NPA separates cases of couple charged after Eldorado Park girl's death

The case against the parents of a four-year-old girl from Eldorado Park in Soweto, who is the victim of abuse, has been postponed until Monday. Both the father and mother will remain in custody while the state prepares to oppose bail.
The four-year-old girl, who is not named to protect the identity of her three-year-old brother, passed away on Friday at Chris Hani Baragwanath Academic Hospital. She was in ICU since August 6 after she was assaulted and nearly drowned, allegedly by her father.
Provincial SAPS spokesperson Lieutenant Colonel Mavela Masondo previously confirmed to Soweto Urban News that the initial case docket of attempted murder was changed to murder after her death.
According to Soweto Urban News, the father and mother each made a brief, separate appearance at the Protea Magistrate's Court yesterday. The father of the four-year-old is facing five counts: Murder, rape, compelled rape, child abuse, and assault of a minor. The mother, who is reportedly pregnant, is facing a charge of failing to immediately report a sexual offence committed against a minor.
The presiding magistrate postponed the matter to allow for a formal bail application. NPA spokesperson Phindi Mjonondwane explained to the media outside the court that while both accused were arrested, the NPA decided to separate the two cases. This was due to a lack of evidence that the alleged offences were committed jointly.
Cases separated
'Now that we know alleged offences are not intertwined, we then had to separate the two matters for the mother to appear alone as well as the father,' said Mjonondwane. 'With the case against the father, he is now facing five charges, we have added three additional charges to the two that he was facing in his first appearance. While the mother on the second docket is facing the charge of failing to immediately report a sexual offence against a minor.'
She added that according to the Sexual Offences and Related Matters Amendment Act 32 of 2007, one has a duty to report such a crime. Mjonondwane stated that the state will be opposing bail, and reasons will be advanced in court.
Calls for justice
Bandile Masuku, the chairperson of the portfolio committee, said that committee members were there to pay their respects to the family and community of Eldorado Park.
'This is one of the many [cases] we continually get reported on in the country and it is important that every time we get such cases as a community and legislature we rally behind the fight against women and children abuse,' said Masuku.
Eldorado Park ward councillor Juwairiya Kaldine told the media that she believes the country's justice system is failing women and children and that the case should be handled by a female magistrate.
'The government of today sitting in legislature need to relook at the constitution of this country because the constitution we are currently guided by [does] not stand [up] for women and children in this country,' said Kaldine.

The judgment was delivered in the Western Cape High Court. Lombaard was the state's star witness during the trial of the missing green-eyed girl from Middelpos in Saldanha. Lombaard was initially arrested and charged alongside Kelly Smith, Jacquen 'Boeta' Appollis, and Steveno van Rhyn for the kidnapping of Joshlin. Joshlin Smith has been missing since February 19, 2024. Image: SAPS However, months after her arrest, Lombaard opted to become a Section 204 witness for the State, providing key evidence that helped secure the convictions of the trio. Her lawyer, Advocate Eben van Tonder submitted that while there were some minor discrepancies found during her testimony, the court needed to take into consideration that nerves can be a factor when testifying. He stated that even professionals feel nervous when testifying, and many times not under such scrutiny as in this matter. 'The court relied on parts of the witness's testimony for judgment. Taking it all into account, the witness testified honestly. She made huge sacrifices, especially when it comes to her family. Image: Robin-Lee Francke/IOL During her testimony, Lombaard told the court Kelly sold Joshlin for R20,000 with the promise of giving van Rhyn R1,200, herself R1,000, and sharing the rest with Boeta. Delivering his judgment, Judge Erasus told Lombaard he knew she faced a lot of criticism, but he had gone through everything, looking not just at the facts but also at everything with common sense. 'At times, as in your case, a person does not come clean because of something you expected. This is the R1,000. It might sound a little to some people. I saw your living conditions. I was at your house. I heard about your prolonged drug use. To you, R1,000 was a lot. You needed it for your drug habit, which was so bad that you often went to Ms Smith to beg for food for your children. I am glad to see you're doing better,' Judge Erasmus told Lombaard. He further said: 'You left school in primary school. You have never been in trouble, do not know how to deal with authority. It is seldom a co-conspirator comes out with everything in the beginning. It took you seven months, from March to October'. Judge Erasmus said it would be unfair to attach too much weight to everything before someone became a Section 204 witness. 'I asked you many questions and at times you said you lied or you corrected yourself. You owned up to your mistakes. The decision I make will not be accepted by everyone. There will be people who will criticise you. I am of the view that you should be granted indemnity on charges relating to human trafficking and the kidnapping of Joshlin Smith. Yes, you were quiet. You played no active role in the trafficking or kidnapping of Joshlin. You may not be prosecuted,' Erasmus said. Lombaard stood up in court with a bright smile and teary eyes as relief washed over her. Judge Erasmus also rejected the application for leave to appeal their convictions and sentencing of Kelly, Boeta, and van Rhyn. Joshlin was reported missing on February 19, 2024. Rise Mzansi has warned that an estimated two million illegal firearms are circulating in South Africa, posing a serious threat to public safety. The party has criticised the South African Police Service (SAPS) for failing to track the specific makes of firearms used in crimes properly, a shortfall it says undermines crime analysis and detection efforts. In a written parliamentary reply to Rise Mzansi, the Minister of Police revealed that SAPS's Enhanced Firearms Register System (EFRS) does not capture the specific makes of firearms, only their types, such as handguns, shotguns, or rifles. This means the system is unable to identify weapons like the AK-47, Norinco, or AKM, all of which have reportedly been used in violent crimes across South Africa. Rise Mzansi Member of Parliament and National Assembly Caucus Whip Makashule Gana said the lack of detailed firearm data hampers the country's ability to track and remove illegal weapons from communities. 'Currently, the data provided in the EFRS can only differentiate in terms of firearm types (handgun, shotgun or rifle), not makes (AK47, Norinco, AKM),' the Minister of Police stated in response to the party's questions.
