No interference in judicial matters as govt respects the Constitutional process, says PM

PUTRAJAYA: Prime Minister Datuk Seri Anwar Ibrahim has stressed that he does not interfere in judicial matters, including the appointment of judges or court decisions.
He said all appointments and extensions of service, including for judges, must follow procedures as outlined in the Federal Constitution.
"If one understands the Constitution, then the process is clear. There's a commission, there's the Prime Minister, and there's the Yang di-Pertuan Agong," Bernama quoted him as saying during a gathering with Prime Minister's Department staff here on Monday (June 30).
"If you look at the recent appointments, the list of candidates is submitted to the Yang di-Pertuan Agong, and then brought to the Conference of Rulers for discussion.
"These procedures must be followed."

Anwar also emphasised that any appointment or extension of tenure influenced by certain groups would tarnish the integrity of the judiciary.
He said the issue of appointments or extending the tenure of civil servants, including judges, should not be made into political fodder or evaluated according to the sentiments of certain groups.
The Prime Minister said in such a political climate, the decision of whether or not to extend an individual's service was used to gauge loyalty by some quarters.
He added that there should not be any campaigning or political pressure on the process of appointing civil servants, including in the judicial institution.
"If a (high-ranking) civil servant campaigns for an extension and (if their service) is not continued, it's called a betrayal by one side. If their term is extended, (another group) will also call it a betrayal," he added.
The same applied to certain high-profile cases, he said, as quoted by Sinar Harian.
"When a case is pursued, it's called treason. If another case is not pursued, it's also called treason. When you're in this position, as Prime Minister ... well, I can only accept it and be patient," he said.
He also stressed his stance not to interfere in judicial matters and only communicate officially with the Chief Justice.
"That is why I avoid meeting any senior judge, except the Chief Justice.
"I would like to thank you for the ... discussions that have been good. The interpretation outside of that is another matter. But for me, in all those meetings, I have never interfered in judicial issues.
"What (a judge) wants to decide, that's their decision. I never interfered. But even that has been politicised," he said.

Anwar pointed out two high-profile cases recently involving former prime minister Datuk Seri Najib Razak and Muar MP Syed Saddiq Syed Abdul Rahman.
Najib was given a discharge not amounting to an acquittal by the Kuala Lumpur High Court in the RM27mil SRC International Sdn Bhd money laundering case.
Syed Saddiq, meanwhile, was discharged and acquitted of four charges including criminal breach of trust involving Bersatu Youth wing funds by the Court of Appeal.
"If Najib gets a DNAA, the Prime Minister is accused of interference and treason. Wrong. He should be given a DNAA by law.
"Then on the other hand, Syed Saddiq recently (was discharged). And from one side's point of view, it's also wrong.
"I said, it's none of my business. My stance is not an issue. We have to respect the judges' decision," he said.
He also touched on his experience of facing an investigation and trial that did not follow fair procedures.
"I know. I've been hit before. It's already over, not even charged, not even a police report, arrest first. There's no building (a case) either.
"If someone followed my case before, there was no police report – again, arrest first. So, we can't repeat that mistake," he said.
He called on all parties to defend the judicial institution and public service without being influenced by political sentiments or the interests of certain groups.
"We have to defend it, but not by following political or group tastes. In one case, there is an elite group of lawyers who agree. There are also Islamic bodies that oppose it.
"I'm not affected by that. This elite group can draw (attention) so well using the media. But it shouldn't influence us," he said.
He explained that the government respects all views but remains guided by the process and principles of the law.
Earlier, the media reported that Chief Justice Tun Tengku Maimun Tuan Mat is retiring on Wednesday (July 2), but questions remain over whether or not her term will be extended.
She will turn 66, the mandatory retirement age for judges, and her last day of service is Tuesday (July 1).

In a written parliamentary reply, education minister Fadhlina Sidek said the funds were disbursed to state education departments and educational institutions in February based on student enrolment numbers. A total of 91 suppliers were involved in supplying the badges, with each student receiving two Jalur Gemilang badges free of charge. Fadhlina said the procurement process was managed by the state education departments, district education offices, and institutions through the ePerolehan system, either by tender or quotation, depending on the amount of allocation received. She said the state education departments were also granted the flexibility to procure the badges by zones to expedite the supply process and to encourage participation from a larger pool of qualified suppliers. Fadhlina said parents are allowed to provide additional badges of the same size and suitable material if desired. 'Wearing the Jalur Gemilang badge on students' uniforms is one of the ministry's initiatives to instil patriotism and love for the country among students from an early age,' she said. She was responding to a question by Latiff Rahman (PN-Kuala Krai) about the total cost incurred by the government in supplying Jalur Gemilang badges to all students under the ministry's institutions and which company supplied them. Public school students started wearing the Jalur Gemilang badge on their school uniforms in March. However, the education ministry said no disciplinary action will be taken against those who fail to do so.

