A key plank of Ireland's social housing delivery now hangs in the balance

There are debates about where the State should and should not get involved in the
housing
market – but no argument that one area where it needs to step in is the provision of social housing for those who do not have the resources to rent or buy in the private market. Like many areas of the housing market, there are shortages here, as shown via long local authority housing lists and homelessness figures.
So when a key Government scheme to provide more social housing is in danger of falling apart, it is noteworthy and the circumstances need to be examined. It is also clear that the decision of the Government to pull out of a public-private partnership (PPP) agreement to provide almost 500 social houses puts the whole process of using these kinds of deals to build social houses for local authorities in doubt.

Late last week, as first reported in The Journal, Government officials deciding to pull the plug on a pubic private partnership programme where a private investment consortium was to deliver almost 500 social homes in Dublin, Kildare, Sligo and Wicklow.

Nobody is saying much about the exact circumstances of this, but we can safely assume that the Department of Public Expenditure and Reform was heavily involved. A key unanswered question is why it took the Government so long to decide to pull the plug on a deal where a preferred bidder had been chosen six months ago, at which time the cost details were all known.
These public/private partnerships
had become an important route for delivery of social homes. Close to 1,000 homes were delivered under the first two partnership programmes, or ' bundles' as they are called.
The one which has now been cancelled was to be the so-called Bundle three. Four more bundles are in the pipeline involving around 3,000 further homes and the Department says these are now being reviewed. Given the cost issues with Bundle three, there must now be serious doubt about whether these will go ahead. So a key plank of Government social housing delivery now hangs in the balance.
PPPs involve a range of players. The houses are financed and constructed by a consortium – involving financiers, builders and housing managers – who then provide maintenance and tenancy management services for a 25-year period. The homes remain in the ownership of the local authorities and are handed back to them after the end of the 25-year period. The preferred bidders for Bundle three – who had also built out the second bundle – was a consortium called
Torc
, led by international financiers Equitix and the Kajima Partnerships. The consortium also involves construction companies
JJ Rhatigan
and the Spanish firm, Obrascon Huarte Lain SA (OHLA). Tenancy management services are provided by
Tuath Housing
and facilities management by Derwent for a 25-year service period.
Minister Browne has said that the department and the relevant local authorities remain fully committed to delivering the social housing in PPP Bundle three through 'an alternative procurement and delivery strategy.'
Planning permission has been granted in all cases and while the department will not comment on what happens next, one possible course of action would be for the local authorities to seek tenders to get the houses built, operating on a more traditional basis which does not involve a PPP contract to manage and maintain the properties afterward. Another option would be to re-enter talks with the consortium to see if the deal could be saved, or even if it might move forward on a different basis. Sources close to the consortium say it is keen to look at all the options.
Sinn Féin housing spokesman Eoin Ó Broin has called on the Government to provide funding to the local authorities to ensure that the houses are delivered as soon as possible. Ó'Broin has been critical of the PPP model in the past arguing that it does not deliver best value for the State. The build costs under previous two social housing PPPs have appeared broadly in line with the market, he said, but significant additional costs are built into the contract for financing, maintenance and management over the subsequent 25 years, raising questions about value for money. Dealing with problems which emerge can also be complicated for tenants, he says, given the complexity of the arrangements.
The Dáil Public Accounts Committee
also questioned the value-for-money achieved through expenditure of €639 million on the first two bundles of PPPs which delivered almost 1,000 social housing units in Dublin, Cork, Galway, Waterford, Clare, Kildare, and Roscommon. The total construction and life cycle costs were approximately €640,000 per unit, it pointed out.
A breakdown of this figure was not provided to the committee beyond it being told that actual construction costs per unit were €222,000 and €277,000 respectively for the first two bundles. The PAC said it was 'concerned that it cannot evaluate whether the units delivered through this PPP programme represent good value-for-money, as commercial sensitivity means the total cost, minus construction costs, in the tenderers' models will remain confidential 'until a specified period of time has elapsed'.'
