Karnataka tightens COTPA rules; penalty for violations, legal age for purchasing tobacco products raised
Tightening tobacco control laws, the Karnataka government has notified major amendments to the Cigarettes and Other Tobacco Products Act (COTPA), 2003, on the occasion of World No Tobacco Day observed on May 31.
The amendments —through which the maximum fine for violations under tobacco control laws has been increased from ₹200 to ₹1,000 and the legal age for purchasing tobacco products has been raised from 18 to 20 years— were approved by President Droupadi Murmu on May 23.
The amended Act — the Cigarettes and Other Tobacco Products (Prohibition of Advertisement and Regulation of Trade and Commerce, Production, Supply and Distribution) (Karnataka Amendment) Act, 2024 — was published in the Karnataka Gazette on May 30.
In addition to the existing ban on tobacco consumption in public places, chewing and spitting tobacco has also been prohibited. The other key amendments include a ban on the sale of loose cigarettes or single sticks and strict prohibition on the sale of tobacco products within 100 metres of any educational institution. This was earlier within 100 yards.
Hookah bars
The State has also imposed a blanket ban on hookah bars, regardless of whether they are located in restaurants, pubs, or cafes. As per the newly added Section 4A, operating a hookah bar will now invite imprisonment of one to three years and fines ranging from ₹50,000 to ₹1 lakh under Section 21A of the Act. Despite an earlier ban, hookah bars were still found operating illegally in parts of Bengaluru.
While designated smoking areas (DSAs) will still be allowed in hotels with over 30 rooms, restaurants with seating for more than 30 and airports, penalties for violations have increased from ₹ 200 to ₹ 1,000 under sections 21, 24, and 28.
Health Minister Dinesh Gundu Rao said these amendments are part of the State government's larger strategy to safeguard public health, particularly in the younger generation in sensitive areas like schools and colleges.
Stringent enforcement
Surgical oncologist U.S. Vishal Rao, who is a member of the State government's High-Powered Committee on Tobacco Control, said the amendments are a significant step in the effort towards achieving tobacco control in Karnataka.
'We have known that as per data from the latest Global Adult Tobacco Survey (GATS) for India, there has been a reduction in the number of tobacco users by about 81 lakh. Specifically, the prevalence of tobacco use among adults aged 15 and above has reduced by 7%. The amended Act makes enforcement more stringent, reducing the accessibility of these products to youth who are the main targets of the tobacco companies for initiating addiction,' Dr Rao told The Hindu.
Following the amendments, the Bengaluru City Police Commissioner B Dayananda has appealed to all proprietors of hotels, bars, restaurants, clubs and pubs to remove illegal designated smoking areas (DSAs) or rooms which are not compliant with COTPA rules.
'DSAs must be distinctly marked and adequately ventilated as per the COTPA guidelines to ensure non-smokers are not exposed to second-hand smoke. It is imperative to note that providing of food, water, beverages, or any tobacco products within DSAs is strictly prohibited,' stated the appeal dated May 31.

CM launches year-long campaign against drugs
Bhubaneswar: Odisha Chief Minister Mohan Charan Majhi on Saturday launched a year-long State-wide campaign against drugs and intoxicants and asserted that awareness is the only solution to prevent tobacco-related deaths in the country. Majhi launched the campaign at the State-level programme held on the occasion of 'World No Tobacco Day'. 'About 1.4 million people lose their lives in India every year due to tobacco use. Among the deaths reported in the country every year due to various causes, about 10 per cent are due to tobacco use alone,' he said. Stating that it was time for the public, especially the youth, to take this issue seriously, Majhi appealed to all to join the awareness campaign against intoxicants and drugs. 'I call upon all to take a resolution to adopt a life free from addiction. Say no to tobacco, say yes to life,' he said. The awareness campaign will continue for about a year across the State from May 31 to June 26 in the first phase, June 26 to August 15 in the second phase, October 2 (third phase) and December 25 to January 15, 2026 in the fourth phase. The Chief Minister said the door-to-door awareness campaign will create awareness about the ill effects and health hazards of tobacco use. He said people should be made aware that 100 per cent of oral cavity cancer or lung cancer is caused by tobacco and cigarette use. 'If the only truth in the world is death, then why should it be painful? Therefore, everyone should adopt a healthy lifestyle,' he said, adding that advertisements of tobacco, cigarettes and drugs are also affecting the youth. He advised people to be careful about these deceptive advertisements. The Chief Minister also stressed on enforcement to check the prevalence of drug abuse and adulterated liquor. He said joint efforts should be made by Excise, Home Department and Narcotics Control Bureau to take strict action against the culprits. 'Efforts are being made to completely stop the sale of tobacco and drugs by empowering the STF. A new excise policy will be formulated soon to crack down on all types of intoxicants,' the Chief Minister said. At the event, Majhi launched the logo, theme song and handbook of the State-wide awareness campaign. Excise Minister Prithiviraj Harichandan said the government has, for the first time, launched a comprehensive awareness programme against the use of tobacco, alcohol and drugs. 'We will spread this message to the last person of the society. Apart from excise, the participation of other departments and civil society is also needed. The punishment for the offenders under the new Excise Act will be stricter,' he said. Odisha's brand ambassador of Nishamukti Abhiyan and sand artist Sudarsan Pattnaik said it is the responsibility and duty of all to take this campaign to every home. The district collectors and excise officers of all the districts attended the programme virtually. In another event organised by the Health and Family Welfare department, stress was laid on interdepartmental coordination and public engagement. On this occasion, a signature campaign was launched to involve citizens in pledging their support to a tobacco-free Odisha. The department also released newly developed IEC (information-education campaign) materials to educate the public, particularly youth and vulnerable communities, on the risks associated with tobacco use. The event also witnessed the digital launch of the ToFEI (Tobacco-Free Educational Institutions) web application, which will assist schools and colleges in self-assessing and reporting their compliance with national tobacco-free guidelines.

