HC hails TN's steps against fraud firms, calls SOPs a tangible relief

Madurai: Appreciating the state govt for issuing comprehensive standard operating procedures (SOPs) for the effective implementation of the Tamil Nadu Protection of Interests of Depositors (in Financial Establishments) Act, 1997, pursuant to the court's earlier directions,

observed that what began as a matter of judicial concern has now evolved into a framework that promises tangible relief to affected depositors.
Justice B Pugalendhi observed that the practical working of the TNPID Act was vitiated by administrative delay, lack of coordination, lack of proactive monitoring or awareness programmes, and absence of timelines, all of which defeated the very object of the legislation. These failures reduced the efficacy of the Act, leaving thousands of poor and middle-class depositors in prolonged distress.
The judge observed that the court earlier issued certain directions to the state to prompt systemic reform and restore public faith in the process.
Pursuant to the directions, the govt showed a meaningful response and structural progress. After a high-level meeting chaired by the chief secretary, comprehensive SOPs were issued on July 9 by the home department, bringing together all departments concerned under a common and time-bound procedural umbrella by issuing a GO.
"The court also notes with appreciation that by the GO, the category of 'economic offender' has now been included as one of the categories under the Tamil Nadu Act 14 of 1982 (Goondas Act).

The judge observed that the court suggested the govt consider appointing a retired high court judge or a senior IAS officer as a full-time competent authority to expedite recovery and refund proceedings and inspire depositor confidence.
The govt has now proposed the appointment of zonal-level officers as additional competent authorities, in addition to the existing district revenue officers, thereby decentralising and strengthening the overall enforcement machinery.
The judge also appreciated the state public prosecutor Hasan Mohammed Jinnah and additional public prosecutor T. Senthil Kumar, who appeared in this matter and played a crucial role in communicating the concerns of the court to the govt. Their contribution reflects the important role that law officers play in bridging the judicial and executive institutions in matters of public interest and ensuring that judicial concerns are translated into administrative action, the judge observed while disposing of a contempt petition.

Although the initial CCTV investigation did not reveal any suspicious movement, we are expanding the probe so that no link is left unturned," a senior police official said. The school administration was cooperating with the police in the case, he informed. Statements of the school staff were being recorded and information was also being sought from other witnesses in the area, according to police. In August last year, two minor girls were sexually assaulted inside the toilet of a school at Badlapur in Thane district by a male attendant, sparking widespread protests and outrage. The accused, Akshay Shinde, was later killed in an alleged retaliatory police shootout while being escorted in a police vehicle.

(Getty Images/iStockphoto/ Representational image) As per an August 4 notification issued by the central ministry, the 15 state civil service officers appointed to the IAS are Vivek Padam Singh, Munish Nagpal, Mahender Pal, Satpal Sharma, Sushil Kumar, Varsha Khangwal, Virender Sehrawat, Satyender Duhan, Manita Malik, Satbir Singh, Amrita Singh, Yogesh Kumar, Vandana Disodia, Jaideep Kumar and Samwartak Singh Khangwal. Hindustan Times was the first to report on July 14 the names of these 15 officers who were found suitable for promotion to IAS in a meeting of selection committee headed by Union Public Service Commission member, Dinesh Dasa, which had met in New Delhi to consider the names of state civil service officers for appointment to 27 posts of IAS by promotion. These appointments have been made for the vacancies arising for 2021, 2022, 2023 and 2024. The newly appointed IAS officers will be on probation until further orders. Meanwhile, eight HCS officers of the 2002 batch facing trial in a corruption case were included provisionally in the select list for appointment to the IAS by way of promotion. As per the central rules, this means that they cannot be promoted to the IAS unless exonerated by the court. A select list is a roll of officers recommended for induction into the IAS. Rule 5(5) of the IAS (Appointment by Promotion) Regulations stipulated that the name of an officer included in the list of officers will be treated as provisional if any departmental or criminal proceedings are pending against him. 'The proceedings shall be treated as pending only if a charge-sheet has actually been issued to the officer or filed in a court,'' reads the explanation to the Rule. Similarly, Rule 7(3) said that if an officer included in the select list is issued with a charge-sheet or a charge-sheet is filed against him in a court of law after his inclusion, then his name in the select list shall be deemed to be provisional. In a nutshell, it means that officers against whom criminal proceedings are pending cannot be considered for promotion to the IAS unless exonerated by the court.

Russia has accused the United States of pushing a "neocolonial agenda" after President Donald Trump announced substantial hike in tariffs on the global south. In a sharp rebuke, Russian foreign ministry spokeswoman Maria Zakharova said the move reflected Washington's inability to cope with a shifting global order. "Sanctions and restrictions have unfortunately become a defining feature of the current historical period," Zakharova said in response to a media query on the US decision to tighten tariffs against countries in the Global South.