Now, it appears, this value for money issue has come to a head. Sources say that the per unit cost – including construction but also all the other expenditure over the 25-year period – has risen sharply beyond the €640,000 per unit referenced in the PAC report, due – presumably – to rising build costs and general inflation. Some sources say that the increase could have been 20 -25 per cent or more per unit, though the figure could not be confirmed.
The costs appear to have sounded alarm bells in the Department of Public Expenditure and Reform (Dper). What is odd is that this seemed to take so long to happen – the preferred consortium had been chosen last October, there had been extensive contacts since then, contracts were about to be signed and builders were close to going on site. Crucially, sources close to the consortium say that there had been no increase in the costs involved in the project since last October, when it had been chosen as the preferred bidder. So why did it take so long for the plug to be pulled?
The agreement would have been assessed by Dper under what is called a public sector benchmark, to ensure value for money as compared to other possible forms of delivery. But this would presumably have been done before the preferred bidden decision.
The Minister for Housing says that it is determined to get the projects moving in some form. But the questions now are what delivery mechanism will be used, what will it cost and, crucially, what the delay will now be in delivery. Public procurement rules will be an issue here in finding a way forward.
Sources believe that with bundle three now in trouble, the subsequent four – which are at varying stages in the process and which were set on up exactly the same basis – are also now in doubt. The Department says that these will be reviewed 'to ensure the most appropriate procurement strategies for the delivery of these homes is selected and advanced.' This would appear to indicate uncertainty about the whole PPP approach.
In turn this means problems for one area of social housing delivery on which the Government and the local authorities would have been relying to help to meet targets. It also sends out some decidedly mixed messages to international investors at a time when the Government is trying to attract more of them to build here under its rental reform programme.
Had the plug been pulled late last year, when the costs were clear and before a preferred bidder was appointed, then there would have been more time to reassess the best way forward. Now, however, there is a messy situation with the bidding consortium and most other players – including the National Development Finance Agency (NDFA) who helps advise on these bundles – all apparently taken unawares.
The consortium has also spent significant amounts of money, including hiring staff, with a reasonable expectation that the deal would go ahead. While sources close to the consortium say they wish to find a way forward, legal action – potentially- delaying matters further must surely be a possibility if some compromise is not found. This one still has a way to run and it is difficult to see how the delivery of the planned social housing will not now be subject to serious delay.

The Government has lost the arts down the back of the sofa again. Look, it happens. It's probably nothing to worry about. It knows it's there. It hasn't abandoned the arts as if it were a failed IT project or anything. Not yet. This is about nomenclature. 'Arts' has been dropped from the name of the department in charge of it as part of a string of shake-ups, with the Department of Tourism, Culture, Arts, Gaeltacht, Sport and Media losing responsibility for tourism and the Gaeltacht and becoming the Department of Culture, Communications and Sport. [ Arts Council wrote to officials almost 60 times over botched IT project without issue being escalated Opens in new window ] On Wednesday we were treated to an official denial that this penalty was for the crime of starting with a vowel. Minister for Culture, Communications and Sport Patrick O'Donovan , as he's now known, was reportedly wary of