‘Terrified' black man died after police restrained him, inquest hears

A vulnerable and 'terrified' black man who was suffering a medical emergency and crying out for help died after police dragged him across a bathroom floor by his collar and handcuffed him, an inquest jury has heard.
Godrick Osei, 35, who was said to be experiencing acute behavioural disturbance (ABD), became 'floppy' and suffered a fatal collapse within two minutes of being restrained.
Relatives of Osei have claimed at the inquest in Truro that he was treated 'inhumanely' because of his race, which was denied by the Devon and Cornwall police officers involved in the incident.
Osei's family described him as a deeply loved son, brother, father and uncle, a 'gentle giant' who had struggled with his mental health after the death of his father.
The inquest heard Osei, a student, experienced ABD in the early hours of Sunday 3 July 2022 after taking cannabis and cocaine, and drinking alcohol.
He thought he was being chased by someone and called the police asking for help before breaking into a care home in Truro and entering a narrow bathroom.
Care home staff called 999 and when police officers arrived, Osei was locked inside the bathroom screaming and calling for help.
Officers forced their way in and found Osei on the floor. One of the officers, PC Peter Boxall, told the inquest on Wednesday that he dragged Osei by his collar as this was the safest way to get him out of the narrow space. He argued that handcuffing him was justified for the safety of the officers and members of the public, including Osei.
Una Morris, the family's lawyer, suggested to Boxall that his attitude changed when he saw Osei was black. He told a colleague to 'red dot' him – aim a Taser at him, though the electrical weapon was not discharged – and said: 'Fucking hell, look at the sight of his fingers,' the inquest heard.
The lawyer asked Boxall if dragging a black man by the collar across the floor and swearing at him was 'inhumane'. Boxall replied that the man's race made no difference. 'We needed to gain control,' he said. However, he apologised for his language.
Morris put it to Boxall that Osei was 'terrified'. The officer replied there was a 'certain amount of shock on his face'. Osei's family also claimed Boxall kicked Osei while he was on the floor, but he denied this.
Within two minutes of being restrained, Osei collapsed and died. The inquest heard Osei had ABD, which presents with symptoms such as extreme agitation, paranoia, rapid breathing and sweating, and can be exacerbated by restraint. Boxall said he had been trained in ABD but had not recognised it in Osei.
Earlier this week, the inquest heard there was an unfounded suspicion that Osei may have been a black man suspected of pushing a man from a bridge in Truro into the river the night before.
Morris told the inquest the colour of the two men's skin was their only similarity. She suggested that this was an indicator of 'racial bias'.
Rosie Antonio, another of the five officers who attended, said she had been worried that Osei could have a knife because care home staff reported he had blood on him and she heard the sound of a metal object hitting a hard surface.
Antonio, who has since left the police, said she had had a 'small amount' of training on ABD but did not think when she arrived at the scene that this was what Osei was experiencing. A third officer, PC Katie Bagguley, said it did not cross her mind that it could have been ABD.
The inquest continues.

'Fred Kerley has already notified the AIU that he intends to contest the allegation that he has violated the anti-doping rules related to whereabouts failures, as he strongly believes that one of (or) more of his alleged missed tests should be set aside either because he was not negligent or because the Doping Control Officer did not do what was reasonable under the circumstances to locate him at his designated location,' the statement said. It added: 'Fred will not comment further at this time out of respect for the process, and looks forward to presenting his case to the appointed hearing panel.' Kerley won the Olympic silver medal in the 100 meters at the Tokyo Games and the bronze in Paris last year. He has also earned six medals at the track and field world championships. 'You can try to break me in the storm, but all you're doing is giving me a better story at the finish line,' Kerley later posted on the same account. In May, Kerley was charged in Florida with punching a woman, a hurdler who also competed in the Olympics. That came just a few months after he was arrested for allegedly punching a Miami Beach police officer on Jan. 2, an incident in which police used a Taser on him. ___

