Deficiencies in civil works: Haryana govt to chargesheet 80 irrigation department officials

The Haryana government has ordered that 80 engineering officials including a number of class 1 officials of the irrigation and water resources department be charge-sheeted for major and minor penalty.
The action has been initiated after samples of the civil works being undertaken by the department failed quality tests in 16 circles. Officials in the rank of superintending engineer (SEs) and heading these 16 circles would be issued a charge sheet for minor penalty while those in the rank of executive engineer, sub-divisional officer and junior engineer would be chargesheeted for major penalty.
Chief minister Nayab Singh Saini has approved disciplinary action against these officials. Certain chief engineer rank officials will also get a displeasure note from the state government, officials said.Officials said that samples of ongoing civil works and installation of high density polyethylene pipe were collected for quality check by the office of superintending engineer, vigilance of the irrigation department in November-December 2024.
'The testing was done at IIT, Ropar, NIT, Kurukshetra and Shri Ram Lab at New Delhi. A lot of deficiencies were found in the civil works and the samples did not meet the parameters set by the Indian Standards Code. The testing revealed use of inferior quality material. Also, construction parameters were not met,'' said an official.
Officials said that a committee under the lead of chief engineer (coordination) Jai Deep Rao has been constituted to frame chargesheets against the errant officials.
Irrigation and water resources minister Shruti Choudhry said that compromise on the quality of construction material will not be tolerated. '48 samples of construction materials used in various ongoing projects of the Irrigation department were collected out of which 18 failed quality tests,' Choudhry said.
The minister said some of the projects were nearing completion, a stage where the accountability of officials increases significantly. After repeated complaints, the vigilance wing of the department conducted raids and took samples, she said.
Punishment for major penalty under Rule 7 of Haryana Civil Services (Punishment and Appeal) Rules entailed compulsory retirement, dismissal from service, withholding of increment with cumulative effect, withholding of promotion for more than a year, reduction to a lower stage in the pay band or pay scale for a specified period.
Punishment for minor penalty under Rule 8 of Haryana Civil Services (Punishment and Appeal) Rules included issuing a warning (with a copy in the personal file), censure, withholding of promotion for a year, recovery of any pecuniary loss caused by negligence or breach of orders, withholding of increment without cumulative effect.

Delhi lieutenant governor VK Saxena has approved disciplinary proceedings against a former Public Works Department (PWD) executive engineer in connection with alleged irregularities in the construction of classrooms under the Aam Aadmi Party (AAP) government. Officials said the LG gave his nod to a proposal moved by the Directorate of Vigilance (DoV) to initiate action under Rule 14 of the Central Civil Services (Classification, Control and Appeal) Rules against SR Meena, who was then an executive engineer in the PWD. Meena is currently posted with the Central Public Works Department (CPWD) in Amritsar. The case dates back to 2018-19 and involves infrastructure projects undertaken under the Centre's Samagra Shiksha Abhiyan, aimed at augmenting school facilities across Delhi. According to officials, a total of ₹38.37 crore was sanctioned for the construction of 226 classrooms in Delhi government schools. 'Instead of constructing 20 classrooms at a school in Tri Nagar, part of the sanctioned amount was used to build a multi-purpose hall at Rani Bagh without the required administrative and financial approvals,' said a senior official at the LG Secretariat, requesting anonymity. 'This constitutes diversion of funds and procedural violation.' The matter surfaced following a public interest litigation (PIL) filed in the Delhi high court by a civil rights group on June 11, 2019. The PIL sought court intervention to ensure that six newly constructed school buildings were handed over for use. This prompted the then chief secretary to initiate an inquiry in March 2024, after the case resurfaced during a review of delayed infrastructure utilisation. A fact-finding report submitted in May 2024 flagged serious lapses not only by the PWD, but also the education department, which failed to conduct proper feasibility studies. 'The department did not verify the availability of unencumbered land before approving the construction, which in some cases led to double allocation of funds for the same space,' the official added. Officials said while proceedings have now been initiated against Meena, the case against another accused officer was dropped as time-barred due to his retirement. This is the latest in a string of actions approved by the LG against officials involved in alleged mismanagement of public funds during previous AAP-led initiatives. Earlier this year, Saxena had cleared action against multiple PWD engineers for irregularities in classroom construction and the renovation of school infrastructure — a project which has been under the scanner since a 2019 CAG audit flagged cost escalations and poor oversight.

