Portions of seven structures near airport removed for height violations, action will continue: State to HC
The government reply stated that the Mumbai Suburban Collector's office will coordinate with the BMC and Mumbai Metropolitan Region Development Authority (MMRDA) for 'any action as may be required to be carried out in the future.'
A bench of Chief Justice Alok Aradhe and Justice Sandeep V Marne was hearing a PIL filed by advocate Yeshwanth Shenoy, in 2019, raising concerns about airport safety.
The plea had sought actions against the owners or developers of high-rise buildings/structures around Mumbai airport, that created 'obstacles' and caused threats to take-off and landing of flights. In July 2022, the HC had directed the collector to take steps to remove 48 structures consisting of unauthorised portions of buildings near Mumbai Airport flouting height norms and are in the way of approach surfaces of runaways.
On March 26 and May 6, the bench had asked the collector to remove the concerned portions from the seven structures including the portions at Faiz CHSL, Allwin Apartments CHSL, Fazal House CHSL and Farzaan Apartment CHS in Kurla. The offending portions also included those from two structures at Rizwi Nagar Co-operative Housing Society Wing C and E and an offending portion at Dheeraj Heritage Premises in Santacruz (West).
The compliance affidavit filed through the Collector's office stated that all of the owners have removed the portions including water tanks, antenna, iron pipes and have also made changes in respect of the concrete structures. The affidavit further stated that the removal of structures was confirmed by Mumbai International Airport Limited (MIAL) after an inspection.
The affidavit further stated that in addition to compliance of HC directions, it has directed the Brihanmumbai Municipal Corporation (BMC), the planning authority, to issue notices under Maharashtra Regional Town Planning (MRTP) Act to remove unauthorised structures.
The bench took the affidavit submitted by Government Pleader Neha Bhide on record and posted further hearing after four weeks to be heard by an appropriate bench not consisting of Justice Marne, as he recused from hearing the matter.

ED freezes Rs 47cr assets of BMC engineer and five contractors in Mumbai's Mithi River desilting scam
Mumbai: The (ED) froze approximately Rs 1 crore in bank balances from BMC engineer Prashant Tayshete and bank-security deposits collectively worth Rs 46 crore from five contractors after conducting searches on their premises in connection with the Mithi River scam. Tayshete was part of the team that visited Kerala to inspect and approve the imported machines intended for desilting work, which a contractor organized. The ED said, "BMC officials have misused their positions for financial gains in procurement and use of silt pusher and multipurpose amphibious pontoon machines introduced in the tenders for desilting of Mithi River in 2021-2022." Earlier, the ED had investigated liaisoner-cum-contractor Ketan Kadam and contractor Jayesh Joshi in the case along with BMC engineer Prashant Ramgude and actor Dino Morea. Kadam and Morea had a financial link. The Mithi river (nullah) desilting work has faced allegations of corruption and contractor cartelisation for decades. It is alleged that contractors deceived the BMC by using forged documents regarding silt disposal from the Mithi River between 2013 and 2021, and by awarding the contract to select contractors after modifying the conditions to ensure only contractors with specific machinery could secure the contract. Even a contractor arranged visits of the BMC engineers to examine the machine, which he had claimed to have procured from abroad. The ED said that Tayshete was among the officials who visited to examine the machine. The ED issued a press release on Saturday stating: "The search operation covered office/residential premises linked to Acute Designs, Kailash Construction Company, Nikhil Construction Co, N A Construction Pvt Ltd, J.R.S Infrastructure and BMC engineer Prashant Tayshete. Further, certain digital devices, records pertaining to various immovable properties. " The ED said that the evidence collected during the course of investigation and the search operations prima facie indicate various irregularities in the works related to desilting of Mithi River by the contractors in connivance with officials of the storm water drains (SWD) department, BMC, and others. It further added that the contractor had submitted various false documents, including MoUs from landowners and NoCs from respective gram panchayats for lands purportedly used for silt dumping.

Over 7,000-page chargesheet filed in Mumbai's Mithi river desilting scam
Mumbai: The Economic Offences Wing (EOW) of city police, probing the Rs 65.5-crore Mithi River desilting scam case, filed an over 7,000-page chargesheet in the court on Friday against two arrested accused. Eleven others named as accused in the FIR, including several BMC officials, have not been arrested yet. Two of the 13 named in the FIR lodged on May 6—Ketan Kadam (50) and Jay Joshi (49)—were arrested the same day. Investigators filed the charge sheet against Kadam and Joshi. While Joshi is out on bail, Kadam is still in the jail, said police. Kadam is associated with Ketan Vodar India LLP, while Jay Joshi is a director at Virgo Specialties Pvt Ltd. The court, where the chargesheet was filed, is yet to take cognisance of it. Both Kadam and Joshi are accused of collectively taking Rs 9 crore as commission. They acted as middlemen to secure the Mithi River cleaning tender for a contractor. The duo allegedly conspired with the accused BMC officials to ensure their contractor got the contract. On March 20 last year, the EOW constituted a special investigation team (SIT) led by joint commissioner Nishith Mishra to probe the alleged scam. There were allegations that the accused persons, contractors, middlemen, and several BMC officials connived and caused a loss of Rs 65.5 crore to the civic body by not desilting the Mithi River, submitting fake bills, and getting them cleared. The machinery belonged to Matprop, a company that sold two machines to Virgo, said a police officer. While the machine cost around Rs 3.1 crore, the BMC officers named as accused allegedly changed the note sheet and asked the contractors to take it on rent.
