Owaisi terms new Waqf law unconstitutional, seeks SC intervention

Describing the new Waqf law as "unconstitutional", AIMIM president Asaduddin Owaisi has alleged that it is aimed at "destroying" Waqf properties and expressed hope of getting justice from the Supreme Court in the matter.
In an interview with PTI Videos on Saturday, he also wondered how a uniform civil code (UCC) can be 'uniform' when there are several separate laws for different issues.
The Hyderabad MP challenged the BJP and those hailing the Waqf (Amendment) Act to point out which sections are good in the new law.
"Tell me in what way is it a progressive law? Tell me one provision by which Waqf property is saved. Tell me one provision by which there is an increase in Waqf's income and one provision by which encroachers are removed," Owaisi asked.
Owaisi, who was a member of Parliament's Joint Committee on the Waqf (Amendment) Bill, alleged that the new law was made to "destroy" Waqf.
"You removed the good provisions (from the previous law). Tell me which sections (are good in the new law)... neither the government nor those sitting in their support would be able to say," the All India Majlis-e-Ittehadul Muslimeen (AIMIM) chief said.
He further said the Dawoodi Bohras had wanted to be kept out of the purview of the Waqf law.
Owaisi, who has challenged the Waqf (Amendment) Act in the Supreme Court claiming that it violates the constitutional provisions, said, "We hope to get justice from the Supreme Court because this is an unconstitutional law."
His remarks come after the Supreme Court said last week that it would hear on May 20 the point of interim relief in the challenge to the Waqf (Amendment) Act, 2025.
A bench comprising Chief Justice of India B R Gavai and Justice Augustine George Masih would hear arguments for passing interim directions on three issues, including the power to denotify properties declared as Waqf by courts, Waqf by user or Waqf by deed.
The second issue raised by the petitioners relates to the composition of state Waqf boards and the Central Waqf Council.
The third issue relates to a provision that says a Waqf property will not be treated as a Waqf when the collector conducts an inquiry to ascertain if the property is government land.
On the UCC, Owaisi wondered how it can be called 'uniform' when there are several separate laws for different issues.
"How can it be uniform when you are excluding tribals, excluding Hindu Marriage Act and Hindu Succession Act? In our country, there is a Special Marriage Act and Indian Succession Act (ISA). Will you follow Mitakshara or Dayabhaga schools?" Owaisi asked.
Mitakshara and Dayabhaga are two schools of Hindu law that deal with inheritance laws.
The AIMIM chief said India's diversity needs to be understood, and added that "one's views cannot be imposed on others".

Thirumavalavan on Friday said the Waqf Amendment Act was passed in Parliament without 'political ethics or moral fear' by the BJP despite severe pushback from the Opposition ranks at every forum. Addressing a meeting organised by the All India Muslim Personal Law Board demanding the repeal of the amended legislation, Mr. Thirumavalavan alleged that the BJP had used the power of the government to target the Islamic community in the name of law and democracy over the last 11 years. 'Citizenship Amendment Act (CAA), abrogation of Article 370, Triple Talaq, and Waqf Amendment Act targets Muslims. BJP doesn't meddle with administration of religious properties of other faiths but meddles with ones owned by the Muslim community. It uses the law to do what should be illegal. It goes against democracy by using the very democracy. On the surface of it, these actions are about targeting and harassing Muslims. But, if you look closely, it is about dismantling of the Constitution,' he said. The VCK opposed the law in Parliament and in the Joint Committee, besides organising protests. 'Now, we are organising a protest to safeguard secularism in Tiruchi. It has become necessary to sharpen our politics. There is no disagreement that all this is a result of hate politics against Muslims, but their eventual target is to dismantle the Constitution because it protects secularism,' he said. Raja said Prime Minister Narendra Modi and Amit Shah contended in Parliament that the Muslims were misappropriating Waqf properties and government-owned properties were being claimed as Waqf properties as reasons for passing the Act. 'All amendments brought in earlier had a basis. Whenever there was a law related to Muslims in Parliament, there would be widespread discussions and consultations and only then would the law be introduced,. I would like to ask Amit Shah and Prime Minister is the basis for the Waqf law that has been passed? Can you show that?' he said. Manithaneya Makkal Katchi president M.H. Jawahirullah said, 'Muslims have not understood the importance of protecting the Waqf properties. When the CAA was introduced, there were protests across India. Specifically, women began protesting in Shaheen Bhags. The Muslim community should have undertaken even more vibrant protests in the Waqf issue.'

Madras high court CHENNAI: Madras high court on Friday ordered notices to the Tamil Nadu DGP and the Chennai commissioner of police on a suo motu plea initiated against former DMK minister K Ponmudy for his obscene speech against Shaivism, Vaishnavism and women. On April 23, Justice N Anand Venkatesh decided to initiate the suo motu plea since the Tamil Nadu police failed to register an FIR against the former minister. After the approval of the chief justice, the petition was numbered and listed before Justice P Velmurugan, who handles the portfolio of cases against MPs and MLAs. Mumbai: A revised diluted draft of the Maharashtra Special Public Security Bill 2024, which seeks to curb the rising influence of Naxalism in urban areas, is set to be tabled during the monsoon session of the state legislature in July. The bill, which was initially tabled in July 2024, was termed "repressive" and "anti-people" as it gave state govt sweeping powers to crack down on Naxal or leftist activities. In Dec 2024, a 26-member joint select committee, headed by BJP minister Chandrashekar Bawankule and comprising legislators from all political parties, was set up to review and scrutinise the bill. This panel has diluted the objectives and some of the provisions of the bill based on the 1,200-plus suggestions and objections received from citizens and social organisations. "There were some misunderstandings about the provisions of the bill, which we have cleared. The revised bill is now based on the consensus of all members of the joint select committee," said Bawankule. "Some changes have been made, like political parties or individuals will now not be booked under the proposed Act, but only those organisations linked to left-wing extremism or Naxalism will be probed. The revised bill will be tabled in the monsoon session of the state legislature. " The committee will meet again on June 25 to finalise the revisions, said officials. NCP (SP) MLA Jitendra Awhad, a member of the joint select committee, said the dilution of the bill was a victory for the opposition and the people of the state who objected to this draconian proposed law. "Now the bill is only related to unlawful activities by organisations involved in Naxalism, and not individuals. We had objected to the bill using the term 'urban Naxalism'. We also demanded that instead of 'left-wing extremism', only 'extremist or hardline activities' must be used," he said, claiming that the word 'urban Naxal' has been removed from the tweaked bill. Bawankule said changes were also made with regards to investigations. "Investigation will be done by an assistant commissioner of police in urban areas and a deputy superintendent of police in rural areas, instead of a police sub-inspector as mentioned in the initial draft," he said. "Also, the advisory board, which will give a go-ahead for the probe, will be headed by a retired high court judge and include a district judge and a govt pleader.
