McLaren unit sued by US surgeon who suffered brain injury in snowmobile crash

Andrew Cannestra's snowmobile crashed near Ivalo, northern Finland, on February 2 2020, during a four-night 'Pure McLaren Arctic Experience' arranged by McLaren Automotive Events, and the Florida native is alleging the company was in breach of contract and negligent.
Barristers for the 54-year-old told the first day of a trial in London that Mr Cannestra and his then-partner, Kaitlin Mealor, were given a safety briefing, but this did not include information on the layout of the track or the emergency stop button and tether cord on the snowmobile.
The motorsports group is defending the legal action, with its lawyers saying there was 'no evidence' that the briefing did not meet safety standards and that the 'irreducible risk' of the activity was 'reasonably controlled'.
Opening the trial on Wednesday, Neil Block KC, for Mr Cannestra, said his client and Ms Mealor were 'absolute novices' on snowmobiles, and that 'a duty was owed by McLaren to use reasonable care'.
He said that while Mr Cannestra's case was not 'that the track was inherently unsafe', he and Ms Mealor 'did need to receive a proper and adequate briefing, and proper and adequate guiding'.
In written submissions, Mr Block said: 'The briefing did not include any information about the layout of the track, the position of potentially hazardous bends, corners or other hazards.
'It seems to be McLaren's case that this was not required.
'It is common sense that this was required, and the failure to do so must be a breach of duty.'
Mr Block told the court that Mr Cannestra and Ms Mealor's 'couples package' cost almost £24,000 before flights, with activities including driving a McLaren car on ice, and optional events such as snowmobiling.

Mr Cannestra and Ms Mealor used a 'dedicated snowmobile track' about four kilometres long, and signed a driver declaration, a waiver and a self-liability form beforehand.
They were given a safety briefing by two guides – Arto Pitkanen and Jouni Satta – which Mr Block said lasted 'approximately five minutes', with the barrister adding: 'There is an issue about what it actually included.'
Mr Block said the Lynx Xtrim 900 snowmobiles had three modes – eco, standard and sport – with the tour beginning in eco mode, which had a top speed of 40kph.
A few hundred metres into the activity, Mr Block said the group stopped, and Mr Pitkanen approached Mr Cannestra and changed the mode, which increased its top speed and was 'not appropriate'.
Mr Pitkanen is alleged to have then set off at speeds of up to 60kph, causing Mr Cannestra to lose sight of him and speed up as he 'did not want to be on his own', Mr Block said.
Mr Cannestra then lost control of the snowmobile on a bend, with the vehicle veering off the track into deep snow and hitting a tree, leaving him with a 'very significant' brain injury and 'orthopaedic injuries'.
Matthew Chapman KC, for McLaren, said in his written submissions that the turn where Mr Cannestra crashed was 'quite safe if negotiated at an appropriate speed' and that the court 'can confidently conclude that reasonable care and skill was exercised' in organising the outing.
He continued that Mr Pitkanen changed the snowmobile's mode as Mr Cannestra was 'eager' for this to happen and that he 'explained the switch' to him.
He added that Mr Cannestra's speed was 'wholly within his control', and claims that Mr Pitkanen had driven too far in front 'cannot sensibly succeed'.
He said: 'In this case, there was a well-organised, risk-assessed activity which was delivered by well-trained and experienced guides who complied with the local standard.
'The irreducible risk was, in other words, reasonably controlled.'
While acknowledging that the content of the safety briefing was 'contentious', Mr Chapman said it included the hand signal to stop, how to use the throttle and brake, starting the engine and 'bodyweight shifting/leaning for turns'.
The trial before Mr Justice Ritchie, which is only dealing with the issue of liability, is expected to conclude this month, with a written judgment expected at a later date.

Now imagine doing that while sat in front of the world's most revered automotive engineers, one who's just designed you a completely unique new car… because that's exactly what has happened at Gordon Murray Automotive. Advertisement - Article continues below At this year's Monterey Car Week, Gordon Murray Special Vehicles, an offshoot of the main company, has revealed the S1 LM bespoke commission – all five of which are going to just the one customer. Unlike the Le Mans GTR that's also been revealed in California, this commission is specifically designed to celebrate the first McLaren F1 GTR which won the Le Mans 24 Hours race outright in 1995, without the famous long-tail design. The S1 LM is based on the T.50, and GMSV's designers have used this iconic racer as direct inspiration for its design and aerodynamic package. This can be seen in unique elements that reference the original's front clamshell, roof-mounted intake and split rear wing. You'll also notice that there's no longer a rear-mounted fan, with more traditional splitters and wings used to generate its downforce. Skip advert Advertisement - Article continues below This also leaves space for designers to fit four traditional exhaust outlets, and a retro set of four round rear lights that mimic those of the McLaren F1 – although, unlike the original, these weren't sourced from a Dutch-built coach. The cabin has also been directly inspired by the original racer, although new switchgear and aggressive bucket seats are unique to this model. Under the skin, there have been more changes, with the Cosworth-built V12 engine upgraded from the T.50. Capacity is now slightly larger at 4.3 litres and it's targeted to produce 693bhp, which is up from the standard car's 655bhp. However, it'll retain its revvy characteristics – revving to 12,100rpm – and is connected to a six-speed manual transmission, powering the rear wheels (which feature wider tyres). GMSV says the car also has a more track-focused suspension set-up, plus adopts the same engine mounting system as the Le Mans GTR special edition. The British company has not revealed how much each of the units cost, but we can probably assume there won't be much of a buy-in-bulk discount applied, considering the comprehensive engineering required to complete the project. Full production of all five units will kick off next year, and as for the identity of the buyer? McLaren are taking the rare step of auctioning off a piece of history which hasn't even happened yet. The manufacturers are giving fans the opportunity to buy cars from the next two years which they hope will encapsulate a defining era for the brand. McLaren aim to win the Monaco Grand Prix, Indianapolis 500 race, and Le Mans 24 Hour World Endurance Championship slog - a prestigious set called the Triple Crown which only they have completed before. With that in mind, the British outfit are auctioning off either Lando Norris or Oscar Piastri 's car from Monaco next year, the 2026 Indy 500 machine, and their 2027 Le Mans drive. The auction will be taking place during the 2025 Abu Dhabi Grand Prix in December in collaboration with classic car auction house RM Sotheby's. Of course, the winning bidders will then have to wait for the cars to be used before getting them - you can't deprive Norris or Piastri of their unit for Monaco! McLaren chief executive Zak Brown said: 'This auction is an extraordinary opportunity to own a piece of racing history and bid for a car that has competed on track before its official launch. 'The Triple Crown is a huge part of our heritage and we are determined to claim it once again as we prepare for our 2027 entry into the World Endurance Championship. 'Not only that, these incredible cars will come with unprecedented VIP access to the team and action on track. 'My first race was the 1981 Long Beach Grand Prix - I remember it like it was yesterday. 'I remember the experience. I remember the first racing driver I met, the first car I saw, and then I started collecting the 1:43s. And then as business grew, I could move up to the 1:18s, and then finally, I've been fortunate enough to get some of the full-size versions. 'So when I look at the McLaren fans, it's everything from me as the 10-year-old who then wants the 1:43 diecast to play Hot Wheels, etc., up to adults that have substantial means and want to have the big version sitting in their garage. 'We have great fans around the world of all ages, genders, and demographics, and so obviously this is right at the peak of what you can do to be part of the McLaren Papaya Club, if you'd like. We think it's a really cool opportunity. 'And we're going to do track cars of our World Endurance cars, so those won't have the racing heritage that these three cars have, but will also be a great experience. It's something we want to do more of.'