(Bernama pic) PETALING JAYA : Bangladesh's chief adviser, Muhammad Yunus, arrived in Malaysia today for a three-day official visit at the invitation of Prime Minister Anwar Ibrahim. Yunus and his delegation were received by home minister Saifuddin Nasution Ismail on their arrival at KLIA Terminal 1, Bernama reported. Wisma Putra said the visit is in response to Anwar's official trip to Bangladesh in October last year. Yunus, who is accompanied by several advisers and senior government officials, will be accorded an official welcoming ceremony at the Perdana Putra Complex tomorrow. This will be followed by a bilateral meeting with Anwar. The two leaders are expected to discuss regional and international developments of mutual concern and review progress in Malaysia-Bangladesh relations in key areas such as trade and investment, labour cooperation, education, tourism and defence. Both leaders will also witness the signing of several MoUs in areas such as defence, energy, strategic and international studies, semiconductor capacity building, and trade promotion. Wisma Putra said Anwar will host an official luncheon at the Seri Perdana Complex in honour of Yunus and his delegation. Bangladesh is Malaysia's second-largest trading partner and export destination in South Asia. Total trade between the two nations reached RM13.35 billion last year, an increase of 5.1% compared with 2023. The major Malaysian exports to Bangladesh include petroleum products, palm oil, and chemicals, while imports comprise mainly of textiles, footwear, and manufactured items. The visit is expected to further strengthen bilateral relations and foster stronger cooperation in areas of mutual benefit, building upon the strong foundation established since diplomatic ties were forged in 1972.

To fly the Jalur Gemilang upside down is an insult to the dignity of our beloved nation, but a hardware store owner in Kepala Batas, Penang, has done exactly that. And to do that just weeks before the country celebrates its National Day is like stabbing the very heart of the nation. Insult a man's dignity, he may forgive you. But insult the dignity of the nation, which the Jalur Gemilang is a symbol of, he will neither forgive you nor forget the disrespectful act. So will not the nation. The proof of this is the numerous police reports lodged around the country by loyal Malaysians and statements issued by national leaders. Disturbed as he was, National Unity Minister Datuk Aaron Ago Dagang took to X, urging the police to take firm action against the offender, stressing the need for the action to serve as a lesson to all. Flying the flag correctly is every citizen's responsibility as a sign of respect and love for the country, Bernama quoted him as saying. He is right. To fly the Jalur Gemilang incorrectly is to seek to blemish the sovereignty, dignity and unity of the nation. Such an abhorrent act mustn't be tolerated. Strongly worded condemnation was also issued by Penang PKR Youth chief Muhammad Zakwan Mustafa Kamal in a statement on Saturday. He said the act of flying the Jalur Gemilang upside down was disrespectful, irresponsible, and an insult to the dignity of the nation. He said if the act was proven to be deliberate, no compromise should be shown. We say the same, too. Zakwan also called on the hardware store owner to issue a public apology to all Malaysians. As this Leader goes to press, no such apology has been issued. The police are saying that there is a case for prosecution. The hardware shop owner, who was detained on Sunday and released on police bail later, is being investigated under Section 5 of the Emblems and Names (Prevention of Improper Use) Act 1963, Section 14 of the Minor Offences Act 1955 and Section 233 of the Communications and Multimedia Act 1998. If there is a case for prosecution, it is high time the authorities bring to bear the full brunt of the law on him to show how serious an insult to the dignity of the nation is. There have been far too many cases in the past, many of the culprits feigning ignorance. Utter incredulity must be the response. Even in the past, it wasn't the act of one who hadn't come of age. Or the act of one who suffered from some disease of the mind. Though the past acts showed clear disrespect for the dignity of the nation, we chose to adopt a softly, softly approach. The Kepala Batas incident proves to the authorities that such an approach was wrong. Nay it might have even encouraged it. If what the police investigation is saying is right, then the full brunt of the law must be brought to bear on him. Even ordinary crime demands punishment. Insulting the symbol of the dignity of a nation is no ordinary crime. As severe as it is, so must the punishment be.
