
2020 northeast Delhi riots aimed at dividing country, say cops; oppose bail
Solicitor General Tushar Mehta who appeared for the Delhi police, urged the bench of justices Navin Chawla and Shailender Kaur to not treat the case as a case of 'mere riots' but as one where the accused had conspired to cause communal divide, and destabilise India's unity, law and order.
The bench has reserved its verdict.
'One of the intentions was to globally defame our nation by choosing a particular date for more rioting, arson. It's not a spontaneous riot. This is a case where riots were pre-planned, well-orchestrated, organised with the view to achieve the sinister goal of dividing the country on religious lines. The intention was to cause embarrassment at a global level since the same were committed on a day when the United States of America Donald Trump was to visit the capital,' Mehta submitted.
The top law officer said the objective of the riots, in which 100 police personnel and others were injured and one policeman lost his life, was to defame the country
Northeast Delhi erupted in violence on February 23, 2020, following clashes between Hindus and Muslims over the then-proposed Citizenship Amendment Act (CAA) that left 53 dead and hundreds injured.
The accused – which include jailed student activist Sharjeel Imam, Gulfisha Fatima, former Jawaharlal Nehru University (JNU) student leader Umar Khalid, United Against Hate (UAH) founder Khalid Saifi – were booked under the stringent Unlawful Activities Prevention Act (UAPA). They approached the high court for bail after the trial court rejected their request.
They argued that they had spent more than four years in custody and that the trial's slow pace made prolonged incarceration unjustifiable. They also asserted that they are entitled to be released on bail on the grounds of parity with co-accused Natasha Narwal, Devangana Kalita and Asif Iqbal Tanha, who were granted bail by the high court in 2021.
At Wednesday's hearing, Mehta insisted that prolonged incarceration could not be a ground for release on bail, in a case where the accused intended to cause violence in the capital and break the country into two parts.
'It's not a riot case where someone can get bail for prolonged incarceration. Prolonged incarceration is held in some cases to be ground enough per se for grant of bail but in the matter of this nature, where the capital bleeds violence and the country breaks into two parts, the same is not applicable. If you're doing something against the nation, you better be in jail until you are acquitted or convicted,' Mehta submitted.
He also submitted that the Delhi police had done a good job and recorded statements of almost 58 witnesses before the magistrate.

Ajmer Dargah admin draws flak from Muslim groups over its notice

Can govt appoint trustee of Banke Bihari temple, HC asks UP govt
Prayagraj (UP), Jul 23 (PTI) The Allahabad High Court has sought a reply from the Uttar Pradesh government on whether it can appoint its officials as trustees of the Banke Bihari temple in Mathura, a private temple, by the issuance of the Uttar Pradesh Shri Bankey Bihari Ji Temple Trust Ordinance, 2025. Justice Rohit Ranjan Agarwal, after hearing amicus curiae Sanjeev Goswami, fixed July 30 as the next date of hearing on a petition filed by Pranav Goswami and another. According to the amicus curiae, 'The temple is a private temple and the religious practice is being carried out by the heirs of the late Swami Hari Dasji. By the issuance of the ordinance, the government is trying to take control over the temple through the back door." The amicus curiae apprised the court that according to the ordinance, there would be two kinds of trustees of the board — nominated trustees and ex-officio trustees. The nominated trustees will be the seers, gurus, scholars, mathadhish and mahants etc. from the Vaishnav tradition as well as followers of the Sanatan Dharma. However, he raised strong objections as to the seven ex-officio trustees, who are officials like the district magistrate, the special superintendent of police and the municipal commissioner of Mathura, which he said would amount to a back-door entry by the state government in the private temple. 'The creation of such a trust amounts to intruding into the Hindu religion by the state government. The Constitution does not provide for the State to practise any religion and take control of any temple," the amicus curiae said. The court, in its order dated July 21, sought the state government's reply and observed, 'The matter requires consideration. Hearing to continue. Put up this case as fresh on July 30, 2025. By that time, the state government would respond to the argument which has been raised by the amicus curiae. Fake STF officer among 3 held for duping people with fake govt job offers
Bulandshahr (UP), Jul 23 (PTI) Three members of a gang allegedly involved in duping people on the pretext of securing government jobs were arrested in the Bulandshahr district of Uttar Pradesh, officials said Wednesday. The police allegedly recovered mobile phones, forged appointment letters, fake ID cards, recruitment advertisements, and impersonated government uniforms, including caps and belts, from their possession, they said. Superintendent of Police (City) Shankar Prasad said that the gang, comprising Neeraj, Satish, and Himanshu, allegedly used counterfeit appointment letters, identity cards, and recruitment materials to mislead job seekers. They wore fake uniforms resembling those of government departments to appear legitimate. One such case involved duping a man named Gajendra Singh of Rs 15 lakh in the Pahasu area on the promise of securing him a government job, the officer said. During the raid, police seized 20 Aadhaar cards, identity documents, posting and appointment letters, photocopies of bank passbooks, 12 fake posting orders, four character certificates, and other forged paperwork used to carry out the scam, he added.
