Lucknow Bench of Allahabad HC seeks locus standi of petitioners on plea against ban on Bahraich Urs

LUCKNOW: The Lucknow Bench of the Allahabad High Court asked the locus standi (right to sue) of the petitioners to file the plea challenging the order of the local administration restraining the mela committee from organising the annual urs at the Dargah of Syed Salar Masood Ghazi in Bahraich.
The division bench, comprising Justice AR Masoodi and Justice AK Srivastava (I) granted time to the petitioners by posting the matter on May 19 as the next date of hearing.
A bench of passed the order on the writ petition filed by Waqf No. 19, Dargah Sharif, Bahraich.
Taking up the petition, the Bench asked the petitioners to prove their right to sue in the present case and said it would hear the plea only on merit.
Appearing on behalf of petitioners, advocate LP Mishra said that if Kumbh could be organised, why 'urs' was not being allowed by the authorities concerned.
Mishra called it a discrimination based on religion by the state authorities in violation of the right to profess religion under Article 25 of the Constitution of India.

Cash At Home Row: The Union government is likely to bring in Parliament an impeachment motion against Justice Yashwant Varma of Allahabad High Court, who was indicted by a Supreme Court-appointed probe panel after the discovery of a huge amount of burnt cash from his official residence in the national capital. Government sources told CNN-News18 that Parliamentary Affairs Minister Kiren Rijiju has begun speaking with all the opposition parties, to take them all in confidence ahead of initiating any action against Justice Varma. What's The Option? According to the officials as quoted by news agency PTI, resignation is the only option before him to avoid removal by the parliament. Officials aware of the procedure to appoint and remove Supreme Court and high court judges pointed out that while defending his case before lawmakers in any of the House, Justice Varma can announce that he is quitting and his verbal statement will be considered as his resignation. Should he decide to resign, he will get pension and other benefits entitled to a retired HC judge. But if he is removed by Parliament, he will be deprived of pension and other benefits. How Can A Judge Resign? According to Article 217 of the Constitution, a High Court judge 'may, by writing under his hand addressed to the President, resign his office." A judge's resignation does not require any approval. A simple resignation letter is sufficient. What Is Impeachment? If pursued, this motion will initiate a rare and highly structured removal process under the Constitution of India and the Judges Inquiry Act. According to Article 217, read with Article 124(4), a high court judge can be removed only by the President after both Houses of Parliament pass a motion with a special majority on grounds of proven misbehaviour or incapacity. The Judges Inquiry Act mandates that the process begin with a notice of motion signed by 100 MPs in the Lok Sabha or 50 MPs in the Rajya Sabha. If the Speaker or Chairman admits the motion, a three-member committee — comprising an SC judge, HC Chief Justice, and a distinguished jurist — is formed to probe the charges. The judge has the right to a fair hearing, including responding to charges and cross-examining witnesses. If the committee finds the judge guilty, the matter is returned to Parliament for a final vote. Justice Varma's removal proceedings will be taken up in the upcoming Monsoon session of Parliament. This will be the first ever impeachment proceeding to be taken up in the new Parliament building. Supreme Court judge V Ramaswami and Calcutta High Court judge Soumitra Sen had earlier faced impeachment proceedings but they resigned. What's The Row? Justice Varma is facing allegations of corruption after the cash discovery in March, when he was a judge at the Delhi High Court. However, he has claimed ignorance about the cash. After the controversy, Justice Varma was transferred to the Allahabad High Court, his parent High Court. After the cash discovery incident, the Supreme Court had set up a three-member committee of Justice Sheel Nagu, Chief Justice of the High Court of Punjab and Haryana, Justice GS Sandhawalia, Chief Justice of the High Court of Himachal Pradesh and Justice Anu Sivaraman, Judge of the High Court of Karnataka, to look into the allegations against Justice Varma. While the preliminary report of the Delhi High Court Chief Justice and the response of Justice Varma, along with the photos and videos taken by the Delhi Police, were publicised by uploading them on the Supreme Court's website, the final iquiry report, submitted to the Chief Justice of India on May 4, has not been officially disclosed yet. Then Chief Justice of India Sanjiv Khanna had written to the president and the prime minister to remove Justice Varma, mired in the cash discovery row. Justice Khanna had prodded Varma to resign but he had refused, sources had earlier said. Maharashtra Congress president Harshwardhan Sapkal Sunday said Chief Minister Devendra Fadnavis's counter to