Bombay HC has left women advocates without PoSH shield. We must extend the Act to Bar Councils

The Division Bench of the Bombay High Court concluded that no employer-employee relationship exists between advocates and Bar Councils. That nexus is the linchpin of the PoSH Act. The Act's architecture presupposes an employer capable of setting up an Internal Complaints Committee (ICC), enforcing penalties, and supervising compliance. Since Bar Councils are not 'employers' and advocates are not 'employees', the judges held, PoSH's machinery simply has nothing to attach itself to. Hence, there is no obligation to set up ICCs at state or national Bar Councils.
The Bombay High Court recently rejected a petition asking it to order the Maharashtra-Goa Bar Council and the Bar Council of India to set up permanent committees for handling sexual harassment complaints under the Sexual Harassment of Women at Workplace Act, 2013. Every woman advocate in India is now outside the PoSH net.
Gap in India's sexual harassment law
The Bombay High Court order reopens the faultline that has shadowed the PoSH Act since its birth. The Act traces back to the Vishaka guidelines rooted in the 1992 gang rape of Bhanwari Devi, a government field worker who was attacked by dominant-caste men while campaigning against child marriage.
Although the Supreme Court invoked constitutional guarantees to establish guidelines on redressing sexual harassment at work, it confined those safeguards to a model that required a formal employer. When Parliament finally codified PoSH in 2013, that structure was embedded in the Act. The duty to constitute ICCs, train staff and committee members, and create a safe working environment was placed wholly on an identifiable employer. The Bombay High Court Bench relied squarely on that design architecture to reject the current plea.
Where the PoSH Act ends, only the penal code is left standing. But criminal prosecution is a blunt, punishing tool. All the obstacles the PoSH inquiry was designed to soften resurface in a criminal courtroom. Evidence of sexual harassment is hard to collect, the standard of proof is exacting, and endless adjournments prolong the trauma for the complainants.
The conviction rate in cases of crimes against women is just 26 per cent, and trials for more than 90 per cent of cases are pending. When justice drags on for years, the process becomes the punishment.

Control without responsibility
It is true that Bar Councils do not control advocates' terms of employment in the way that traditional employers do. However, merely redirecting women advocates facing sexual harassment from fellow advocates, staff, or even Bar Council members to the Advocates Act is completely unsatisfactory.
ICCs and local committees under the PoSH Act were designed for this kind of dispute. Their members are trained in gender-sensitive procedures, grasp the evidentiary patterns typical of harassment, and can craft remedial as well as punitive directions. None of these safeguards would be present in a general misconduct hearing under the Advocates Act.
The composition of Bar Councils compounds the issue. Women occupy only 2 per cent of elected seats in state Bar Councils. Senior male lawyers dominate deliberations in these councils, reflecting the 'old boys clubs' tag. Expecting such bodies to investigate sexual misconduct claims with neutrality, confidentiality, and survivor-centred empathy is unrealistic.
When a special forum and process are created, the relief and platform they offer must be accessible to everyone facing complaints of such nature. That is why the PoSH Act should be reimagined as a forum for civil redress of sexual harassment more generally. An ICC should be constituted in every institution or organised profession, regardless of whether an employer-employee relationship exists. The Act should extend to covering the ambit of Bar Councils as well. The district-level local complaints committees must have explicit jurisdiction to hear such cases from women advocates. Right now, their remit is also restricted by the employment nexus.
The legal profession must start taking harassment, especially sexual harassment, seriously. The Australian Law Council has developed a National Model Framework Addressing Sexual Harassment, and the UK's Solicitors Regulation Authority has rules for dealing with sexual misconduct allegations. It is high time India adopted a similarly systematic response. Such a move would embolden women to remain within the sphere of advocacy—currently, only 15 per cent of practising advocates are women. It would also create a clear path to justice in incidents like last month's Kerala case, where a woman junior advocate alleged that her senior had assaulted her multiple times.
If the Bar can discipline lawyers for missing gowns, it can and must police harassment in its own corridors. The law should not look the other way.

