President Droupadi Murmu, R N Ravi and Supreme Court: Questions for the Bench

Chief Justice Bhushan Ramkrishna Gavai, who was sworn in to the highest judicial office Wednesday, the first Buddhist and only the second Dalit to be elevated to this position, begins with a plateful. President of India Droupadi Murmu has sent the Supreme Court a list of 14 questions sparked by the Court's April verdict. The SC had declared the action of Tamil Nadu Governor RN Ravi in reserving 10 bills for the consideration of the President, after they had been reconsidered by the state legislative assembly, to be 'illegal' and 'erroneous'. In the process, it prescribed timelines for the Governor's decision in the lawmaking process — three months when a bill is first sent, a month when it is resent. More controversially, it laid down a three-month deadline for the President as well. Unsurprisingly, this was seen as contentious. It could be argued that guardrails for the exercise of gubernatorial discretion were needed, and especially so in a political context where, in several states, governors appointed by the BJP-ruled Centre are seen to be locked in open and perpetual conflict with the non-BJP elected government, smudging lines of accountability and creating obstacles in governance. But by asking the President to adhere to a deadline, by prescribing the manner in which she must exercise the power given to her by Article 201 — in other words, by seeking to limit the President's constitutional discretion — the court invited questions of overreach.
Vice President Jagdeep Dhankhar articulated those concerns by overstating them. Article 142, which empowers the SC to pass 'any decree or order necessary for doing complete justice in any case or matter pending before it', a power it exercised in the case against Tamil Nadu Governor Ravi, had become a 'nuclear missile against democratic forces', he said. Now, the President's 14 questions — even though the Court is not obliged to answer them, and in spite of the fact that its opinions are not legally binding — are an opportunity. They can lay the ground for a calmer dialogue and deliberation on the issues that lie at the core of the matter — the constitutional doctrine of separation of powers; the boundaries of executive discretion and judicial review (can the latter, for instance, kick in even before a bill becomes law?); the balance between the executive, legislature and judiciary in a framework of federal democracy.
Going ahead, such a dialogue will be complicated by the political context in which it occurs — an aggressive executive has been facing off with the judiciary, with the waqf law that has been passed by Parliament and taken up by the Court for a pointed questioning being the latest flashpoint. The process of deliberation will also be made more fraught by the fact that among President Murmu's 14 questions to the Court are those that challenge its broader powers under Article 142 — going much beyond the questions of justiciability of gubernatorial and presidential discretion. That the President chose to make a reference to the Court under Article 143, which concerns the SC's advisory jurisdiction on critical constitutional questions, instead of merely seeking a review of its April ruling, has also sharpened the stakes. For it to be fruitful, the to-and-fro between the President and the Court will need to be conducted in a climate of mutual trust and respect, not suspicion.

Solan (Himachal Pradesh) [India], June 3 (ANI): Union Minister and Bharatiya Janata Party (BJP) President JP Nadda on Monday chaired a key core group meeting of the party in Himachal Pradesh's Solan, and instructed the state unit to start preparing for the upcoming Panchayat elections. During his visit, Nadda also participated in a Tiranga Yatra, where he congratulated Prime Minister Narendra Modi and the armed forces for Operation Sindoor. In his address during the core group meeting, Nadda instructed the state BJP to launch a series of outreach programmes over the next two and a half months from June 5 to August 15 coinciding with the 11th anniversary of the Modi government. These events, he emphasised, should highlight the achievements of the Centre and energise party cadres across Himachal Pradesh. The State spokesperson and BJP MLA Randheer Sharma elaborated on the upcoming programme, saying, 'from Sankalp to Siddhi, We'll Take 11 Years of Modi's Work to the people.' She thanked the Paraguayan government for its strong condemnation of the terrorist attack in Pahalgam, Jammu and Kashmir. President Murmu received Paraguay's counterpart, Santiago Pena Palacios, at Rashtrapati Bhavan and hosted a banquet in his honour on Monday. Vice President Jagdeep Dhankhar, his wife, Sudesh Dhankhar, and other dignitaries attended the banquet. In her remarks at the banquet on Monday, President Murmu said, 'I would like to thank you for your government's strong condemnation of the heinous terrorist attack in Pahalgam and for expressing your deep condolences and solidarity with the people of India and with those who lost their loved ones. India believes in the principle of Vasudhaiva Kutumbakam, which means the world is one family. Guided by this principle, India has been working with all like-minded countries to advance the cause and progress and development for all humanity.' 'In this endeavour, Paraguay has been a consistent supporter and collaborator for India in several multilateral international fora. Welcoming Paraguay President to Rashtrapati Bhavan, she said, 'It gives me great pleasure to extend a warm welcome to His Excellency President Pena and a distinguished delegation from Paraguay at the Rashtrapati Bhavan on their first state visit to India. This is a historic occasion. Since the establishment of diplomatic relations between our two countries in 1961, this marks only the second visit to India by a President of Paraguay.' She emphasised that the two nations share 'warm and friendly relations' based on mutual trust, democratic values and a shared commitment to the progress and development of the people of the two nations. Highlighting the warm bilateral ties between the two nations, she said, 'Our two countries share warm and friendly bilateral relations based on mutual trust, democratic values and a shared commitment to the progress and development of our people. Both our countries have steadfastly upheld the principles we believe are important, principles deeply rooted in our civilizational values and historical experiences.' President Murmu expressed optimism that the ties between the two nations will reach greater heights with the visit of Paraguay's President. She said, 'Over the past six decades, these relations have grown progressively stronger and with your visit today, they are poised to reach even greater heights.' She noted that the two nations attach great importance to maintaining peace, sovereignty and territorial integrity and working for the prosperity and well-being of the people of the two nations. She said, 'Paraguay was the first country in Latin America to fight against colonial rule. While your struggle for independence became a source of inspiration for other Latin American countries, India's non-violent freedom movement imparted energy and strength to other Asian and African countries.' 'People of both our countries share this fighting spirit. Both nations attach great importance to maintaining peace, sovereignty and territorial integrity and to working for the prosperity and well-being of their people,' she added. Earlier, Prime Minister Narendra Modi met Paraguay President Santiago Pena Palacios at Hyderabad House in New Delhi on Monday. Palacios also paid a tribute to Mahatma Gandhi at Rajghat. Paraguay's President is on a three-day State visit to India, which will conclude on June 4. Following the Delhi visit, President Pena will travel to Mumbai to engage with state political leadership, business and industry representatives, startups, innovators, and technology leaders. (ANI)
