The Supreme Court on Tuesday (August 12, 2025) said 'mistakes' might have happened while preparing the draft Bihar electoral roll and pointed to the Election Commission of India's (ECI) willingness to correct those even as petitioners reminded the court of its promise to 'step in' if the Special Intensive Revision (SIR) led to 'mass exclusion'.
Appearing before a Bench of Justices Surya Kant and Joymalya Bagchi on the first day of hearing in the challenge to the SIR, senior advocate Gopal Sankaranaryanan said, 'My Lords promised you would step in if there was a mass exclusion. This has happened. Sixty-five lakh people have been excluded from the draft electoral roll published on August 1.'
Senior advocate Rakesh Dwivedi, appearing for the poll body, said errors were bound to occur 'here and there'. 'This is a draft roll. It can be corrected by the Booth Level Officers,' he said.
Senior advocate Kapil Sibal, who led the petitioners' side, said, 'In a small constituency, 12 people left out as dead were found alive'.
While Mr. Dwivedi said the petitioners were more keen to be an 'obstruction' and indulge in speculation, Justice Kant asked Mr. Sibal whether the petitioners wanted a 'roving inquiry', and at whose behest. 'If there are people genuinely aggrieved, please give a list of their names to us. We will take action,' Justice Kant addressed Mr. Sibal.
Mr. Sibal said a larger part of the population of Bihar was poor and would have none of the documents sought by the ECI for verification of citizenship in order to be included in the electoral roll.
Senior advocate A.M. Singhvi, also for the petitioners, submitted that many records would have been lost due to floods, migration or other reasons. Most of the population of Bihar does not have their documents in a digital form, he said.
'Determination of citizenship is not the role of ECI. If crores of people in Bihar are already on the electoral roll, the poll body cannot ask them to produce documents to prove their citizenship again. This amounts to presumptive exclusion,' Mr. Singhvi argued.
Mr. Sibal submitted that only 3.05% of people in Bihar had birth certificates, one of the 11 'indicative' documents required by the ECI.
But Justice Kant dismissed the submission, saying, 'Bihar is a part of India. If people in Bihar do not have these documents, other States would also not have… These are documents which show a person is a bona fide resident of a State. Once you show the documents, the burden will shift on the ECI,' Justice Kant observed. The judge urged Mr. Sibal not to make 'sweeping statements'.
Justice Kant further said 87% of Bihar had Aadhaar and Electors' Photo Identity Cards. They could be used as proof, though not conclusive, of citizenship. The court said those who were part of the Bihar electoral roll in 2003, when the previous intensive revision happened, need not produce documents to be included in the current draft roll.
'On a conservative estimate, 6.5 crore electors need not produce any documents as they are already in the 2003 electoral roll,' Mr. Dwivedi said.
But Justice Kant did ask about the need for an SIR now when a summary revision of the Bihar electoral roll had happened in January 2025.
Activist Yogendra Yadav, who appeared in person, said SIRs across the world have been found to be counter-productive. He said whenever the onus to be included in the electoral roll shifts from the state to the citizens, a quarter of the population, mostly the marginal and the poor, tend to get excluded.
Mr. Yadav said the current SIR and the 2003 intensive revision of the Bihar voters' list could not be compared. The latter happened at a time when computers were introduced in the election process.
'Records were being computerised. Printouts were given out to officers who were asked to go from house to house to verify. The requirement to fill up enumeration forms and this presumption of exclusion now are unique... The Bihar SIR may be the largest disenfranchisement not only in the history of India, but of the world, in any democracy. This is not an issue of revision, but a tectonic shift in the burden to the voters,' he said.
Advocate Prashant Bhushan submitted that the poll panel has the exact number of persons deleted from the draft roll and the reasons – death, traceability, duplication and permanent shift in the State – for their exclusion. However, it is not sharing the details. Many enumeration forms of deleted persons showed 'BLOs have not recommended' their names in the voters' list without giving any further reason, he said.