a name change to the Department of Sport, Media, Arts, Culture and Communications because he didn't want to be Minister for Smacc. READ MORE Other acronyms were available. We could have had Cacs, which would have conjured up a lovely image every time, or Scam. My personal choice would have been to name it the Department of Sport, Arts and Communications and then dub it DoSac, in homage to the chaotic Department of Social Affairs and Citizenship from Armando Iannucci 's BBC satire The Thick of It. Asked about the Smacc theory at this week's meeting of the relevant Oireachtas committee – which still has arts in its title – the department's secretary general, Feargal Ó Coigligh , said the previous name was 'seen to be a mouthful' and the Minister was anxious that the new one be 'accessible'. Across European ministries, 'culture' was the term usually favoured. 'Culture is the normal word that's used,' he said, seeming relieved to take a break from raking over how the Arts Council spent €6.7 million on a botched, bug-riddled IT project. The upshot of the committee meeting, as summarised by its chairman, Alan Kelly of the Labour Party, was that the department has more questions to answer about its handling of that fandango. With O'Donovan opting not to appoint Maureen Kennelly for a further five-year term as director of the Arts Council , Kelly couldn't help feeling that she had become 'a sacrificial lamb'. There was some eagerness, too, about O'Donovan's scheduled appearance before the committee in early July. He may no longer be minister for the arts, but he is still, after all, the Minister in charge of the Arts Council. He's also the Minister who has backed extending the Basic Income for the Arts scheme beyond its pilot phase, though that doesn't, of course, guarantee the introduction of these financial lifelines for artists. This Coalition, like the one before it, is so good at being non-committal, and so adept at being angered and disappointed by various agencies and semi-States, that it seems a stretch to think it would bother vanishing 'arts' from the department name as part of any distancing exercise. But some believe the ditching bodes ill. Labour's arts spokesman, Rob O'Donoghue, has blasted the rebrand as shameful, saying that it sends a message – some might say an unnecessary one – to artists 'that they don't matter and aren't a priority'. Subsuming arts into 'merely culture' is symbolic of artists' status as 'the poor relation within the department', O'Donoghue suggests. It's a Smacc-down. Naturally, no one cares about 'media' being swallowed up by 'communications'. And few will remember that before the last name change, in 2020, the reconfigured department was first announced as the Department of Media, Tourism, Arts, Culture, Sport and the Gaeltacht before someone realised that this was not the correct pecking order and booted 'media' down the back. 'Arts' has, by comparison, enjoyed long spells on departmental stationery. Responsibility for it escaped the Department of the Taoiseach in 1993, when Michael D Higgins became minister for arts, culture and the Gaeltacht. Since then there have been two artsless periods – May 2010-June 2011 and August 2017-September 2020 – with culture reigning supreme both times. I've recoiled from it because of the precious way that a minority invoke it as a kind of extension of their privilege, trumpeting it as a rarefied and narrowly defined practice, replete with gatekeeping and entitlement. 'Culture', by contrast, is a word that seems to reflect the entire sweep of creativity embedded in our lives. Culture is not 'merely culture'. It's inseparable from who we are. But these semantics are only safe to explore in the abstract, divorced from concerns about political expediency – even the slightest hint that it might be convenient for the Government to jettison 'arts' from the department name is enough to render the demotion ominous and, well, artless. It's possibly either too late or too soon for a Save the Arts campaign. Still, prepare your placards. We must start one in support of the establishment of the Department of Smacc right away.

