
Two accused in 2003 Kolkata gang-rape case acquitted 20 years later
KOLKATA: A gang-rape case, reported in Amherst Street in the city in May 2003, that came up for trial 20 years later -- in Jan 2025 - has led to the acquittal of two persons implicated by police.
The complainant, who appeared before a Kolkata trial judge on April 24, said that two decades later, she was unable to recollect "what happened" that day and who tortured her.
The trial court, in its May 23 order, while acquitting the two accused, also criticised the police for shoddy investigation where none of the witnesses or evidence produced helped unravel the crime.
Additional district and sessions Judge Rohan Sinha, in his judgment, said, "Not a single witness examined by the prosecution could throw any light on the incident alleged.
Unfortunately, even the victim has turned turtle from her earlier statement."
The judge also pointed out three key lapses by the investigating officer (IO) which led to the acquittal. The judge said, "The victim could not identify the wrongdoers, but, curiously, the IO did not try to get the accused persons to face any Test Identification Parade for their identification."
The judge also noted that despite the survivor having given an in-camera testimony to a judicial magistrate, her statement under 164 CrPC was not produced in court.
Also, the Amherst Street officer-in-charge did not bother to "sign or endorse" the survivor's statement saying that she was gang-raped, which led to the FIR.
The trial court also could not rely solely on the survivor's testimony because she filed a formal application not to proceed with the same.
The judge, in his order, recorded that the survivor "firmly deposed that due to the passage of time of more than 20 years, she could not recollect exactly what happened to her on the fateful day.
She also failed to disclose the identity of the accused, nor could she identify the accused persons".
According to the case details, the survivor was engaged as a casual labourer to work in an under-construction house in Rajarhat by one of the accused. According to the FIR, which was also corroborated in the police charge sheet filed in 2004, on May 13, 2003, she was working when she was gang-raped by two persons, including the one who engaged her for work. Police, 20 years ago, got the victim medically examined, recorded her statement before a magistrate, and charge-sheeted four persons.
Two among those named in the charge sheet were arrested, while the remaining two are still absconding.

Tensions escalated in Maharashtra's Thane district on Saturday (June 7, 2025) after members of both the Eknath Shinde-led and Uddhav Balasaheb Thackeray-led factions of the Shiv Sena attempted to reach Durgadi Fort while Id-ul-Azha prayers were being offered at its foothill. According to police officials, protestors from both factions tried to ascend to the Durga temple atop the hill during the course of the Id-ul-Azha prayers being held at the base, resulting in chaos in the area. Prohibitory orders under Section 144 of the CrPC were in effect, and several protestors were subsequently detained for violating the restrictions. 'Police took measures to prevent protestors from both factions from reaching the fort. The protestors attempted to breach the barricades, triggering scuffles and a standoff with the police. We detained several members in preventive custody so that it does not escalate,' Deputy Commissioner of Police Atul Zende said. Durgadi Fort has long been at the centre of a communal dispute regarding the control of a mosque located within its premises. Access to the Durga temple is typically restricted during Id-ul-Azha to facilitate prayers at the foothill. Members of the Shiv Sena have criticised the arrangement, alleging discrimination against Hindu devotees and calling for equal access to the site. The Idgah located at the fort has been under litigation since 1976, when the Majlish-e-Mushavreen Majjid Trust filed a suit seeking control. In 2024, the court ruled in favour of the State government.

Call for police action against cow vigilante groups during Eid in Bengaluru
A group of concerned advocates, researchers, and social activists have alleged rising cow vigilantism in Bengaluru during Eid celebrations, and called for immediate intervention by taking such vigilantes into preventive detention. In a statement issued on Saturday, advocate B.T. Venkatesh, along with activists Vinay Sreenivasa, Zia Nomani and Sylvia Karpagam, flagged instances of cow vigilantism over the last few days by Hindutva activist Puneeth Kerehalli, who is notorious for such raids. Over the last three days in the run up to Eid, Puneeth Kerehalli has conducted at least three 'raids' in which he trespassed into private properties and took away cattle in the garb of 'rescuing' them in Tannery Road, Ahmednagar, and Shivajinagar. He has broadcast these acts live on his Facebook page. He was detained by R.R. Nagar police over one such incident, but was later released, sources said. Notably, this is not the first time Puneeth Kerehalli has carried out such acts. He was arrested for murder in 2023 when a cattle transporter was killed during one such acts of vigilantism by him. The complaint, submitted to the Bengaluru City police, calls for the preventive detention of such individuals under relevant provisions of the CrPC or the Goonda Act. The group claims that these activities are being carried out under the guise of animal rights enforcement, but amount to criminal trespass and communal provocation. No response from city police The activists lamented the lack of any urgency or response from Bengaluru City police even after they flagged these incidents. 'Despite the urgency, physical copies of the complaint submitted to the offices of DCP West, DCP East, and DCP North were not acknowledged or accepted, citing Bakrid holiday and non-availability of officials for receiving tapal (official correspondence). This lack of acknowledgement during a time of high communal sensitivity is deeply concerning,' the statement read. The activists stated that the complaint has also been emailed to senior police and government officials, including the Bengaluru Police Commissioner, ADGP (Law & Order), and the Home Minister, among others. 'Even as the Bengaluru City police are yet to act, Mangaluru City police have registered a suo motu case against Puneeth Kerehalli for communally inflammatory language used on his Facebook live,' pointed out activist Zia Nomani. The FIR in the case, says Puneeth Kerehalli referred to some 'muslim areas' in Bengaluru as 'Pakistan'.

Piyush Jain case: Court dismisses accused application, hearing on July 4
1 2 Kanpur: Special chief judicial magistrate Kanpur Nagar Kumud Lata Tripathi on Friday dismissed the application of accused Piyush Jain and Sunil A Hirani in the much-publicised case in which the GST department had recovered approximately Rs 195 crore cash and gold bars weighing around 22 kgs. The DGGI Ahmedabad had raided perfume trader Piyush Jain's houses situated at Anandpuri Kanpur and Kannauj on December 21, 2021. The department had seized Rs 196 crore in cash and 23 kg gold from his possession. Piyush was ultimately arrested on December 27, 2021. He was bailed out after about eight months. The prosecution had made thirteen other persons accused apart from Piyush. All are currently on bail. Both accused had previously applied for the case diary and other documents as per provisions of the Cr PC which was strongly opposed by the prosecution. According to Ambrish Tandon, special prosecutor for DGGI Ahmedabad, the accused applicants pressed their demand on last date while he submitted that CD/DVD containing 479 to 11,455 pages of the charge sheet had already been provided to the counsel of Sunil A Hirani and the same had also been provided to Piyush Jain on October 20, 2023. The application was viewed as a tactic to delay the trial and thus was dismissed. The next date was fixed as July 4 for hearing. Tandon informed that the prosecution would now present its evidence.
