
Heir of Barne Estate 'shocked' by €50K brown envelope 'luck penny' offer from John Magnier

Mr Magnier wants the court to enforce the deal he claims he sealed with Mr Thomson-Moore in an alleged handshake agreement for the 751-acre farm on August 22nd, 2023, at Mr Magnier's Coolmore home.
The Magnier side has sued the Barne Estate, Mr Thomson-Moore and three companies of IQEQ (Jersey) Ltd group, seeking to enforce the purported deal, which they say had been "unequivocally" agreed.
The Barne defendants say there was never any such agreement, as they needed the consent of the trustees to finalise any agreement, and subsequently they preferred to sell the estate to Mr Regan.
Mr Thomson-Moore has told the court that while a "price" was agreed with Mr Magnier for Barne, a "deal" was not.

After agreeing on €15 million, Barne and the Magniers entered into an exclusivity agreement stipulating that the estate would not permit itself or its representatives to solicit or encourage any expression of interest, inquiry or offer on the property from anyone other than Mr Magnier between August 31st to September 30th 2023.
However, during September 2023, billionaire Maurice Regan offered around €20 million.
The trustees, who hold the estate, decided to remain loyal to the Magnier offer and felt the higher offer of Mr Regan could be seen as a "provocative" one.
The court has heard that on September 7th 2023 - two weeks after Mr Magnier claims he shook hands with Mr Thomson-Moore on the deal for the Barne Estate - Mr Magnier called to Barne with his son, JP.

The Thomson-Moores have told the court their estate agent, John Stokes, who had walked out with the Magniers, returned to the house with two brown envelopes given to him by JP containing a total of €50,000 in cash - €25,000 in each.
Mr Thomson-Moore told the court that he did not interrogate Mr Stokes about the purpose of the envelopes and that Mr Stokes explained their offering as a "luck penny".
The Magnier side have told the court that the money was a token of "appreciation" to the Thomson-Moores for letting the Magnier side onto the land before any sale was finalised.
The Magnier side were ultimately gazumped by US-based construction magnate Mr Regan, who offered a final €22.25 million and was made the preferred bidder.

Mr Regan is not a party to the case.
At the High Court today, Mr Thomson-Moore said the delivery of the money to their Barne home caused him "shock" and he said he felt the offer of "envelopes stuffed with cash" was "untoward". The money was later returned by the Thomson-Moores.
Mr Thomson-Moore told defence barrister Niall Buckley SC that a guide price of €13.5 million had been advertised by the selling agents, which he thought was underpriced, and believed the property to be worth between €17.5 million-€20 million based on a comparator property in Kildare.
Mr Thomson-Moore said that Mr Magnier's retort to this valuation was "slightly hostile" before an offer of €15 million was accepted by the Thomson-Moores at the Coolmore kitchen meeting.

Caren Geoghegan SC, for the Magniers, asked Mr Thomson-Moore about lists drawn up detailing the contents of the Barne mansion and asked why there were two lists - one "complete" list with a separate incomplete list going to the trustees of the estate.
Mr Thomson-Moore said that after the Magnier offer, he was in talks organising an auction of the contents of Barne with Mealy's auction house.
Ms Geoghegan put it to Mr Thomson-Moore that his intention at this time was to give one list to the trustees that did not disclose all the items in the house.
She put it to him that his intent was to not disclose "high-value items" to the trustees of the estate, which he denied.
"There is no ambiguity about the intention," said Ms Geoghegan, "a complete list and then a separate list for trustees."
Mr Thomson-Moore said "it didn't happen" but added: "that is what it looks like, though, yes".
The case continues before Mr Justice Max Barrett.

Chemours, DuPont and Corteva have agreed to pay $875m over 25 years to the state of New Jersey to settle environmental claims including pollution linked to Pfas, or forever chemicals, the companies said on Monday. Lawsuits accusing major chemical companies of polluting US drinking water with toxic Pfas chemicals led to over $11bn in settlements in 2023, with experts predicting that new federal regulations and a growing awareness of the breadth of the contamination will spur more litigation and settlements. Pfas are a class of chemicals that are used in a wide range of products including non-stick cookware and firefighting foams. They are commonly called 'forever chemicals' as these substances do not break down easily in the human body or nature, and are associated with certain cancers, hormonal dysfunction and other diseases. The payments announced on Monday, whose present value is about $500m before taxes, will start no earlier than 1 January 2026. Chemours will make half of the settlement payments, while DuPont will pay 35.5% and Corteva the rest, the companies said in a statement. In 2023, the three firms reached a settlement agreement with the US state of Ohio for $110m to resolve claims associated with Pfas. That same year, 3M agreed to pay $10.3bn to settle hundreds of claims that the company polluted public drinking water with the chemicals, while Chemours, DuPont and Corteva reached a similar deal with US water providers for $1.19bn. Of the total settlement announced on Monday, $16.5m is attributed to alleged Pfas contamination unrelated to the companies' operating sites.

