Health, assuring Malaka and the evaluation committees that the procurement process was compliant.
However, key regulatory requirements, such as valid SAHPRA licences, were not enforced.
Both Malaka and Sisi approved contracts based on flawed internal assurances, according to the report.
The report recommended disciplinary action against officials involved in the tender, particularly Malaka, for endorsing the RFQ process despite irregularities and incorrectly appointing Health Department officials.
Malaka also faces criticism for improperly establishing and managing the bid specification committee (BSC) and bid evaluation committee (BEC), appointing National Department of Health officials as members instead of observers, and violating procurement protocols.
Dr Sisi is also implicated for failing to handle procurement issues in a fair, transparent, and equitable manner, as required by the IDT's supply chain management policy and the Constitution.
Additionally, the report criticises the BEC secretariat for failing to maintain accurate records of meetings and proceedings.

The three workers were inside a container serving as a lamp control room when it plunged into a sinkhole during the Lily Mine collapse on February 5, 2016. The container remains unrecovered to this day. Now, nearly ten years later, the families have been given renewed hope with the promise that recovery efforts will finally get underway. Despite the government's inaction over the years, ActionSA remains committed to supporting the families and ensuring that the remains of the three miners are finally brought home. 'We recognise the importance of direct engagement with the families affected by the tragic incident, and we commend the efforts to provide clarity and reassurance during this difficult time.' Most recently, in a letter to Mineral and Petroleum Resources Minister Gwede Mantashe, Chief Whip Athol Trollip expressed his frustration over ongoing delays and warned that if the government does not retrieve the bodies of the three Lily Mine workers, missing since 2016, within 60 days, ActionSA will take matters into its own hands. ActionSA president Herman Mashaba previously pointed out that the container at Lily Mine is located about 70 metres underground, a stark contrast to the Chilean mining rescue in 2010, where miners were successfully brought to the surface from a depth of around 600 metres. After years of heartache and waiting, the families of the Lily Mine victims were filled with relief and renewed hope following news that plans to retrieve their loved ones may soon begin. Since April 30, 2019, they have camped outside the mine, clinging to faith and resilience through daily prayers at 6am, 12pm, and 6pm, determined to see their loved ones brought home and laid to rest. Speaking to The Star, Rose Mkabi, the heartbroken mother of Yvonne Mnisi, said: 'It's only hope, prayer, and the support of others that keep us going. We go to the mine every single day, crying and praying for our children. I just want my daughter's remains; I want to lay her to rest with dignity. This pain of not knowing, of waiting for so long, is unbearable.' She added that if it were not for Mashaba, the world might have forgotten about their loved ones. 'If it wasn't for him, I'm sure no one would be talking about our children anymore. He's always there for us, paying for our children to go to school, buying us food. To be honest with you, we don't go without because of him. This country has failed us, but in Mashaba, we trust.' Family spokesperson Harry Mazibuko confirmed that during a recent meeting, Business Rescue Practitioner Robert Devereux presented proof of funding from a Chinese investor and assured families that the retrieval work would begin within two months. However, Mazibuko said the families remain cautious. 'To be honest, it's hard for us to trust this until the work starts,' he said. 'This is not the first time we've been given promises and timeframes that never materialised, even by the minister himself. We asked Mr. Devereux why we should believe him now, and he told us that, unlike previous investors or officials, he came in person because he wanted to show us this time it's real.' Mazibuko added that Devereux told the families the funds would be in his possession this week, and that they expect a progress report soon. 'As at 6 June 2025, the outstanding rental amount is R2,540,382.42 (0.5%) and R19,897,707.26 (4.1%) for April and May, respectively,' he said. Macpherson was responding to parliamentary questions from Build One South African leader Mmusi Maimane, who enquired about the Information and Communication Technology outages that affected the ability of the Property Management Trading Entity to process rental payments to landlords in April. Advertisement Next Stay Close ✕ Maimane enquired about the current status of rental payments, the total number of landlords that remained, the total monetary value of outstanding rental payments, and steps his department has taken to ensure that such delays do not recur. Macpherson said there were 1,991 leases for 1,274 landlords valued at R484,425,687.62 in the lease administration system and the payment system for April rental payments as of June 6. 'Forty-four leases (2.2%) affecting 26 landlords (2%) amounting to R2,540,382.42 (0.5%) failed Central Supplier Database (CSD) verification and therefore were not paid.' He also said there had been 1,995 leases for 1,269 landlords valued at R483,952,863.48 for May. At least 89 leases (4.5%) affecting 75 landlords (5.9%), amounting to R19,897,707.26 (4.1%) were not verified and were not paid. Macpherson said the payment system was still processing the June rental payments. 'The outstanding rental payments for April 2025 are 44 leases (2.2%) affecting 26 landlords (2%). The outstanding lease payments for May are 89 leases (4.5%) affecting 75 landlords (5.9%),' he said. 'It must be noted that the non-payment of transactions submitted on the payment system is primarily due to landlords not being compliant with CSD. In addition, 33 CSD non-compliant landlords from April are included in the May figure.' Meanwhile, the Independent Development Trust (IDT) has collected R882 million in payments in just three months from 15 departments that owed for infrastructure projects it implemented on their behalf. 'The IDT has been able to collect R882,374,561 between 01 April 2025 and 30 June 2025,' Macpherson said. The entity has paid a total of 1,366 service providers to the tune of R648,167,277. 'As at 30 June 2025, 790 service providers remained unpaid an amount of R1,394,036,545. The variance in the amount is due to additional invoices that would have been received between 01 April 2025 and 30 June 2025,' he said. Macpherson was responding to ActionSA MP Malebo Patricia Kobe, who enquired about the department's obligation to pay contractors after receiving money due from client departments. The IDT had informed the portfolio committee in June that it was owed R1.2 billion by client departments. It informed Parliament four months ago that it had been unable to pay service providers due to delays in payment by client departments. The entity has incurred R47m in total expenditure on legal costs and owed creditors for more than 12,000 invoices that could not be paid within the 30-day deadline as of the end of March last year.

