Court upholds 10-year sentence, whipping for tahfiz warden's sexual assault on student

PUTRAJAYA: The Court of Appeal here today upheld a 10-year jail sentence and two strokes of the cane imposed on a warden of a tahfiz education centre who was convicted of two counts of physical sexual assault on a male student, five years ago.
A three-judge panel led by Datuk Azman Abdullah unanimously dismissed the appeal by Tengku Mohammad Khaireel Tengku Wahab, 32, against the conviction and sentence handed down by the Kuantan High Court on Oct 17, 2023.
In the judgment, he said, the court found that the testimony by the victim, who was then 11 years and six months old, was not a fabricated story, and this was supported by his complaint to a doctor at a health clinic who treated him.
"The victim cried when testifying at the Sessions Court. The accusation or complaint by the victim was against an ustaz (religious teacher) who taught him. It not only tarnished the name of the ustaz, but also had a personal impact on the victim," he said.
Azman, sitting with Datuk Noorin Badaruddin and Datuk Hayatul Akmal Abdul Aziz, said the court found the conviction handed down against Tengku Mohammad Khaireel to be correct and appropriate for both charges.
Regarding the sentence, he said that as the appellant should be the individual responsible for preventing such an incident, a sentence of 10 years in prison and one stroke of the cane for each charge was not excessive.
"This sentence should not only give fear to the appellant but also to the general public so that they do not repeat the same offence. With this, we unanimously dismiss the appeal by the appellant and the High Court's decision is upheld," he said.
On Dec 23, 2020, Tengku Mohammad Khaireel was charged with two counts of committing physical sexual assault on the boy in the warden's room of the school's dormitory.
He was charged under Section 14(a) and Section 14(b) of the Sexual Offences Against Children Act 2017 with committing the offence at 11.30 pm on Dec 1, 2020.
On Dec 20, 2022, the Kuantan Sessions Court sentenced him to eight years in prison and two strokes of the cane for each charge and ordered the prison sentences to be served concurrently.
Following a cross-appeal by the prosecution, the Kuantan High Court, on Dec 20, 2022, increased the prison sentence to 10 years on each count, to be served concurrently, and reduced the number of whippings to one stroke for each charge.
Earlier, Mohd Shuhairil Ziqrul Sapi, who represented Tengku Mohammad Khaireel, submitted that the High Court had erred in ruling the victim as a credible witness because the boy had given three different versions of the incident.
"The High Court erred in stating that the child's testimony was judiciously convincing and that the testimony should be scrutinised by the appeal panel carefully.
"The victim's testimony cannot be said to have reached the level of judiciously convincing because the prosecution did not call two other child witnesses who were sleeping on the top bunk of a double-decker bed in the same room," he said.
Deputy public prosecutor Aznee Salmie Ahmad, who appeared for the prosecution, said there was no basis to question the victim's credibility because the testimony given was consistent and was supported by the testimony of the doctor at the health clinic, the accompanying teacher and the recording officer in the case.
"The victim was also emotional and cried while giving evidence in court about an ustaz who was respected in the school community. It was not fabricated but stemmed from trauma.

KUALA LUMPUR: Toh Puan Na'imah Abdul Khalid is one step closer in her bid to refer eight questions to the Federal Court regarding the validity of the charges she is facing. Justice K. Muniandy, in his decision Thursday (Aug 21), said that Na'imah's case contained constitutional issues that requires the Federal Court's intervention. "In fact, there is a clear and compelling constitutional issue to be resolved by the apex court," he said. He said the questions raised were not frivolous or an abuse of court process, as the Sessions Court had suggested, but rather represented a genuine and important challenge to a piece of legislation. "The outcome of this case will have a profound impact on the rights of the individuals called as witnesses, including the applicant, in the Malaysian Anti-Corruption Commission (MACC) investigations and further define the limit of state power under the supreme law of the Federal Constitution," he said here on Thursday. The court then allowed Na'imah's revision application and ordered for the matter to be transmitted to the Sessions Court for the lower court to transmit it back to the High Court. On Jan 23, 2024, Na'imah was charged with failure to comply with a notice to declare her assets, which included Menara Ilham and several other properties in Kuala Lumpur and Penang. She was charged under Section 36(2) of the MACC Act 2009, which carries a maximum penalty of five years' imprisonment or a fine of RM100,000, upon conviction. On Feb 29, 2024, Na'imah filed an application to refer questions of law pertaining to Sections 30(5), 36(2) and 62 of the MACC Act 2009, as well as Section 32(3)(b) of the Anti-Money Laundering, Anti-Terrorism Financing and Proceeds of Unlawful Activities Act 2001 to the High Court. On Feb 18, the application was dismissed by the Sessions Court on grounds that it lacked merit, as there were no constitutional issues raised in the case. Na'imah then filed an application to the High Court to revise the Sessions Court's decision, which was decided Thursday. In an immediate statement to the press, Na'imah welcomed the court's decision. "This outcome is bigger than any individual case. It's about protecting fundamental liberties guaranteed under our Federal Constitution, including the right to silence, the right against self-incrimination and the right to a fair trial. "No one is above the Constitution and no one is beneath its protection," she said.

SIBU: The High Court here has ordered the accused in a drug trafficking case to enter his defence. Justice Wong Siong Tung said on Thursday (Aug 21) that the prosecution had adduced enough credible evidence to establish a prima facie case against Wong Kieng Li, 32. "The evidence shows that the accused had custody or control of the drugs, thereby triggering the presumption under Section 37(d) of the Dangerous Drugs Act 1952 that he was in possession of, and knew the nature of, the said drugs," he said in his ruling. "The evidence further established that he was trafficking in them at the material time," he added. Justice Wong gave the accused three options: testify under oath and be subject to cross-examination; give an unsworn statement from the dock; or remain silent. Defense counsel Darel Ling said the accused opted to give sworn evidence. He said the accused and his mother, among others, would be called to the witness stand. According to the charge sheet, the accused had trafficked 717.67g of methamphetamine in a car on Jalan Oya at about 5pm on Dec 12, 2023. The charge was framed under Section 39B(1)(a) of the Dangerous Drugs Act 1952, punishable under Section 39B(2) of the same Act. It carries the death penalty, or life imprisonment with no fewer than 12 strokes of the cane, upon conviction. The court then fixed Sept 25 and 26 to hear the defence case.

TAWAU: A 30-year-old Filipino labourer, Alisa Badan, was sentenced to 30 years in prison and 12 strokes of the cane by the High Court on Wednesday after being found guilty of trafficking 1,128.5 grammes of syabu. High Court Judge Datuk Duncan Sikodol handed down the sentence after ruling that the defence failed to raise reasonable doubt. Advertisement The court found that the drugs, discovered in a black bag at Hotel City Inn, Semporna, on May 14, 2023, were indeed in Alisa's possession. Alisa, a father of three who worked at the Semporna Jetty, was charged under Section 39B(1)(a) and punishable under Section 39B(2) of the Dangerous Drugs Act 1952, which allows for either the death penalty or life imprisonment with not less than 12 strokes of the cane if the death sentence is not imposed. In mitigation, defence counsel Jhesseny P. Kang pleaded for a custodial sentence instead of death, citing Alisa's first offence and his intention to reform. The court granted this under the revised sentencing provisions of the Abolition of Mandatory Death Penalty Act 2023. However, Deputy Public Prosecutor Nur Nisla Abd Latif urged for a stiff sentence, noting the increasing number of drug trafficking cases under Section 39B at the Tawau High Court. She argued that a harsh penalty would serve as an effective deterrent. The court ordered the sentence to take effect from May 14, 2023, the date of Alisa's arrest.