Two members of a Supreme Court-appointed panel on Wednesday warned of Dharali-like consequences if the much-hyped Chardham all-weather road widening project in Uttarakhand is pursued in its current form. They also described the Dharali disaster as a fallout of state authorities ignoring repeated scientific warnings against unregulated construction and tourism activities in the fragile Himalayas. In a letter written on Tuesday to the road transport and highways ministry, senior geologist Navin Juyal and environmentalist Hemant Dhyani said the uniform 10 m widening of the Chardham all-weather road on the valley side slopes both in lesser and higher Himalayas has created multiple new chronic zones along the widened roads. They advocated adopting an alternate DPR submitted by them to the ministry nearly two years ago detailing a flexible and disaster-resilient road widening design that could be followed in the Bhagirathi Eco Sensitive Zone (BESZ) which will ensure minimum tree felling and tampering with the slopes. It will definitely minimise the damages caused due to road widening in the Himalayas, they said. BESZ covering an area of 4179.59 sq km is a notified are from Gomukh to Uttarkashi of which Dharali is a part and through which portions of the ambitious Chardham road project passes. Both Juyal and Dhyani were part of the Supreme Court-appointed expert committee on Chardham all-weather road. Juyal has left the panel but Dhyani continues to be a part of it. Citing the sensitivity of Higher Himalaya towards extreme weather events like landslide lake outburst floods, the experts recommended adopting a sustainable and flexible approach in the road widening project in BESZ. 'We have been warning and protesting continuously for an alternative sustainable approach to ensure a disaster-resilient highway. But so far authorities have not given any consideration to our appeal,' Juyal and Dhyani said in the letter. The letter said these recommendations cover the road stretches that were devastated by the flash flood in Kheer Ganga on August 5. 'We recommended that proposed Netala bypass (near Uttarkashi) should be dropped as it is proposed through pristine forest grown on old landslide deposits which is incised by rainfed streams. If the road is dug through these deposits , it is likely to suffer from slope instability and subsidence because the road would also have to negotiate multiple streams,' the duo said in the letter. At least 6000 trees are marked to be felled for the construction of a 10-km stretch of road under the proposed road widening project between Jhala (below Sukhi Top) and Jangla (near Bairon Ghati)… If that happens, it would certainly destabilise the avalanche debris and could make the 10 km road stretch extremely unstable, the experts said. In the alternative plan submitted to the ministry, they have identified locations where the road can be constructed towards the river flank using the technique of elevated corridor. High elevation bridges have been proposed in the stream segments so that the boulders that are usually transported during the ice-rock avalanches can be bypassed. 'These bridges were proposed opposite Harshil where we lost our jawans and Dharali where the human loss is yet to be estimated,'the letter said. On the Dharali flash floods, the experts said there has been an explosion in tourist influx in the upper Ganga catchment in recent years and to meet the requirements, widespread proliferation of new construction took place defying all the rules. 'Dharali falls in the Bhagirathi Eco-sensitive Zone. The catastrophe there is a result of authorities ignoring repeated scientific warnings about the vulnerability of such fragile Himalayan locations and violation of legal provisions made under the BESZ notification which ban construction and development activities on slopes in proximity to rivers and streams,' Dhyani told PTI. A devastating flash flood in the Kheer Ganga river demolished almost half of Dharali village on way to Gangotri on August 5 razing hotels and homestays and leaving more than 60 people missing. In Dharali, the state authorities not only violated the provisions of the BESZ notification but also Namami Gange notification which prohibits construction of both permanent and temporary nature in the flood plain areas of the Ganga or its tributaries, Dhyanai said. The Kheer Ganga, which originates from a cirque glacier, traverses around 7 km before it meets the Bhagirathi River near Kalp Kedar temple which was also buried in the debris in Dharali. Even after the Kedarnath disaster, people were not discouraged to vacate the stream proximal locations, instead, an RCC wall was constructed to prevent flood debris from entering the settlement. This encouraged people to build the resorts and hotels next to the stream.

The Opposition members on Wednesday has drawn the attention of the State government on the increased number of dog-bite cases in Bengaluru city and demanded immediate action to relocate all stray dogs. Raising the issue during Zero Hour in the Legislative Assembly, Suresh Babu (JD-S) Umanath Kotian, S. Suresh Kumar, and C.N. Ashwath Narayan (all BJP) have expressed concern over the rise in the number of dog-bite cases in the State. Mr. Suresh Kumar said over 18,000 dog-bite cases and 18 suspected human rabies deaths were reported in Bengaluru city in the last six months. Threat to public health They demanded that the government implement the Supreme Court order on August 11 on controlling stray dogs in public places in New Delhi. They warned that the stray dog menace has been a threat to public health in the city. The SC order should be applicable in Bengaluru, Mangaluru, Mysuru, and other cities, Mr. Suresh Kumar said. Noting the incident of a stray dog biting two students of Dr. B.R. Ambedkar School of Economics University (BASE) in west Bengaluru, he urged the government to implement the Supreme Court guidelines. The government should also issue directions to all municipalities to catch stray dogs and make appropriate arrangements to relocate them. Mr. Suresh Kumar stressed that children have become victims of stray dogs in the city. In LH too They highlighted stray dog problems at the Legislators' Home (LH) and asked Speaker U.T. Khader to take steps to keep the surroundings of LH and the Vidhana Soudha free from stray dogs. Mr. Kotian said members have been finding it difficult to keep the doors open at the LH. He said people of Andhra Pradesh knew that 'Naidu-Pawan, Modi-Shah and Jagan' were one team. 'If Mr. Jagan Mohan Reddy has the courage to fight the vote-chori by BJP at the Centre, he should join the march proposed to be taken out by the Congress party on August 14 in Vijayawada,' he challenged.
