Zara Qairina case: Five minors to be charged with bullying, says AG
KUALA LUMPUR: Attorney General Tan Sri Mohd Dusuki Mokhtar says five teenagers will be charged in the Kota Kinabalu Juvenile Court on Wednesday (Aug 20) in connection with the bullying case of Form One student Zara Qairina Mahathir. "Yes, all of those to be charged are under the age of 18," he said on Monday (Aug 18). He said all the teenagers involved would be charged under Section 507C(1) of the Penal Code, relating to the offence of using or making any threatening, abusive, or insulting words or communication. Earlier, the Attorney General's Chambers (AGC) said in a statement that it had examined the investigation papers into Zara Qairina's death referred by the police and decided to charge several suspects involved based on the available evidence. "The decision to charge the suspects for the bullying offence was made as the charges will not interfere with the inquest proceedings that will take place," the statement said. The AGC stressed that the decision to charge the suspects for the bullying offence would not affect the ongoing investigation by the police, including the inquest proceedings to be conducted in court. During the question-and-answer session in the Dewan Rakyat on Monday, Home Minister Datuk Seri Saifuddin Nasution Ismail said the investigation into the death of Zara Qairina, which centred on three elements - bullying, neglect and sexual harassment - had been submitted to the AGC after police completed recording statements from 195 witnesses. Meanwhile, the Kota Kinabalu Coroner's Court today set Sept 3 to commence the inquest proceedings into Zara Qairina's death. Coroner Azreena Aziz also fixed Sept 4, Sept 8 to 12, Sept 17 to 19 and Sept 22 to 30 for the inquest hearings. On Aug 12, the AGC decided to hold an inquest to determine the cause and circumstances of the death of the student of Sekolah Menengah Kebangsaan Agama Tun Datu Mustapha after reviewing the investigation report submitted by the police on the case. Zara Qairina, 13, died at Queen Elizabeth I Hospital in Kota Kinabalu on July 17, after being found unconscious in a drain near the school dormitory on the morning of July 16 in Papar. – Bernama

S'porean gets 72 years, 24 strokes for murdering wife, stepson
Shahrul Nizam Zuraimy being led from the Melaka High Court. PETALING JAYA : A Singaporean man has been sentenced to 72 years in prison and 24 strokes of the rotan by the Melaka High Court for murdering his wife and stepson, whose dismembered remains were found in bushes six years ago. Justice Anselm Charles Fernandis ordered Shahrul Nizam Zuraimy, 36, to serve 36 years' in jail and 12 strokes of the rotan for each charge, with the sentences running consecutively from his arrest on Oct 11, 2019. He said Shahrul's actions were cruel, noting that he had placed his wife's severed head in the ceiling of their home in an apparent attempt to conceal the crime and the victims' identities. 'The court has considered the concept of life for life, as well as the emotions of the victims' family members. 'However, it must also look at the case as a whole and the wider public interest,' Bernama quoted him as saying. Anselm said he had taken into account the defence's submissions, the prosecution's points, and statements from the victims' family, who spoke of trauma, health issues and the surviving children's hardship without their mother. Shahrul was charged with killing his wife, Norfazera Bidin, 27, and her son, Iman Ashraf Abdullah, 11, at their home in Taman Merdeka Jaya, Batu Berendam, between 6pm on Oct 6 and 7.30am on Oct 7, 2019. The charges under Section 302 of the Penal Code carry the death penalty or a maximum of 40 years' jail, with whipping of at least 12 strokes if the death sentence is not imposed. Earlier, Norfazera's mother and sister urged the court to impose a commensurate sentence, including the death penalty, while deputy public prosecutors Asri Abd Rahman Sidik and Nur Syazwanie Marizan pressed for either the death sentence or consecutive prison terms. Asri and Syazwanie said the accused was supposed to protect the victims but killed them instead. The court must balance public interest with the severity of the cruelty committed, they contended. The prosecution also said that Shahrul initially misled the victims' family about their whereabouts and fled to Singapore before surrendering. Defence lawyers Andrew Lourdes and Chua Yong Yi pleaded for leniency, saying their client regretted his actions and deserved a second chance.

Several people linked to Zara Qairina's death to be charged
Zara Qairina Mahathir was found unconscious at 4am on July 16 after allegedly falling from the third floor of her school's hostel in Papar, Sabah. (Facebook pic) PETALING JAYA : Several suspects believed to have bullied Form 1 student Zara Qairina Mahathir, whose death sparked national outrage, will be charged in court, the Attorney-General's Chambers said. In a statement, the AGC said the decision to haul the suspects to court will not disrupt the inquest into the teenager's death, which is set to begin on Sept 3. The AGC also said the decision to prosecute the suspects for bullying will not affect the ongoing investigation by police into Zara's death. Attorney-General Dusuki Mokhtar said five suspects under the age of 18 will be charged at the Kota Kinabalu children's court on Wednesday, Utusan Malaysia reported. The AGC's decision to charge the suspects comes after home minister Saifuddin Nasution Ismail told the Dewan Rakyat today that the probe into Zara's death had revealed elements of bullying, neglect and sexual harassment. Saifuddin said these elements were uncovered after recording statements from 195 witnesses, including her hostel mates, adding that the signs of bullying were 'clear'. Zara was found unconscious at 4am on July 16 after allegedly falling from the third floor of her school's hostel in Papar, Sabah. She died at Queen Elizabeth I Hospital in Kota Kinabalu the following day. Her body was exhumed on Aug 9 to allow for a post-mortem amid allegations of bullying.