Madurai: The right to burial is a fundamental right; however, the process must be regulated by the concerned authorities as contemplated in the statutes, observed the Madras high court . The court made the observation while directing the district administration officials and Hindu religious and charitable endowments (HR&CE) department officials to conduct an inspection and identify land for a burial ground for a few villages in Thisayanvilai taluk in Tirunelveli district. The court was hearing a public interest litigation filed by S Venkatesh. The petitioner stated that temple land parcels belonging to Tiruchendur Subramanya Swamy Temple were illegally used as a burial ground by the people residing in Vijaya Achampadu, Ittamozhi, and Thisayanvayal, and the surrounding villages. Hence, the petitioner moved court seeking a direction to restrain the villagers from using the temple land as a burial ground. An additional govt pleader submitted that there are no other alternate govt poramboke land near the villages to be allotted for the purpose of using them as a burial ground. The Thisayanvilai tahsildar wrote a letter to the joint commissioner/executive officer of Tiruchendur temple, seeking some of the temple land for the villagers to use as a burial ground. A division bench of justice S M Subramaniam and justice A D Maria Clete observed that when govt poramboke lands and natham land parcels are available, there is no reason to address any letter to the temple authorities or HR&CE department authorities. Section 172(3) of the Tamil Nadu Urban Local Bodies Act, 1998, stipulates that no person shall bury or burn any corpse except in a place that has been registered or licensed or provided as aforesaid. The judges made it clear that the burial of dead bodies is to be made only in the licenced area. People cannot bury dead bodies in a place that has not been notified under the provisions of the Act. "Right to burial is a fundamental right. But such burial is to be undertaken with the authority of law and to be regulated by the competent authorities under the provisions of the relevant Act and Rules," the judges observed. Taking into account the contrary submissions made by the tahsildar and counsel for the temple, the judges directed the district administration officials and HR&CE department officials to conduct a field inspection and inquiry, in consultation with the temple authorities, to identify land for a burial ground for the villagers, in the manner known to law. Saxena has approved a proposal to initiate disciplinary proceedings against a senior Public Works Department (PWD) engineer for alleged irregularities in the construction of classrooms under the Central government's Samagra Shiksha Abhiyan, a Raj Niwas official said on Thursday. The accused officer, S.R. Meena, a former executive engineer, is currently serving with the Central Public Works Department in Amritsar, he added. 'This decision follows serious irregularities identified in the implementation of the Samagra Shiksha Abhiyan, a Centrally sponsored initiative aimed at enhancing educational infrastructure in Delhi, which was allocated ₹38.37 crore for the construction of 226 classrooms across various schools,' said the official. The action has been taken after a public interest litigation filed in the Delhi High Court on June 11, 2019, sought a directive for the government to hand over possession of six newly constructed school buildings. The litigation revealed significant irregularities in construction practices and fund management, the official said. The then Chief Secretary constituted a committee on March 26 last year to examine the issues. The committee's findings revealed lapses on the part of the PWD, including the diversion of funds intended for the construction of 20 classrooms at Trinagar School to Rani Bagh School and the construction of a multipurpose hall without obtaining the necessary approvals. The Vigilance Department's proposal to initiate disciplinary proceedings against Mr. Meena under Rule-14 of the Central Civil Services (Classification, Control and Appeal) Rules, 1965, has received endorsement from both the Principal Secretary (Vigilance) and the Chief Secretary, the official said. The Anti-Corruption Branch of the Delhi government has also summoned AAP leaders and former Delhi Ministers Manish Sisodia and Satyendar Jain in the case.
