
Refusing To Implement Court Rulings in Kuwait? Now Penalties Increased
Under the new provisions, any competent public employee who intentionally fails to implement a judicial ruling within 90 days of official notification—via regular means or modern electronic communication—will face imprisonment for up to two years and a fine ranging from KD 3,000 to KD 20,000, or one of these penalties. This represents a significant increase from previous fines, which were deemed insufficient to deter violations.
If the employee abuses their official authority to obstruct execution of the ruling, the penalty increases to imprisonment for up to one year and a fine between KD 2,000 and KD 10,000, or one of these penalties. Courts are also granted discretionary power to order the dismissal of employees convicted under these provisions, allowing judges to tailor punishments to individual circumstances.
The draft clarifies that the Public Prosecution will have exclusive jurisdiction to investigate and prosecute such offenses, with criminal proceedings ending if the employee complies with the ruling at any stage. This measure is intended to encourage timely enforcement and uphold judicial finality.
The amendment follows observations that the prior 30-day compliance window was often insufficient for administrative procedures, prompting the extension to 90 days to provide a more realistic timeframe. Notifications may be delivered through traditional or electronic means consistent with the Civil and Commercial Procedures Law.
The explanatory memorandum underscores the importance of enforcing judicial rulings as fundamental to justice and the constitutional principle of separation of powers, as outlined in Article 50 of Kuwait's Constitution. It further notes that the amendment aligns with Amiri Order No. 4 of 2024, which mandates laws be enacted through decree-laws.
Article 2 of the draft stipulates that the Prime Minister and relevant ministers are responsible for implementing and publishing the decree in the Official Gazette, making it effective immediately upon publication.

Nod to clear debts of batch 2 Kuwaitis
KUWAIT CITY, Aug 4: Acting Undersecretary of the Ministry of Social Affairs and Chairman of the Debtors Committee Dr. Khaled Al-Ajmi has announced the approval to settle the debts of the second batch of citizens, whose debts range between KD5,000 and KD10,000. In a press statement Monday, Al- Ajmi stated that the total number of indebted citizens reached 767; stressing they met the conditions and criteria approved for the third national campaign. He said the Supreme Committee, in coordination with the participating entities, submitted the names of the beneficiaries to the Enforcement General Department at the Ministry of Justice, in preparation for completing the settlement procedures according to the legal and administrative procedures. He asserted that this is an advanced stage of the campaign, which is based on a humanitarian vision for alleviating the financial burdens of struggling groups. He confirmed that the technical and legal committees emanating from the Supreme Committee; which includes representatives from the Ministry of Interior, Ministry of Justice (Civil Execution Department), Ministry of Islamic Affairs, Zakat House, Secretariat General of Awqaf, and Ministry of Social Affairs; conducted a thorough review of the applicants' files and verified that they met the basic conditions. These conditions include that the beneficiary be a Kuwaiti citizen, that they have not benefited from previous campaigns in 2023 and 2024, that the debt is due for enforcement, and that they have an existing enforcement file with the Ministry of Justice. Al-Ajmi disclosed that the committee has started reviewing the files of the third batch of debtors -- whose debts do not exceed KD 15,000 -- in preparation for moving to new phases that cover all eligible cases according to available resources. He added that the total number of beneficiaries from the first and second batches reached 1,178 – a manifestation of the extent of the work accomplished and the institutional commitment to deliver aid to those who deserve it, in a manner that achieves social justice. He said the committee has been keen to facilitate communication with beneficiaries through the 'Sahel' application, which allows inquiries and monitoring of the status of applications with complete transparency. He explained that debtors whose debts have been approved for repayment will receive an official notification via the application indicating the completion of repayment. Kuwait MoI detains gang implicated in theft through cardless cash withdrawals
KUWAIT, Aug 4 (KUNA) -- The Ministry of Interior announced on Monday the arrest of a gang involved in stealing money from citizens and residents using a new and unique criminal method by exploiting the cardless withdrawal feature of ATMs. In a press statement, the Ministry said that intensive search and investigation efforts revealed the identity of the main suspect within less than 24 hours using biometric data. Detectives were able to locate and arrest him in Jleeb Al-Shuyoukh with an amount of money estimated at KD 5,000 (approx. USD 16,500), in addition to SIM cards, bank cards and receipts from exchange offices through which he intended to transfer money abroad. The statement added that further investigations revealed the existence of a cross-border gang as well as two other individuals working in a clothing company, the suspect was cooperating with. The company was exploited as a front with the aim of camouflaging and concealing the proceeds of the crime outside official financial channels. The Ministry of Interior explained that the accused were arrested in the Khaitan area and the tools used in the transfer process were seized, indicating that legal measures are being taken against them. The location of the international gang has been identified in an Asian country and coordination is underway with concerned authorities in this regard. It stressed the continuation of its efforts to use modern technologies such as biometric fingerprints to detect crimes and confront any criminal activity that threatens societal safety. (end)

Kuwait's Amir accepts resignation of finance minister, appoints Al-Mukhaizeem as acting minister
KUWAIT CITY, Aug 4: His Highness the Amir has issued an Amiri decree accepting the resignation of Noura Sulaiman Salem Al-Fassam, the Minister of Finance and Minister of State for Economic Affairs and Investment. The decree also appoints Dr. Sabeeh Al-Mukhaizeem, the Minister of Electricity, Water, and Renewable Energy, as Acting Minister of Finance and Minister of State for Investment Affairs. The Amiri decree, which was issued on Monday, comes after a review of the Constitution and relevant legal frameworks. It specifies that the resignation of Al-Fassam has been accepted following her formal submission. The decree also assigns His Highness the Prime Minister Sheikh Ahmad Abdullah Al-Ahmad Al-Sabah with the responsibility to implement the changes, which will take effect upon publication in the official gazette. The full text of the Amiri Decree reads as follows: 'Decree No. 149 of 2025: Accepting the resignation of the Minister of Finance and Minister of State for Economic Affairs and Investment, after reviewing the Constitution and the Amiri Order issued on 2 Dhu al-Qi'dah 1445 AH corresponding to May 10, 2024 AD, and Decree No. 73 of 2024 forming the Ministry and the decrees amending it, and the resignation submitted by Noura Sulaiman Salem Al-Fassam, Minister of Finance and Minister of State for Economic Affairs and Investment. Article Two: The Prime Minister is tasked with implementing this decree, which takes effect from the date of its issuance and shall be published in the Official Gazette.'
