HC refuses to grant permission to Jeth Mela at Bahraich dargah
Lucknow: The Lucknow bench of the Allahabad high court on Saturday refused to grant permission to organise the annual Jeth Mela ('urs') at Dargah Sharif in Bahraich. The court, however, said that routine activities and other rituals at the dargah would continue. The court passed an interim order while reserving the detailed judgment which will be pronounced later. A division bench of justice AR Masoodi and justice Subhash Vidyarthi passed the order on the petition filed by Waqf No. 19, Dargah Sharif, and two other petitioners. The petitioners had demanded that the court set aside the order of the local administration whereby it restrained the Dargah Sharif Management Committee from organising Jeth Mela. The bench heard the petitioners on Saturday after the Chief Justice of the Allahabad high court constituted a special bench to hear the matter on a holiday. After prolonged hearing, the bench, in its interim order, directed the local administration to maintain law and order, providing necessary civic amenities in association with the committee administering the management of dargah. Lucknow Bench of Allahabad HC seeks locus standi of petitioners on plea against ban on Bahraich Urs
LUCKNOW: The Lucknow Bench of the Allahabad High Court asked the locus standi (right to sue) of the petitioners to file the plea challenging the order of the local administration restraining the mela committee from organising the annual urs at the Dargah of Syed Salar Masood Ghazi in Bahraich. The division bench, comprising Justice AR Masoodi and Justice AK Srivastava (I) granted time to the petitioners by posting the matter on May 19 as the next date of hearing. A bench of passed the order on the writ petition filed by Waqf No. 19, Dargah Sharif, Bahraich. Taking up the petition, the Bench asked the petitioners to prove their right to sue in the present case and said it would hear the plea only on merit. Appearing on behalf of petitioners, advocate LP Mishra said that if Kumbh could be organised, why 'urs' was not being allowed by the authorities concerned. Mishra called it a discrimination based on religion by the state authorities in violation of the right to profess religion under Article 25 of the Constitution of India.

HC questions locus standi of petitioners on plea against ban on Bahraich urs
Lucknow: The Lucknow bench of the Allahabad high court on Friday asked the locus standi (right to sue) of the petitioners to file the plea challenging the order of local administration restraining the mela committee from organizing annual urs on the dargah of Syed Salar Masood Ghazi in Bahraich. Granting time to petitioners, the bench fixed May 19 as the next date of hearing. A bench of justice AR Masoodi and justice AK Srivastava (I) passed the order on the writ petition filed by Waqf No. 19 , Dargah Sharif, Bahraich. The bench asked the petitioners to prove their right to sue in the present case and only then would it hear the plea on merit. Appearing on behalf of petitioners, advocate LP Mishra said that if Kumbh could be organized, why 'urs' was not being allowed. He claimed that the govt was discriminating on the basis of religion and it was the violation of right to profess religion under Article 25 of the Constitution of India. The bench, however, said that it was the right of the court to be satisfied if the petition was maintainable or not. "Without being satisfied on this aspect, we will not proceed further," the bench said. Mishra requested the court to fix Saturday for the next hearing and assured that he would place the necessary documents before the court. However, the bench refused to fix Saturday as it was a holiday. The court asked Mishra to move proper application before the chief justice in this regard as only he could constitute a special bench on holidays.

HC seeks govt's reply on plea against ban on annual urs in Bahraich
Lucknow: The Lucknow bench of the Allahabad high court on Wednesday asked the state govt to respond to the plea seeking direction to the district administration to allow the annual urs at the Dargah of Syed Salar Masood Ghazi in Bahraich. Tired of too many ads? go ad free now The writ petition filed on behalf of Waqf No. 19 Dargah Sharif, Bahraich, challenged the order of the district magistrate that disallowed the holding of the urs this year. The urs was scheduled to start on May 15. The bench comprising Justice Rajan Roy and Justice OP Shukla fixed May 14 as the next date of hearing. Appearing on behalf of the petitioner Dargah Sharif , advocate LP Mishra argued that the dargah was established in 1375 AD by Firoz Shah Tughlaq in memory of Syed Salar Masood Ghazi. "Month-long urs is held every year which is attended by 4-5 lakh people from India and abroad. The district magistrate has no right to stop the urs as according to an order issued on April 1, 1987, the administration itself is duty-bound to arrange for the urs," he said. Opposing the petition, the govt counsel said that the urs was held within a radius of about five km and the order given by the district magistrate was based on the report of local intelligence unit and other departments. It was said that there was no ban on holding of urs within the dargah. When advocate Mishra told the court that the area of 1.5 square kilometres around the dargah belongs to the shrine itself, the court asked him for relevant documents. At this, Mishra sought time to present the documents. The court granted time and fixed May 14 as the next date of hearing.