Godolphin's business sense trumps sporting narratives on both sides of the Atlantic

Many years ago, a well-known journalist did an interview for the job of sports editor in a Dublin newspaper and was asked what ideas he'd implement if successful. 'First thing I'd do is get rid of the racing,' he announced. 'It takes up too much space. And it's not even a sport. It's a business.' Such black-and-white demarcation was always going to spook the editorial horses and, thankfully, he didn't get the gig. Every professional sport is a business. No one argues the Premier League isn't sport just because it generates so many billions and so much cynicism. Racing pulls off the same combination and maybe doubles down on the cynicism given how much betting is front and centre. But rarely has business trumped sport like it did with Godolphin 's campaigning of their two best classic colts on either side of the Atlantic last week. READ MORE On Friday, a weather forecast for significant rain on Derby Day 24 hours later prompted doubts about the 2000 Guineas winner, Ruling Court, lining up for English racing's 'Blue Riband'. Godolphin's trainer Charlie Appleby said they could take out the colt if conditions got too soft. No deluge occurred before the Derby. But after jockey William Buick rode in the first race, he adjudged the ground to be good to soft. Appleby took out Ruling Court. The Derby was run on going officially described as good. Perhaps the most disillusioning element to it all was the lack of indignation at such a faint-hearted move. Amid a narrative of the Derby being the most coveted prize in racing, there was little or no surprise at the Godolphin call. Conditions weren't lightning quick. But they weren't bog-like either. Given Appleby's reassurances about the trip not being a particular worry, the defection smacked of an expedient exercise in asset protection. In the stallion business, a Guineas winner is a valuable commodity. A Derby victory should increase that value but doesn't. A St James's Palace Stakes at a mile, or an Eclipse at 10-furlongs, does, and that's where Ruling Court goes next. The usual caveats apply about Sheikh Mohammed and his team not being obligated to run any of their horses anywhere they don't want to. But it pulled the rug out of a rather frantic narrative about how special winning the Derby is. Maybe Ruling Court wouldn't have overhauled Lambourn. But maybe he would. No one will ever know. It showed a dispiriting lack of sporting pluck, but Godolphin's transatlantic timidity betrayed a woeful lack of appreciation of racing's broader picture. Their Kentucky Derby winner Sovereignty landed the Belmont Stakes with aplomb. It meant the colt has two legs of the US Triple Crown under his belt, which makes it even more astounding that he wasn't given a shot at what has always been American racing's Holy Grail. Having beaten Journalism at Churchill Downs on the first Saturday in May, it quickly became obvious that following the natural path to Pimlico for the Preakness was a non-runner. Instead, Sovereignty would be kept in reserve for the Belmont. It left Journalism to win the Preakness despite an agricultural effort by jockey Umberto Rispoli that memorably prompted rival trainer Steve Asmussen to say the Italian had ridden the winner 'like a rented mule'. Journalism was again runner-up in the Belmont. Despite his dodgem experience in Pimlico, Journalism again ran his race last weekend. Sovereignty looks to be just better than him. There's no shame in that. The real shame afterwards was the sense of 'what if?' that accompanied the winner's classic glory. All evidence suggests US racing would have had its 14th Triple Crown winner if Sovereignty had lined up in Baltimore. That he didn't was due to a meagre two-week gap between races being less than perfect. Defeat might have carried significant reputational cost. Sovereignty, ridden by Junior Alvarado, crosses the finish line to win the 151st Kentucky Derby in May. 'There was no reason physically why we couldn't have run in the Preakness. We had no excuse other than we didn't feel like it.' The Triple Crown races are crammed tightly. It's part of the challenge. The 2022 Derby winner, Rich Strike, skipped the Preakness too. But he was an 80/1 freak result. Sovereignty looks the best of his generation. The Triple Crown is the pivotal story US racing tells itself and sells to the world. It's become a much harder sell in recent years. This time no one appeared to care. Godolphin weren't feeling it. The schedule wasn't ideal, but it it's never perfect. It wasn't ideal for American Pharoah and Justify either. They at least got a shot at overcoming it. It's always easy to be plucky with someone else's horse. But the privilege of a Kentucky Derby winner comes with a responsibility too and ducking the Triple Crown challenge left another hallowed racing narrative sounding hollow. All of it ultimately comes down to Sheikh Mohammed, the man we're assured is instrumental in everything his operation does. Presumably no one makes any classic decisions before talking to him. Maybe those decisions with both Ruling Court and Sovereignty were judicious investments in commercial bloodstock good sense. But from a sporting point of view, it just looked gutless. Something for the Weekend This weekend's classic action is the French Oaks, the Prix De Diane, at Chantilly where Mandanaba (3.05) should relish the step-up in trip following her third in the 'Pouliches' last month. Henry de Bromhead has snapped up Colin Keane's services for Town and Country (2.40) in tomorrow's Listed sprint at Sandown. The filly came up just a head shy of First Instinct in Cork last month and doesn't need to step up much on that to go close.