Govt hikes tobacco fine to Rs 1,000
Bengaluru: The Karnataka government has published a gazette notification increasing the fine for public use of cigarettes and tobacco products from Rs 200 to Rs 1,000. The government has also raised the minimum legal age for purchasing cigarettes and tobacco products from 18 to 21 years, according to a statement issued by the Health Ministry on Saturday. Additionally, the government has banned the opening or operation of hookah bars across the state. The order has been issued in the name of the Governor by the Secretary, Department of Parliamentary Affairs and Legislation, G. Sridhar. This decision follows the assent of President Droupadi Murmu on May 23 to the Cigarettes and Other Tobacco Products (Prohibition of Advertisement and Regulation of Trade and Commerce, Production, Supply and Distribution) (Karnataka Amendment) Bill, 2024. The new Act amends the Cigarettes and Other Tobacco Products Act, 2003 (Central Act 34 of 2003) as it applies to the state of Karnataka. The amendment specifies that no person shall use tobacco products in any public place. The term 'use' includes both smoking and spitting of tobacco. The sale of cigarettes or other tobacco products is now prohibited: To any person under the age of 21 years; within a 100-meter radius of any educational institution; in loose form or as single sticks. The Act also states that no person shall open or operate a hookah bar, either individually or on behalf of another person, in any location—including eating houses, pubs, bars, or restaurants—regardless of what they are called. According to the new provisions, anyone who violates Section 4A of the Act shall be punishable with: Imprisonment of not less than one year, which may extend up to three years; a fine of not less than Rs 50,000, which may go up to Rs 1 lakh. The Act further allows that in hotels with 30 or more rooms, restaurants with a seating capacity of 30 or more, and at airports, a designated smoking area or space may be provided. Karnataka joins the league of Rajasthan, Maharashtra, and Gujarat states, which have implemented similar amendments to strengthen public health protections against tobacco use.

Fourth Covid death reported in state amid rising cases
Karnataka recorded its fourth Covid-related death of the year on Saturday after a 63-year-old man with underlying health conditions succumbed in Bengaluru, bringing renewed attention to the state's ongoing battle with a modest surge in infections. According to the health department, the deceased was being treated for oral cancer and tuberculosis. He had been admitted to a private hospital in the city on May 21 with complaints of general weakness and was undergoing chemotherapy. He died on May 29 due to a jugular vein thrombosis and cancer-associated weight loss, with Covid detected incidentally. The state's active Covid caseload stood at 238 as of Saturday. In the preceding 24 hours, 58 new cases were reported while 53 patients were discharged. Since the beginning of 2025, Karnataka has logged 425 total cases, including 183 recoveries and four fatalities. Testing levels remain steady, with 420 samples examined in the last day — comprising 354 RT-PCR and 66 Rapid Antigen Tests — and a positivity rate of 13.8%. The case fatality rate currently stands at 1.7%, according to official data. Hospital admissions remain limited. Thirteen Covid-positive individuals are undergoing treatment, including one in the ICU of a private hospital. The rest are on isolation beds across both government and private facilities. The majority of patients — 225 — are recovering in home isolation. Health Minister Dinesh Gundu Rao addressed the situation, reassuring the public that the numbers do not warrant panic. 'The current position does not require panic or restrictions. Officials and experts are monitoring continuously. Further decisions will be taken in consultation with the Centre,' he said. The government has stepped up its medical inventory, ensuring the availability of 2,500 rapid antigen test kits, 1.3 lakh RNA extraction kits, 5,000 RT-PCR kits, and two lakh viral transport medium (VTM) kits. An additional 5,000 RT-PCR kits are also being procured to support continued testing over the next month. Weekly meetings of the state's technical advisory committee have been mandated to track trends and respond to developments. On the possibility of imposing travel restrictions amid rising cases in neighbouring Kerala, the minister clarified that no such move is under consideration. 'Such measures, if at all needed, will be decided by the Centre after inputs from the state,' he said.