The Mumbai police invoked the Maharashtra Control of Organised Crime Act (MCOCA) against three persons allegedly involved in supplying mephedrone on Tuesday— the first such case in the state after the stringent Act was amended to bring drug peddling under the purview of organised crime. The Anti-Narcotics Cell of the Mumbai police seized 766 grams of mephedrone in a case registered on August 7 under sections of the Narcotics Drugs and Psychotropic Substances Act, 1985. The main accused, Jamir Ahmed Ansari alias Boka, and his two other accomplices, Kayanat Shaikh and Adnan Shaikh, had formed a gang that supplied narcotics, police said. While Jamir Ahmed was arrested on August 7, the two others are still at large In order to take concrete action against him, the police decided to invoke new amended sections of the MCOCA following which a proposal was put up before senior officers as per procedures laid down for the application of the MCOCA. After the permission was granted, the three accused were booked under sections 3(1)(ii), 3(2) and 3(4) of the MCOCA. 'This action is the first action in Maharashtra against a drug trafficking gang under the amended MCOCA,' an official said. During the Monsoon Session of the Maharashtra Assembly in July when the Act was amended, Chief Minister Devendra Fadnavis had said that he had directed the police to take strict action against drug networks with growing cases of mephedrone production coming to the fore. Under MCOCA it is difficult to get bail for offenders thereby keeping them under custody of for a few years.

Article 15 (5) empowers the state to make special provisions for the educational advancement of socially and educationally backward classes, including SCs and STs, in private unaided educational institutions (excluding minority institutions). The Parliamentary Standing Committee on Education, Women, Children, Youth and Sports, chaired by Congress Rajya Sabha MP Digvijay Singh, tabled its 370th report Wednesday on the implementation of Article 15(5) of the Constitution regarding special provisions for reservations for SCs, STs, and OBCs in educational institutions, including private ones. New Delhi: Noting the significantly low OBC admissions and 'abysmally low' SC and ST enrollments in private universities in India, a parliamentary panel has recommended implementing reservations in private higher education institutions for marginalised students, with full financial support from the government to ensure equal access to quality education. Under the Central Educational Institutions (Reservation in Admission) Act, 2006, and as enabled by Articles 15(4) and 15(5) of the Constitution, central educational institutions in India provide 15 percent reservation for SCs, 7.5 percent for STs, 27 percent for OBCs, and 10 percent for EWS. However, private educational institutions are not legally required to implement reservation policies, as no statute mandates them to do so. According to the report, there is a significant gap between official data and actual enrollment figures. The committee noted that, as per data from the Department of Higher Education, Ministry of Education, private HEIs reportedly have 40 percent OBC, 14.9 percent SC, and 5 percent ST students. However, data provided by the private universities themselves reflect much lower OBC admissions and 'abysmally low' SC and ST enrollments. The report highlights lower admissions in OBC, SC and ST categories in esteemed private universities including Birla Institute of Technology and Science (BITS), OP Jindal Global and Shiv Nadar University. It states that during the 2024-25 academic year at Birla Institute of Technology and Science, out of 5,137 students, approximately 514 (10 percent) are OBC, 29 (0.5 percent) are SC, and 4 (0.08 percent) are ST, with some students not declaring their category. Similarly, at O.P. Jindal Global University, out of 3,181 students, only 28 SC and 29 ST students are enrolled, each constituting less than 1 percent. At Shiv Nadar University, among 3,359 students, SCs number 48 (1.5 percent) and STs 29 (about 0.5 percent). 'The Committee, therefore, recommends that the Department of Higher education implement reservation quotas in educational institutions, including private ones, in proportion to the population of SCs, STs, and OBCs,' the report stated. It further urged the establishment of a central oversight mechanism—such as the UGC, National Commission for Backward Classes, and SC/ST Commissions—to monitor implementation of Article 15(5) of the Constitution ensuring that institutions submit annual admission data to ensure compliance. Global rankings won't build Viksit Bharat Divide in higher education According to government data cited by the parliamentary panel, India has 685 government-managed universities (including 240 central and 445 state institutions) and 473 private unaided universities. Among the country's 45,473 colleges, only 21.5 percent are government-run, 13.2 percent are privately aided, and a majority—65.3 percent—are private unaided institutions. The Standing Committee noted a growing divide in Indian higher education between a small number of well-resourced private and select government institutions, and the majority of higher education institutions that struggle to match their quality. 