AUSTIN, Texas — A shooting outside a Target store in Texas that killed three people, including a 4-year-old girl and her grandfather, began with the gunman randomly firing on an employee collecting shopping carts and set in motion a terrifying sequence of stolen cars and crashes that ended with him arrested naked holding a Bible, police said Tuesday. Austin police said Ethan Nieneker, 32, killed the Target worker then opened fire on the grandfather and his granddaughter before stealing their sport utility vehicle. The violence sent store employees and shoppers fleeing for cover. Police Chief Lisa Davis said Nieneker had a history of mental health problems, but she was unaware of any specific diagnosis. Court records show he also had a history of arrests for domestic violence and assault 'What happened yesterday was an unprovoked and deliberate attack, a deliberate act of violence,' Davis said at a news conference. 'Innocent lives were taken in broad daylight in a place where people should feel safe to run their everyday errands and to live their everyday lives.' Police said that the Target employee, Hector Leopoldo Martinez Machuca, 24, was taken to a hospital where he died. Adam Chow, 65, and his granddaughter were pronounced dead at the scene while Chow's wife sustained minor injuries. The name of the child was not released. In the hour after the shootings, Nieneker caused multiple car crashes, tried to steal a water truck, stole a woman's vehicle and assaulted her in the process, Sgt. Nathan Sexton said. Niekeker also tried to get inside a Waymo self-driving taxi, went to the home of an acquaintance and vandalized it, and was later spotted in a residential backyard without his clothes on, the officer said. 'He said that he was Jesus,' Sexton said. Police said Nieneker has been charged with two counts of capital murder and one count of murder. Jail records do not list an attorney for him. Online court records show he had a history of arrests for domestic violence and assault, and was arrested several times in recent years in both Travis County, which includes Austin, and neighboring Williamson County. His arrests in Travis County included misdemeanors for criminal mischief and driving while intoxicated, and three arrests on felony domestic violence charges. He was convicted of a charge of assault causing bodily injury family violence in 2016 and briefly sentenced to jail. Another charge within days of the 2016 episode was dismissed, according to court records. It was not immediately clear if those two charges were related. Another charge of felony assault on a family or household member in 2019 was dismissed three years later when prosecutors could not locate the victim. Williamson County records show repeated run-ins with law enforcement, including two cases of misdemeanor family violence in 2015 that were later dismissed. He was also convicted of possession of marijuana in 2012 and entered a no contest plea to a charge of criminal mischief in 2016. Monday's shooting came as back-to-school shopping was in full swing ahead of the upcoming academic year. It also comes just over two weeks after an attack at a Walmart store in Michigan. A man accused of stabbing 11 people at the Traverse City store on July 26 has been charged with terrorism and multiple counts of attempted murder.

The disturbed fiend who allegedly opened fire in a Target parking lot in Texas claimed to be Jesus and gunned down his three victims — identified Tuesday as a cart collector, a grandfather and his 4-year-old granddaughter — at random. Ethan Nieneker, 32, went on the deadly rampage Monday afternoon in Austin, using a gun obtained by a family member to fatally shoot Target employee Hector Leopoldo Martinez Machuca, 24, Adam Chow, 66, and Chow's young granddaughter, the Austin Police Department announced Tuesday. 'He said that he was Jesus and there was no real reason whatsoever given,' Austin Homicide detective Nathan Sexton said of the accused mentally ill gunman's violent spree. 3 Ethan Nieneker claimed he was Jesus, and chose his victims at random. Chow's wife was also injured in the heinous attack before Nieneker stole their car and fled at high speed from the store. Nieneker later crashed the Toyota into a Volkswagen before coming to a rest on top of an Infiniti SUV. He then assaulted the Volkswagen driver, hijacked the vehicle, and drove off, according to police. He was eventually taken down with a Taser about 20 miles away in the city' south end after throwing a brick through a friend's house and wandering naked through a backyard, all of which was captured on video surveillance.
