Dani Alves: Former Barcelona defender acquitted of sexual assault, prison sentence overturned after appeal

An appeals court has acquitted former Barcelona and Brazil full-back Dani Alves of sexual assault and overturned a four-and-half-year prison sentence.
Alves, 41, was sentenced in February 2024 for an alleged sexual assault at a Barcelona nightclub in December 2022. He was released on bail in March 2024 while all sides awaited the outcome of all the appeals submitted against the initial ruling.

The High Court of Justice of Catalonia has allowed Alves' appeal after a panel of four judges deemed the initial conviction contained 'inaccuracies'.
The appeals panel consisted of judges Maria Angels Vivas, Roser Bach, Maria Jesus Manzano and Manuel Alvarez, who reasoned the initial ruling contained 'a series of gaps, inaccuracies, inconsistencies and contradictions regarding the facts, the legal assessment and its consequences'.
The court dismissed two appeals from the prosecution; the public prosecution's office had sought the partial annulment of the sentence and an increased sentence of nine years, and a private prosecution had sought an increased sentence of 12 years.
Alves had been released from prison in March after his defence deposited his €1million bail ($1.08m at current exchange rates). Bail had been set as a request from Alves' defence while all the sides waited on the appeals outcome.
As part of his bail conditions, Alves was not permitted to leave the country and had to surrender his Spanish and Brazilian passports to Spanish authorities.
Before being released on bail, he had spent the previous 14 months in the Brians 2 prison in Catalonia.
Alves was arrested by local police in January 2023 as part of an investigation into an alleged sexual assault at a nightclub in Barcelona.
The Spanish public prosecutor's office alleged that Alves sexually assaulted a 23-year-old woman at the Sutton nightclub. He repeatedly denied the charges against him.

Wide-man Raphinha was for his part involved in a heated sequence at Son Moix yesterday evening. En route to a 3-0 Barcelona victory, the Brazilian was responsible for a dangerous challenge late in the first-half. Mallorca's players were left incensed by as much, quickly calling for Raphinha to be given his marching orders. This anger spilled over beyond the half-time whistle, with the former Leeds United man having been confronted by a number of the hosts' players and staff members. As alluded to above, though, Raphinha had strong backup, in the form of teammate Jules Koundé. Rangers' horrendous start to their Champions League play-off against Club Brugge left them with a bruising 3-1 defeat at Ibrox and staring at the exit door. In a nightmare beginning to the first leg, Gers defender Nasser Djiga inexplicably allowed a long ball past him in the third minute and grateful visiting striker Romeo Vermant coolly lofted the ball over stranded goalkeeper Jack Butland. And further strikes from Jorne Spileers and Brandon Mechele had the visitors 3-0 up after just 20 minutes. Brazilian striker Danilo pulled a goal back four minutes after the break and the home side rallied, but the Belgian outfit stood firm. The return game against Nicky Hayen's men in Belgium next Wednesday will require a huge turnaround, albeit the Govan club are assured Europa League group phase football at least. Wins over Panathinaikos and Viktoria Plzen in previous qualifiers revealed flaws in Russell Martin's new-look Gers side and raised concerns in the stands, as did back-to-back draws to start the Premiership campaign. And once again the former Southampton boss incurred the ire of the Light Blue legions. Martin made 10 changes for Saturday's 4-2 Premier Sports Cup victory over Alloa and seven for the visit of the Belgian outfit. The news that elicited the most surprise was that 19-year-old England youth international Jayden Meghoma, who signed on loan from Brentford on Sunday, went straight in at left-back with Max Aarons preferred to experienced club captain James Tavernier at right-back. Jack Butland, John Souttar, Mohamed Diomande, Oliver Antman, Djeidi Gassama, and Nicolas Raskin all returned. Greece international Christos Tzolis, who scored for Greece against Scotland at Hampden Park in March and who has been linked with a move to Crystal Palace, started for the visitors, while former Liverpool keeper Simon Mignolet was in goal. All eyes were on Meghoma, who spent last season on loan at Preston, and he started positively. But a horror mistake by Djiga allowed Tzolis' pass to give Vermant an easy finish which stunned everyone inside the ground. The Gers fans were coming to terms with the needless loss of a goal when Tzolis' corner from the right was knocked past Butland by the unmarked Spileers from 12 yards. The boos that rang round the ground intensified when Mechele, making his 500th appearance for Brugge, stepped all too easily in front of Danilo just outside the Rangers box and gave Butland no chance with an arrowed right-footed drive. A three-goal deficit at the break left the Gers support in a state of shock but they got a lifeline when Danilo slid in to convert an enticing cross from Meghoma. Gassama's angled-drive skipped inches past the far post before Mohamed Diomande and Danilo were replaced by Hamza Igamane and Thelo Aasgaard. Gassama had the ball in the Brugge net in the 78th minute but French referee Francois Letexier was asked by VAR to check his pitchside monitor and quickly decided that Mignolet had the ball in his hand before it was bundled into the net. The Light Blues' second-half display was heartening but it was a chastening first 20 minutes which keeps the spotlight on Martin.