National Gambling Board boss quits after forensic audit
The National Gambling Board's chief strategic adviser Caroline Kongwa has resigned. She earned R3.4-million last year. Caroline Kongwa, the chief strategic adviser of the National Gambling Board (NGB) for the past six years, resigned earlier this month after being informed of the findings of an independent audit. The NGB regulates the almost R60-billion gambling industry in South Africa. Audit firm TSU Investigation Services found that performance bonuses paid to Kongwa during her tenure 'were not approved in line with the NGB performance management policy and [are] thus deemed irregular expenditure'. TSU also found that expenditure relating to 'international travel' by Kongwa 'can be deemed irregular expenditure'. Trade, Industry and Competition Minister Parks Tau responded to several written parliamentary questions by DA MP Toby Chance. As to whether 'disciplinary and criminal complaints' were being considered as a result of TSU's investigation, Tau said: 'Following receipt of the investigation report, the minister has appointed legal representation to advise him on the way forward. The minister is currently engaging with legal counsel on the course of action.' Kongwa was appointed joint administrator with Tumelo Baleni after the NGB's CEO resigned in April 2014. This came after the NGB was placed under administration and its board suspended by former minister Rob Davies following a forensic audit into maladministration and wasteful expenditure. All the board members resigned. The NGB has been without a board for 11 years. Baleni resigned in 2015. In response to another question from Chance, Tau said: 'The process of selecting members to serve on the National Gambling Board is under way and has not yet been concluded.' Tau's spokesperson, Kaamil Alli, did not reply to questions from GroundUp after an earlier undertaking to respond by last Friday. Kongwa's initial appointment as a joint administrator was extended several times. Despite some internal opposition, she was appointed chief strategic adviser in 2019, a position that did not previously exist. Kongwa was paid a total of R3.4-million in 2024 (including bonuses and perks). This was R800,000 more than she was paid in 2023. For context, in 2024, South Africa's deputy president was paid R3.16-million and ministers R2.68-million, excluding perks. Besides her 2024 salary of R2.5-million, other payments she received included a 13th cheque of R212,825 and a performance bonus of R510,781. In 2023, she was paid R2.6-million, including a R196,945 13th cheque and performance bonuses totalling R212,283. Kongwa's response Kongwa responded to GroundUp: 'I can confirm I tendered my resignation. The reasons for my resignation are personal and private and not for public consumption or publication in your story. 'The rest of the issues you raise are official matters and I employ you to directly engage and seek reply from both the DTIC [Department of Trade, Industry and Competition] and the NGB to verify if what your source has told you is the truth.' 'The DTIC and NGB should and are more than capable and accountable to answer for their own statements and deal with official Government business which they make public or report to Parliament. 'I unfortunately am not able to assist you any further. I hereby reserve my rights to sue if any misrepresentations are made in your publication.' Whistle-blowers A whistle-blower, who asked to remain anonymous because they feared punishment for speaking to the media, told GroundUp last year: 'I have submissions dating back to 2018 where some senior officials in the DTIC were raising reservations to some of the decisions by the then Minister [Davies], one of which was the creation of the position of a chief strategic adviser for a specific person, the current Accounting Authority [Kongwa].' Another whistle-blower, who also requested anonymity for fear of retribution, shared a letter sent to the DTIC in 2023 about the fact that Kongwa had been at the helm of the organisation ever since the dissolution of the board in 2014. The letter states: '[I]t appears that there is no interest or agility from the side of the DTIC to appoint a Board of Directors for the entity'. This had led to 'a serious gap in governance and has created a sense of authority and power by the person who has been the accounting authority [Kongwa]'. DM
