Samsung India executives seek to quash $81 million penalty over tax evasion

NEW DELHI (Reuters) -Seven Samsung India executives have asked a court to revoke penalties of $81 million included in New Delhi's $601-million tax demand from the company for allegedly misclassifying some imports, arguing "no grave offence" had been committed, according to legal papers and a source.
The Indian tax authority in January found Samsung and its executives evaded tariffs by misclassifying imports of key mobile tower equipment from 2018 to 2021. Samsung has separately challenged the order before a tax appeals tribunal, where it has defended its declarations and denied any wrongdoing.
While Samsung's India unit faced a $520 million demand, employees were asked to pay penalties totaling $81 million for "knowingly and intentionally" playing a role in the misclassification of imports.
In a High Court filing in Mumbai which was not made public but was seen by Reuters, Samsung India logistics executive Ravi Chadha said the authorities issued the penalty within two to three days of receiving hundreds of pages of detailed responses from the company and its executives in January, and the process was "rushed".
"This timeframe is utterly insufficient to conduct the requisite in-depth study," read the filing by Chadha, who faces a fine of 950 million rupees ($11.1 million).
"The present case is limited to the interpretation of tariff entries, no grave offence has been committed."
Samsung India and Chadha did not respond to Reuters queries. India's tax authority did not respond immediately to requests for comment.
Online court records show the six other executives including the network division's vice president, Sung Beam Hong, a general manager for finance, Sheetal Jain, and Samsung's general manager for indirect taxes, Nikhil Aggarwal, have also challenged the tax authority's order.
The lawyer for all seven executives, Sriram Sridharan of Indian law firm Lakshmikumaran & Sridharan, did not immediately respond to a request for comment. The law firm also represents Samsung in the tax appeals tribunal challenge.
Their pleas and grounds for revoking the penalty are identical to Chadha's, said a source with direct knowledge of the ongoing lawsuits.
In his court filing, Chadha argued that the "egregiously exorbitant" penalty is impossible for any salaried employee to bear, and it would take him more than 100 years to settle the amount given his earnings.

Stampede after cricket victory kills at least 11 in India
Eleven people were killed and scores more injured after a stampede outside a cricket stadium in Bengaluru, in India's southern Karnataka state, where fervent fans had gathered to celebrate the first-ever Indian Premier League title win for the city's team. Thousands of people had congregated on Wednesday in anticipation of the arrival of the Royal Challengers Bengaluru team at the stadium to celebrate Tuesday's victory in the IPL final. The state's chief minister confirmed the 11 fatalities and 33 people seriously injured in the stampede late Wednesday evening. All the injured are out of danger, according to officials. "A moment of joy has been eclipsed by sorrow," Karnataka Chief Minister Siddaramaiah, who only goes by one name, wrote on X. He promised compensation for the victims' families, and added that, ahead of the deadly stampede, "precautionary measures were taken by not allowing a victory parade" because of the fear of crowd surges. Brazil's Pix set for next leap with launch of recurring payments
(Reuters) - Brazil's wildly popular instant payment system Pix is poised for another leap with the launch of a new recurring payments feature this month, central bank officials said on Wednesday. Since its launch in late 2020, Pix has rapidly become the leading payment method in Latin America's largest economy, surpassing cash as well as debit and credit cards. Last year it handled more than 26 trillion reais ($4.61 trillion) in transactions. Initially slated for launch last October, the new feature will go live on June 16, allowing users to authorize recurring charges with a single consent, according to the central bank, which developed and operates Pix. That will allow for automatic payments of utilities, phone bills, school tuition, gym memberships, and digital or streaming services via the new "Pix Automatico" tool. "'Boleto' will be overtaken by Pix Automatico when it comes to automatic payments," said Renato Gomes, the central bank's financial system organization director. Boleto is the traditional slip method, which moved 6.2 trillion reais last year, according to banking federation Febraban. Speaking at a central bank event in Sao Paulo to present the feature, Gomes added that existing automatic debit services via banks are also likely to be disrupted by the new tool. Companies must sign bank agreements to offer automatic debit, a process central bank regulation director Gilneu Vivan described as burdensome for small businesses. Pix Automatico will simplify the process, allowing small merchants to receive recurring payments with ease. Vivan also noted that nearly 60 million Brazilians do not own a credit card, a group that will now be able to access subscription-based services previously limited to cardholders. A study by payments platform EBANX estimates that Pix Automatico could handle at least $30 billion in e-commerce transactions within its first two years of operation.