'The Committee strongly emphasizes that education must be a key instrument of attaining social justice in this country, and noted that the current absence of reservations in private HEIs may be an impediment to the same,' the report stated. To address this imbalance, the committee recommended that Article 15(5) of the Constitution be implemented in full through parliamentary legislation. The committee specifically proposes reserving 27 percent of seats for OBCs, 15 percent for SCs, and 7.5 percent for STs in private higher educational institutions. It also noted that the high fees charged by private universities make education inaccessible for marginalized students and urged the State to legislate financial and structural support to ensure effective implementation of these reservations. The committee also recommended that the department take steps to improve the quality of data collected on student composition in both private and public HEIs. 'It is important for HEIs and the department to understand the social composition of the student body as well as the prospective pool of applicants. The current system of making caste declaration optional may result in a caste-blindness of the admissions process,' the report stated. Also Read: The history of Indian caste censuses is the history of Indian statecraft Financial support from govt The committee stated that any introduction of reservations for SCs, STs, and OBCs in private higher educational institutions must be fully funded by the government. It recommended adopting a model similar to the 25 percent quota under Section 12(1)(c) of the Right to Education Act, where private schools are reimbursed by the government for admitting students from disadvantaged backgrounds, in the higher education institutions as well. Observing that expanding reservation will require increasing seats and infrastructure like classrooms, hostels, faculty, the committee recommended that central and state governments should allocate dedicated funds for private HEIs to increase seats, build infrastructure, and hire faculty in institutions implementing reservations. 'The Central and state government should also supplement resources through Public Private Partnerships (PPP) in education. The Department of Higher Education, Ministry of Education, through Higher Education Funding Agency (HEFA) should provide low-interest loans to HEIs/ Universities for infrastructure expansion, ensuring no reduction in general category seats to avoid reducing general category opportunities,' the report stated. The Committee recommends that the department of higher education develop certain model programmes (bridge courses, free coaching for entrance exams, etc.) that private HEIs can adopt to support effective implementation of Article 15(5). 'Similarly, the Department may also provide scholarships which can bear the burden of living costs in hostels to students taking admission through quotas in private HEIs,' the report added. Reacting to the report, Congress general secretary in charge of communications Jairam Ramesh posted on social media platform X, 'The legitimate demand of SC, ST, and OBC communities for reservations in private higher education institutions can no longer be ignored.' He added that the party's 2024 Nyay Patra had pledged to legislate the implementation of Article 15(5), and the Committee's report has given fresh momentum to this commitment. A press statement by the government said the amendment defines inducement broadly, making it a criminal offence to attempt conversion by offering money, gifts or job opportunities, promising free education, deceiving with a marriage proposal, or using social media for promotion. Concealing one's religion with the intent to marry will also be treated as a crime, punishable with three to ten years of imprisonment and a fine of Rs 3 lakh. New Delhi: The Uttarakhand cabinet last week approved the Uttarakhand Freedom of Religion (Amendment) Act, 2025, introducing stricter provisions against forced, fraudulent or inducement-based religious conversions. General cases will attract 3 to 10 years of imprisonment and a fine of Rs 50,000, while offences involving women, children, SC/ST or differently-abled persons will be punishable with 5 to 14 years in jail and a fine of Rs 1 lakh. Mass conversions will carry imprisonment of 7 to 14 years along with a fine of Rs 1 lakh, and accepting foreign funds for conversions will invite 7 to 14 years of imprisonment and a minimum fine of Rs 10 lakh. Conversions carried out through threats, assault or trafficking will be punishable with 20 years to life imprisonment, the statement said. The amendment also allows for confiscation of any property acquired through illegal conversions by the district magistrate, with the accused required to prove the legitimacy of the property. Victims will be provided legal aid, shelter, maintenance, medical facilities and confidentiality of identity, and the government will introduce a special scheme for immediate support, the statement said, adding that all offences under the Act will be cognizable and non-bailable, with police empowered to arrest without warrant.