Dawn is breaking at Espanyol in Spain's La Liga. Fans of the Parakeets, a team less followed and with more grounded aims than local colossus Barcelona, hope it won't be a false one. Meanwhile, ex-defensive end J.J. Watt has a role to play. Now turning his attention towards being an NFL game analyst this coming season at CBS Sports, dissecting a game he knows inside out, Watt got a first taste of another new role—in soccer—last weekend. The 36-year-old looked on from the stands, fists pumping, as Espanyol fought back to beat Atlético Madrid in the surprise result from the opening matchday. The former Houston Texans player is a shareholder of Velocity Sports Limited (VSL), an investment branch of ALK Capital, which is led by U.S. managing partner Alan Pace. VSL acquired Espanyol from the Rastar Group, controlled by the Chinese businessman Chen Yensheng, for a reported €130 million ($152 million) in July (though Rastar retains some input). VSL also controls Premier League club Burnley. Much optimism surrounds Watt's arrival. El Mundo has gone as far as calling him Espanyol's new idol (Spanish). Much of that is down to the American ingratiating himself after saying a couple of phrases in Catalan, enjoying a beer with supporters outside the stadium, and getting behind the players inside it. Watt says he can't return there until February because of work commitments on Sundays, yet it's already a shift from the previous owners, who were rarely present and oversaw two relegations despite initially eyeing a place in the Champions League. Is The Future Bright For Espanyol? There's a peculiarity with ownership in soccer today. Many, even those who attend every fixture or know their side's history back to front, will understand that a foreign executive arriving on the scene doesn't. But if they stay involved, not least by investing in the squad, that's good enough. Very much the face of VSL in Espanyol right now, Watt has made a good impression. Then again, it's the honeymoon period, and at a club whose main target will still be avoiding demotion to the second division. How Espanyol does under U.S. guidance in the long term is what matters. It's worth noting that while Burnley and Espanyol are part of the same investment group, and therefore could be deemed part of the growing multi-club ownership model, the Spanish entity stressed that each will remain independent. Still, when interests are diversified, does Espanyol become the priority, or is that consolidating Burnley's place in the Premier League? Then, there's a cultural angle; Watt may have donned the blue and white scarf, but VSL is adapting to a different division in a different country, and everything that entails. U.S. Links To Spanish Soccer Are Tightening Of course, U.S. majority ownership in European soccer—Spain in this instance—is nothing new. Notably, top-tier Mallorca has former tennis player Andy Kohlberg at the top, while Leganés—relegated to the Segunda in 2024/25—is led by Blue Crow Sports CEO Jeff Luhnow. All the while, the Spanish soccer federation (RFEF) has approved controversial plans to host a first La Liga game on U.S. soil (Miami) this December. As the games and seasons progress, with Espanyol set on taking more scalps after the fast start against Atlético, it will become clearer whether the Catalans benefit from their end of the deal. At least the initial signs are promising.
