NCLAT stays insolvency proceedings against Reliance Infrastructure

Ltd on Friday said appellate tribunal NCLAT has stayed the insolvency proceedings against the company following a repayment of ₹92.68 crore towards tariff as per an energy purchase agreement. Reliance Infrastructure in its latest regulatory filing said that the National Company Law Appellate Tribunal (NCLAT) has stayed an NCLT order over an appeal filed by it.
The Mumbai bench of the the National Company Law Tribunal (NCLT) on May 30 this year directed initiation the
corporate insolvency resolution process
and appointment of an interim resolution professional against Reliance Infrastructure.

The NCLT order came after IDBI Trusteeship in April 2022 had filed a petition alleging a default of ₹88.68 crore plus interest as of August 28, 2018.
In a regulatory filing on June 2 this year, Reliance Infrastructure said the NCLT order has become infructuous "upon full payment having already been made".
On June 4, NCLAT had suspended the NCLT order while hearing the company's appeal which said it has made the full payment of ₹92.68 crore to Dhursar Solar Power Pvt Ltd (DSPPL).

"The company has made full payment of ₹92.68 crore to Dhursar Solar Power Private Limited, towards claim of tariff as per the Energy Purchase Agreement with the company," Reliance Infra had said in its June 2 statement.
IDBI Trusteeship in its petition had alleged payment defaults on 10 invoices raised between 2017 and 2018 by DSPPL for supplying solar energy to Reliance Infrastructure.
The payments were sought by IDBI Trusteeship, the security trustee of DSPPL.

Anil Ambani family-owned Reliance Infrastructure (R-Infra) posted a profit attributable to owners of the parent for the first quarter of fiscal year 2026 (Q1 FY26) of Rs 59.84 crore, compared to a loss of Rs 233.74 crore reported in the June quarter of FY25. The company's revenue from operations for the quarter stood at Rs 5,907.82 crore, down 17.86 per cent year-on-year (YoY). Its expenses for the quarter were Rs 6,469.81 crore, down by 4.84 per cent YoY. Sequentially, the company's revenue grew by 43.81 per cent, while its profit declined by 98.63 per cent. The company's consolidated earnings before interest, taxes, depreciation, and amortisation (EBITDA) stood at Rs 1,494 crore, up 29 per cent YoY. In Q1 FY26, R-Infra's subsidiary Mumbai Metro One achieved the highest-ever Q1 fare revenue of Rs 84 crore. Mumbai Metro One also secured station branding rights at Airport Road and Andheri stations with HDFC Ergo and AMFI, respectively. Earlier, the National Company Law Appellate Tribunal stayed an order passed by the National Company Law Tribunal, Mumbai, admitting R-Infra into the Corporate Insolvency Resolution Process following a plea filed by IDBI Trusteeship Services over an alleged default of Rs 88.68 crore (apart from interest). The company, however, claimed that it had made full payment of Rs 92.68 crore. R-Infra's total market capitalisation as of Friday was Rs 13,549.67 crore. Its shares, listed on the Bombay Stock Exchange (BSE), closed at Rs 342.05 per equity share.

Mumbai: After the Enforcement Directorate (ED) raided multiple premises linked to industrialist Anil Ambani, shares of Reliance Infrastructure and Reliance Power dropped 10 per cent over two sessions, hitting their lower circuits of 5 per cent on Friday. ED conducted the raid on over 35 premises linked to Anil Ambani's Reliance Group (RAAGA Companies) during a probe into the Rs 3,000 crore Yes Bank loan fraud. Both Reliance Power and Reliance Infrastructure have issued statements distancing themselves from the investigation, saying the ED's actions mainly relate to Reliance Communications and Reliance Home Finance -- companies no longer associated with them. Reliance Power fell 5 per cent to Rs 56.72, while Reliance Infrastructure slid 5 per cent to Rs 341.85, upon which it was locked in the lower circuit. On July 23, 2024 the Reliance Infrastructure shares were trading at Rs 384 in the mid day session, since then the shares have fell sharply, now touching Rs 341.85. In the trading sessions following the raids, Reliance infrastructure shares were locked in a 5 per cent lower circuit two times. They were locked at Rs 360.05 on July 24, and today at Rs 341.85 were sealed once again. Reliance Power shares also dropped significantly, falling 7.41 per cent over the same period. Preliminary investigation by ED has revealed a well-planned and thought-out scheme to divert or siphon off public money by cheating banks, shareholders, investors and other public institutions. The offence of bribing bank officials, including Promoter of Yes Bank Limited, is also under the scanner. Allegedly, the promoters colluded for an unalwful loan diversion of around Rs 3,000 crore from Yes Bank (from 2017 to 2019). The regulator has found gross violations in Yes Bank loan approvals to RAAGA companies, such as Credit Approval Memorandums (CAMs) being backdated and investments being proposed without any due diligence/ credit analysis in violation of the bank's credit policy.

PlayStore billing policy: Google appeals NCLAT order in Supreme Court

Google approached the Supreme Court on July 21 Almost three years after the Competition Commission of India (CCI) held that Google leveraged its dominance in the Android ecosystem, and the National Company Law Appellate Tribunal (NCLAT) partially upheld the order later, the matter has now reached the Supreme Court with the US technology giant challenging the appellate tribunal's ruling. Google approached the Supreme Court on July 21. On March 28 this year, NCLAT partially upheld the CCI ruling against Google for misuse of its dominant position by imposing unfair Play Store policies and promoting its own payments app. The appellate tribunal had said that Google shall allow, and not restrict app developers from using any third party billing services; shall not impose any anti-steering provisions on app developers or restrict them from communicating with their users to promote their apps; and shall not discriminate against other apps facilitating payment through Unified Payments Interface (UPI) in India vis-à-vis its own UPI app, in any manner. The NCLAT, however, overruled several of the more stringent behavioural remedies imposed on Google by the CCI. The CCI had, in its ruling, asked Google to allow third-party app stores within the Play Store, uninstallation of pre-installed apps, and side-loading of apps. In May this year, NCLAT reinstated two CCI directions that obligated Google to disclose data policies and remove advantages for Google Play Billing System (GPBS). In the petition moved now in the apex court, Google has challenged the changes approved by the NCLAT in May.