Primark to launch UK app as it rolls out much-awaited features – but there's a catch
PRIMARK is set to launch an app in the UK for the first time - but there's a catch. The fashion retailer is rolling out a new bespoke app across England, Wales, Scotland and Northern Ireland - within 18 months. 3 3 Primark is yet to reveal any other details about the mystery tech update that has already launched in Italy and Ireland today. In those two countries, the app lets shoppers browse products, check in-store stock availability and save items so they can go back and buy them later on. Customers can also use a store locator tool to find their nearest branch and change their settings to receive notifications when new collections and items come in. Customers can download the app for free onto their smartphone via the Apple App Store or Google Play Store by searching for "Primark" or "Penneys". Primark said the launch of the app in Italy and Ireland will let it "test and learn how customers" interact with it. This will "inform further development ahead of future launches", including the UK. Matt Houston, chief customer and digital officer, said: "We know our customers increasingly start their shopping journey online, whether that's checking what's new or planning a visit, and the app gives them the tools to do that in a more intuitive, personalised way." The launch of the app comes after Primark rolled out new websites in 17 countries over the last three years including one in the UK in 2022. Meanwhile, Primark sparked shopper fury among some customers in May by introducing a charge for its paper bags. Since May 12, shoppers now have to pay 15p for paper bags, regardless of size - small, medium, or large. Explaining the decision, the retailer said: 'We've introduced a small fee for single-use paper bags. "Have a reusable bag? Bring it with you next time you shop! "Why the change? Domino's profits fall as people order fewer takeaways
Domino 's Pizza Group has warned it will miss its annual profit targets after opening fewer new stores than anticipated, citing cautious franchisees and a downturn in consumer confidence. The pizza delivery business saw its shares plunge in early trading following the announcement. The fast-food giant attributed the slowdown in expansion to its franchisees adopting a "cautious" approach, primarily driven by increased labour costs stemming from the government 's recent budget. This, coupled with what the company described as "weaker" sentiment among its customer base, has led to the revised profit outlook. Domino 's joins a growing list of high street hospitality businesses, including Greggs, that have recently flagged "tougher" market conditions and mounting pressure on customer demand. The pizza chain, which operates 1,381 outlets across the UK and Ireland, confirmed on Tuesday that its sales growth has been directly impacted by "weak" consumer confidence over recent months. Andrew Rennie, chief executive of Domino's, said: 'There's no getting away from the fact that the market has become tougher both for us and our franchisees, and that's meant that the positive performance across the first four months didn't continue into May and June. 'Given weaker consumer confidence, increased employment costs and uncertainty ahead of the autumn statement, franchisees are taking a more cautious approach to store openings for the time being.' It said this has caused a 'short-term slowdown' in new stores but stressed that it expects this to pick up again next year. Domino's has opened 11 new stores so far this year and expects overall openings in the 'mid-20s' this financial year. The company had previously said it expected to open 'in excess of 50 new stores' this year. It came as the group also warned that profits would miss previous guidance due to weaker trading. Domino's told shareholders that it expects to deliver earnings between £130 million and £140 million for the year. It had previously said it was due to meet market expectations of between £140.8 million and £149.7 million. It came as the business revealed that system sales grew 1.3 per cent to £777.8 million for the 26 weeks to June 29. Like-for-like sales were 0.1 per cent lower for the half-year, as a positive first quarter was offset by a 0.7 per cent decline in the second quarter, when delivery orders 'weakened'. The group added that 'softer' trading improved towards the end of July. Mr Rennie stressed that 'weakness' in consumer sentiment has weighed on the whole sector, highlighting that the firm has continued to grow market share despite recent pressure. He also highlighted that franchisees are keen for certainty over the Government's next budget as they assess investment plans for the year ahead. He told the PA news agency: 'Our franchisees are mainly concerned about uncertainty ahead of the upcoming budget. 'We want to see stability so that we, and our franchisees, can be confident in our investment plans. 'We don't want to see an increase in the quantum of costs on small businesses because you have to make these sustainable to support any growth agenda.'