Rahul Gandhi's claims of 'matchfixing' in the 2024 Maharashtra elections was 'superficial' and 'laughable'. He also demanded a narco test on Chief Electoral Officer S Chockalingam and then-additional CEO Kiran Kulkarni. In an opinion piece for The Indian Express Saturday, Gandhi, Leader of the Opposition in Lok Sabha, said the total electors in Maharashtra had increased more between the 2024 Lok Sabha and Assembly elections than between the 2019 and 2024 Assembly polls. He alleged that most of the additional electors were in 85 constituencies where the BJP had not done well in the Lok Sabha polls. In the 2024 Maharashtra Assembly elections, the BJP-led Mahayuti coalition, which includes the Eknath Shinde-led Shiv Sena and the Ajit Pawar-led NCP, secured a total of 235 seats. The BJP alone won 132 seats for its best performance in the state. In contrast, the opposition coalition, Maha Vikas Aghadi, composed of the Congress, Shiv Sena (UBT), and NCP (SP), was only able to win 46 seats. Replying to Gandhi, Fadnavis, in another opinion piece for The Indian Express, said the Congress leader was rejecting the people's mandate after they rejected him and his party. Sapkal said, 'Leader of Opposition (in Lok Sabha) Rahul Gandhi has raised some critical questions on the electoral process of the Maharashtra Legislative Assembly. However, instead of the Election Commission responding, it is the BJP and CM Devendra Fadnavis who have jumped in with a counter-article. His reply, however, is laughable and an evasive attempt to distract the public,' said Sapkal. Sapkal slammed Fadnavis, saying he should stop acting like a 'judicial icon'. 'His responses are weak, superficial, and fail to address the actual questions,' said Sapkal, adding that Fadnavis is a 'compulsive liar'. On Chockalingam and Kulkarni, Sapkal said, 'These officers were at the helm when voter scam took place in Maharashtra Assembly elections. To expose the truth behind the alleged vote theft in Maharashtra, these officers must be subjected to a narco test.' 'Every issue Rahul Gandhi has raised over the years has proven to be correct with time. He warned of the China threat, and now the dragon is encroaching on India. He warned that demonetisation would devastate the economy and lower GDP, and it did. He alerted the nation to the dangers of Covid-19 when the BJP government ignored it, and the country paid a heavy price,' said Sapkal. 'Today, questions are being raised over the transparency and integrity of the Election Commission's conduct. These are questions of democratic survival, and it is the Commission's duty to answer them. Instead, it remains silent, denies CCTV footage, and quietly changes the rules,' Sapkal added. On the EC's criticism that Gandhi was going to the media, Sapkal said, 'Does the Election Commission deny that the media is the fourth pillar of democracy? The questions raised by the Congress and Rahul Gandhi deserve factual, objective responses from the Commission.' According to officials cited by news agency PTI, resignation remains his only option to avoid a Parliamentary motion for removal, which, if passed, would strip him of pension and retirement benefits. Justice Varma came under scrutiny after a fire at his Delhi residence in March led to the discovery of several burnt sacks of unaccounted cash in the outhouse. Though he denied knowledge of the money, a Supreme Court-appointed in-house panel, led by then Chief Justice of India Sanjiv Khanna, found him culpable after recording witness statements and Varma's own deposition. Based on this report, Justice Khanna urged the President and Prime Minister to initiate his removal, PTI reported. As per Article 217 of the Constitution, a High Court judge may resign by writing to the President. The resignation becomes valid without requiring formal acceptance. If a judge resigns, they retain post-retirement entitlements. However, if removed by Parliament, they lose all such benefits. In Parliament, a motion for removal must be supported by at least 50 Rajya Sabha or 100 Lok Sabha members. 'It cannot be brushed aside,' Rijiju was quoted as saying by PTI, adding that reconciling the existing report with the statutory inquiry process will be a matter for the Speaker or Chairman to decide. Vice-President Jagdeep Dhankhar, while meeting members of the Punjab and Haryana High Court Bar Association, expressed dismay over the lack of a criminal investigation into the matter. 'A very painful incident happened... There was a cash haul, obviously tainted, unaccounted and illegal,' he said. Dhankhar criticised the judiciary's internal mechanism for shielding its members from FIRs, saying, 'Unless permission is accorded by a functionary at the highest level in the judiciary, an FIR can't be registered.' Justice Varma has since been transferred to the Allahabad High Court, where he has not been allotted any judicial duties. Rijiju has begun consultations with political parties to build consensus on the motion, which could be the first impeachment to be taken up in the new Parliament building. The Monsoon session of Parliament is scheduled from July 21 to August 12.
